ORDINANCE NO. 90-38
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS, ABANDONING AND VACATING
A PORTION OF A SPECIAL SURFACE DRAINAGE
EASEMENT N0. 2 LOCATED IN THE BANYAN PLACE
ADDITION IN THE CITY OF GRAPEVINE, TEXAS, AS
�.� HEREINAFTER DESCRIBED; PROVIDING A
SEVERABILITY CLAUSE; DECLARING AN EMERGENCY
AND PROVIDING AN EFFECTIVE DATE

WHEREAS, a portion of a special surface drainage easement
located in the Banyan Place Addition in the City of Grapevine,
Texas, as described in Exhibits "A" and "B" attached hereto and
incorporated herein for all purposes, is not needed for public use
and will not be needed in the future for public use; and
WHEREAS, abandoning and vacating this portion of said special
surface drainage easement will relieve the City of Grapevine, Texas
from the cost and expense of maintaining said property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:
Section 1 . That all the matters stated in the preamble of
this ordinance are true and correct and are hereby incorporated
into the body of this ordinance as if copied in their entirety.
Section 2 . That a portion of the City of Grapevine ' s special
� ° surface drainage easement dedicated to the City by deed as recorded
in Volume 9465 , Page 147 of the Tarrant County Deed Records, and as
' shown in Exhibits "A" and °'B°' , attached hereto and made a part
� `� hereof, (across Lots 21R and 22R, Block 1 of the Banyan Place
Addition) is hereby abandoned and vacated for public use and the
same is hereby abandoned and vacated insofar as all public right,
title, and interest in and to said described portion of said
drainage easement is concerned.
Section 3 . That the terms and provisions of this ordinance
shall be deemed to be severable, and that if the validity of any
section, subsection, word, sentence, or phrase shall be held to be
invalid, it shall not affect the remaining part of this ordinance.
Section 4 . The fact that the present ordinances and regula-
tions of the City of Grapevine, Texas, are inadequate to properly
safeguard the health, safety, morals, peace, and general welfare of
the public creates an emergency which requires that this ordinance
become effective from and after the date of , its passage.

BEING a part of the Special Surface Drainage Easement No. 2,
originally granted by document filed in Volume 9465, Page 147 of
the Deed Records of Tarrant County, Texas, said portion of said
easement to be abandoned extends across Lots 21R and 22R in Block
1, of said Banyan Place as shown by plat filed in Cabinet "B",
Slide 249 of the Plat Records of Tarrant County, Texas, and said
part being more particularly described as follows:
BEGINNING at a point in the north line of said �ot 21R, and the
south line of Lot 20, Block 1, Banyan as shown by plat filed in
Volume 388-217, Page 16 of the Deed Records of Tarrant County,
Texas, said point being S 88 ° 49' 14" W, 25. 02 feet from the
common easterly corner of said two lots;
THENCE S 43 ° 44 ' 07" E, 14 . 14 feet;
THENCE S 1' 15 ' S3" W, parallel to and five (5) feet westerly
from the east line of said original easement, and said line also
being 15 feet west of and parallel to the east line of said lots,

for a distance of 179 .75 feet to a point;
THENCE S 46' 15' S3" W, 7. 07 feet to a point on the south line of
�:_„� said Lot 22R and the north line of Lot 24, Block 1, Banyan Place
, as shown on said plat filed in Volume 388-217, Page 16 of said
deed records, said point being S 88 ° 23 ' 33" W, 20. 03 feet from
the common easterly corner of said two lots;
THENCE S 88° 23 '33" W, with said lot line 5. 01 feet to a point on
the original westerly line of said easement;
THENCE N 1' 15' S3" E, with said original line 195 . 00 feet to the
place of beginning and containing 1, 886 square feet of land.
