HomeMy WebLinkAboutORD 1990-035 ORDINANCE NO. 90-35 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING ORDINANCE NO. 82-17 WHICH ADOPTED THE CITY OF GRAPEVINE, TEXAS COMPREHENSIVE PARKS & RECREATION MASTER PLAN, APRIL, 1982 BY AMENDING SECTIONS 1 AND 2 TO INCLUDE THE 1990 COMPREHENSIVE PARKS & RECREATION MASTER �, PLAN UPDATE; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE � WHEREAS, the City Council adopted the Comprehensive Parks & Recreation Master Plan on April 20, 1982 upon the passage of Ordinance No. 82-17; and WHEREAS, the City Council desires to amend Ordinance No. 82-17 relative to the Comprehensive Parks & Recreation Master Plan, April, 1982 to incorporate the 1990 Comprehensive Parks & Recreation Master Plan Update which expands and identifies nature areas to be included in the Park System within the City; and WHEREAS, the update of the Comprehensive Parks & Recreation Master Plan is in the best interest of the public and in support of the health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section l . That all the above premises are found to be true � ° and correct and are incorporated into the body of this ordinance as if copied in their entirety. �.-.�, Section 2 . That Section 1 of Ordinance No. 82-17 is hereby amended to read as follows: "That the Comprehensive Parks & Recreation Master Plan, April, 1982 , prepared by Schrickel, Rollins, & Associates, Inc. (Land Planners and Engineers) and the 1990 Comprehensive Parks & Recreation Master Plan Update, hereinafter called the 'Approved Plan' , which are on file in the in the Office of the City Secretary, are hereby approved and adopted. " Section 3. That Section 2 of Ordinance No. 82-17 is hereby amended to read as follows: "That the 'Approved Plan' shall be filed for record in the official City records and the 'Approved Plan' shall be available to the public and to all landowners and used as an officially approved Comprehensive Parks & Recreation Master Plan by the City Administration, City Parks & Recreation Board, and City Council. " �� Section 4 . If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstance is held invalid or unconsitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 5 . The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace, and general welfare of the public creates an emergency which requires that this ordinance become effective f�`om and after the date of its passage, and it is accordingly so ordained.
