A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS MAKING FINDINGS OF CERTAIN
FACTS RELATIVE TO THE PURCHASE OF A MUNICIPAL
COURT COMPUTER SYSTEM; DETERMINING THAT THE
SYSTEM IS AVAILABLE FROM ONLY ONE SOURCE;
AUTHORIZING THE PURCHASE FROM INCODE, INC. IN
THE AMOUNT OF $52,091.00; AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, Incode, Inc. is the sole provider of a Municipal Court Computer System
under the patents and copyrights held by Incode, Inc., and
WHEREAS, the City Staff has been unable to locate anyone except Incode, Inc.
who offers a Municipal Court Computer System under the patents and copyrights held by
Incode, Inc. and
WHEREAS, the City Staff has determined the need to purchase a Municipal Court
Computer System.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS:
Section 1. That all of the above premises are found to be true and correct and
are incorporated into the body of this resolution as if copied in their entirety.
Section 2. That the City Council authorizes the purchase of the Municipal Court
Computer System from Incode, Inc. in the amount of$52,091.00.
Section 3. That the City Manager, or his designee, is authorized to take all steps
necessary to consummate the purchase of the authorized system provided in section 2.
Section 4. That if any section, article, paragraph, sentence, clause, phrase or
word in this resolution, or application thereof to any persons or circumstances is held
invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect
the validity of the remaining portions of this resolution; and the City Council hereby
declares it would have passed such remaining portions of the resolution despite such
invalidity, which remaining portions shall remain in full force and effect.
Section 5. That this resolution shall be effective from and after the date of its
passage.
