HomeMy WebLinkAboutRES 1998-033 RESOLUTION NO. 98-33 ,�..�, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, DIRECTING STAFF TO PROCEED WITH SUBMITTAL OF A GRANT APPLICATION FOR PARTICIPATION IN THE TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS' TEXAS HOME INVESTMENT PARTNERSHIP PROGRAM; PROVIDING FOR A COOPERATIVE AGREEMENT WITH GRACE, INC. AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council has identified the need to provide affordable, low cost housing and also is of the opinion that preserving, rehabilitating and revitalizing existing homes, historic or non-historic, is critical to the revitalization of the City of Grapevine; and WHEREAS, the City Council has created the Grapevine Township Revitalization Project, Inc., a non-profit corporation exempt from taxation under Section 501 (c)(3) of the Internal Revenue Code, to provide opportunities for ownership of historic homes to families with low to very low income and to assist in revitalizing and preserving the existing historic - homes within the boundaries of the original town of Grapevine; and � . WHEREAS, Grapevine Relief and Community Exchange (GRACE), Inc. has expressed interest in cooperating with the City of Grapevine to provide affordable housing to low and very low income households; and WHEREAS, the Texas Department of Housing and Community Affairs has made available public housing funds available as loans or grants to provide decent, safe and sanitary housing for low, very low and extremely low income single family owner occupied households; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the preamble of this resolution are true and correct and are hereby incorporated into the body of this resolution as if copied in their entirety. Section 2. That a Grant Application for $200,000 by the Grapevine Township Revitalization Project, Inc. in cooperation with GRACE, Inc. be submitted for participation °'�` ` in the Texas Department of Housing and Community Affairs' Texas HOME Investment Partnership Program. Section 3. That the City of Grapevine has committed to assisting with a nine percent (9%) cash match, one percent (1%) cash donation through the waiving of usual ��.,� and customary Permit and Inspection Fees, twelve percent (12%) leveraging of professional services and that GRACE, Inc. has committed to assisting with a five percent (5%) cash match. Section 4. That the purpose of the Grant Application is to: A. Provide much needed funding for the rehabilitation and revitalization of existing low income housing within the City of Grapevine. B. Participate in State Funds for the benefit of the City of Grapevine. Section 5. That the following attached documents are hereby approved: A. Memorandum of Agreement between the Grapevine Township Revitalization Project, Inc. and GRACE, Inc. Section 6. That the appointee to the Township/GRACE Advisory Board is as follows: � A. Roger Nelson �_ � Section 7. That the development and implementation of the Grant Application and project be coordinated through the City of Grapevine Township Revitalization Project. The City Council hereby authorizes the City Manager, or his designated representative, to enter into the agreement and all other necessary documents with the Texas Department of Housing and Community Affairs in connection with the grant application and project. Section 8. That this resolution shall be effective from and after the date of its passage. (GTRP)AND �`� GRAPEVINE RELIEF AND COMMUNITY EXCHANGE, INC. (GRACE) REGARDING IMPLEMENTATION OF THE TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS' (TDHCA) TEXAS HOME INVESTMEN7 PARTNERSHIP PROGRAM FUNDS FOR PROVIDING SAFE,AFFORDABLE, LOW COST HOUSING THROUGH REHABILITATION AND REVITALIZATION OF EXISTING HOMES IN GRAPEVINE,TEXAS WHEREAS, the City Council of the City of Grapevine, Texas and GRACE�have identified the need to provide affordable, low cost housing and the need rehabilitate and revitalize existing housing within the City of Grapevine and particularly in the Hill Neighborhood; and WHEREAS, the City Council has created the GTRP, a non-profit corporation exempt from taxation under Section 501 (c}(3)of the Internal Revenue Code, to assist in revitalizing and preserving the existing historic homes within the boundaries of the original township of Grapevine; and WHEREAS, GRACE, a local non-profit corporation exempt from taxation under Section 501 (c)(3)of the Internal Revenue Code, was created for the sole