A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE AUTHORIZING THE CITY MANAGER TO
'`�`"' MAKE APPLICATION TO THE TEXAS NATURAL
RESOURCE CONSERVATION COMMISSION FOR AN
AMENDMENT TO CERTIFICATE OF ADJUDICATION NO.
2362 FOR LAKE GRAPEVINE AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the City of Grapevine owns Certificate of Adjudication No. 08-2362
which authorizes the City to impound 26,250 acre feet of water per annum from Lake
Grapevine and to divert and use for municipal purposes not to exceed 26,250 acre feet
of water per annum; and
WHEREAS, the City of Grapevine desires to add irrigation use as an authorized
purpose under Certificate of Adjudication No. 08-2362; and
WHEREAS, on November 6, 1998, the Executive Director of the Texas Natural
Resources Conservation Commission served notice on the City of Grapevine that he
would petition the Commission to amend water rights in Lake Grapevine owned by the
City of Grapevine, the City of Dallas County Park Cities MUD No. 1; and
WHEREAS, the Executive Director's petition fails to recognize the City of
Grapevine's historical reliance upon and reuse of the City's treated sewage effluent
; a which is discharged into Lake Grapevine.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS;
Section 1. That all matters stated in the preamble of this ordinance are true
and correct and are hereby incorporated into the body of this ordinance as if copied in
their entirety.
Section 2. That the City Manager of the City of Grapevine is hereby authorized
and directed to file an application with the Texas Natural Resources Conservation
Commission to amend Certificate of Adjudication No. 08-2362 to add irrigation use as
an authorized purpose and to obtain the right, authority and recognition to continue to
divert and reuse the City's return flow into Lake Grapevine.
Section 3. That the City Manager of the City of Grapevine is hereby authorized
to employ such persons as necessary, and to expend funds as necessary to accomplish
the amendment of Certificate of Adjudication No. 08-2362.
Section 4. That this resolution shall become effective from and after the date
