HomeMy WebLinkAboutRES 1998-002 � RESOLUTION NO. 98-02 � A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS FINDING THAT AN EMERGENCY EXISTED ON NORTHWEST HIGHWAY NECESSITATING THE INSTALLATION OF A TRAFFIC SIGNAL AT THE INTERSECTION OF RUTH WALL STREET AND NORTHWEST HIGHWAY; NEGATING THE NECESSITY TO ADVERTISE FOR COMPETITIVE BIDS; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE WHEREAS, Texas Department of Transportation's (TxDOT's) contractor recently began its Northwest Highway Paving and Drainage Reconstruction Project; and WHEREAS, the condition existed that adequate sight distance was impaired at the intersection of Ruth Wall Street and Northwest Highway due to the erection of concrete traffic barriers; and � R WHEREAS, the traffic signal warrants as required by the Texas Department of Transportation were met; and � WHEREAS, it was necessary to erect a traffic signal due to increased traffic generated from the recently constructed Grapevine Mills Mall without complying with the competitive bidding process requirements of the Tex. Rev. Civ. Stat. Ann. Art 2368a; and WHEREAS, Durable Specialties, Inc. was able to respond immediately with the wherewithal to erect traffic signal improvements at a cost of$21,350.00; and WHEREAS, the City Staff has requested the City Council to find that an emergency did exist, that it was valid, legal and correct to waive the statutory competitive bidding requirements, to ratify all actions of the City Staff relative to the soliciting the repair and awarding said contract to the firm submitting the invoice. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: 1. That all matters stated in the preamble are found to be true and correct and are incorporated into the body of this resolution as if copied in their entirety. � 2. That the City Council does hereby find that an emergency existed on Northwest �" Highway, that all actions taken by the City Staff were necessary and correct, that it was valid, legal and correct to waive the statutory competitive bidding requirements, and that � the contract for the erection of the traffic signal by Durable Specialties, Inc. is hereby approved and ratified. 3. That this resolution become effective from and after the date of its passage. PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS on this the 20th day of .lanuary , 1998.