purpose of providing food, clothing and other emergency assistance to people who are in need and strives to offer compassion and aid to those families who, for no single reason, are suffering from financial or other setbacks and r- - WHEREAS, the TDHCA has made available public housing funds available as loans or grants to provide decent, safe and sanitary housing for low, very low and extremely low income single family owner �,.:; ... occupied households; NOW,THEREFORE, The City of Grapevine, through GTRP, and GRACE agree to implement any HOME funds for rehabilitation and revitalization of low and very low income housing in Grapevine in accordance with the following Stipulations: STIPULATIONS A. APPLICATION The City of Grapevine, through GTRP, will process, complete and forward the application to TDHCA for HOME funds. B. CASH DONATIONSlMATCH/LEVERAGING The parties to this MOA agree to match/donate/leverage the following: City of Grapevine: Ten percent(10%) cash match, or the equivalent of�20,000. One percent(1%) in-kind donation through the waiving of usual and customary Permitting and Inspection Fees, or the equivalent of 52,000. Through GTRP, twelve percent (12%) leveraging through donation of Professional Architectural and Engineering Services consisting of evaluating properties, execution of construction drawings and �" ' specifications, bidding and construction administration of rehabilitations, or the equiva►ent of�24,000. �:� EXNiBIT...�-- 1'0 -��— Page .�..�- of ' - GRACE Five percent(5%)cash match or the equivalent of�10,000. C. IDENTIFICATION,SCORING AND SELECTION OF ELIGIBLE HOUSEHOLDS " " GRACE, through the GRACE Scoring Committee agrees to identify, assess and select applicants (households)from the City of Grapevine for award of grants from the TDHCA for the �ehabilitation of low and very low income housing. Upon identification and selection of applicants, the GRACE Scoring Committee will make a formal recommendation to the Township/GRACE Advisory Board. The Township/GRACE Advisory Board will then consider all the applications and make a final decision on which households receive HOME funding. D. REHABILITATION OF EXISTING HOUSING The City of Grapevine, through GTRP, agrees to: 1. Evaluate and assess housing (selected by GRACE)for grant awards for feasibility of rehabilitation versus reconstruction. 2. Provide construction drawings and specifications for selected properties. 3. Publicly and competitively bid and award the proposed rehabilitations. 4. Provide construction administration which will include contracting, field reports, change orders (if required), processing payment applications, making partial and final payments to contractors and requirements of final closeout(warranties, affidavits, bond releases, etc). ' E. MINIMUM STANDARDS The City of Grapevine,through GTRP, agrees to ensure that completed work shall be in 'y F accordance with the TDHCA's Texas Minimum New and Rehabilitatron Construction Standards. Where the house is determined to be a historic house, the completed work shall also be in accordance with the Secretary of the Interior's Standards for the Treatment of Historic Properties. F. DISPUTE RESOLUTION Should either party to this agreement object, within 30 days of any action or decision, to any of the award recipients, plans or documents required pursuant to the terms of this Memorandum of Agreement, all parties shall consult with each other to resolve the objection. G. PUBLIC OBJECTIONS Should an objection pertaining to this Memorandum of Agreement be raised by any member of the public at any time during the implementation of the measures set forth in the Agreement, the parties to this agreement shall consult with the objector and should the objector request, with the TDHCA to resolve the objection. H. REPORT The City of Grapevine, through GTRP, will provide a Program Close-Out Completion Report to TDHCA and GRACE six months after conclusion of the rehabilitation work. AMENDMENTS ' Any parties to this agreement may request that it be amended or added thereto, whereupon the ,.�A.:, parties will consult to consider such amendment. if parties agree with such amendment or addendum, it wiil be executed in the same manner as the original Agreemen . J. TERM The term of this Agreement shall commence on the latest date of execution shown hereon and shall terminate two(2)years following the date of execution of an agreement with TDHCA HOME Investment Partnership Program.
