HomeMy WebLinkAboutRES 1998-016 �y;� RESOLUTION NO. 98-16 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF � GRAPEVINE, TEXAS AUTHORIZING AND DIRECTING STAFF TO PROCEED WITH THE EXECUTION OF THE GRAPEVINE TOWNSHIP REVITALIZATION GRANT PROGRAM FOR THE PRESERVATION, RESTORATION, REHABILITATION AND RECONSTRUCTION OF HISTORIC HOMES WITHIN THE BOUNDARIES OF THE ORIGINAL TOWNSHIP; PROVIDING FOR AN APPLICATION PROCESS FOR AWARDING GRANTS; AUTHORIZING THE CITY MANAGER OR HIS DESIGNATED REPRESENTATIVE TO ACT AS THE CITY'S AUTHORIZED REPRESENTATIVE IN ALL MATTERS PERTAINING TO THE GRANT; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City Council of the City of Grapevine, Texas has identified the need to revitalize and preserve the existing historic homes within the boundaries of the Original Town of Grapevine; and WHEREAS, the City Council has created the Grapevine Township Revitalization ,,; _� Project, Inc., a non-profit corporation exempt from taxation under Section 501(c)(3) of the Internal Revenue Code, to assist in revitalizing and preserving the existing historic ��;,..� homes within the boundaries of the original town of Grapevine; and WHEREAS, the City Council has concluded that the creation of a grant program will further assist in revitalizing and preserving the existing historic homes within the boundaries of the Original Town of Grapevine; and WHEREAS, the Grapevine Township Revitalization Project will revitalize and preserve the historic homes in accordance with the Secretary of the Interior's Standards for the Treatment of Historic Properties. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all matters stated in the preamble of this resolution are true and correct and are hereby incorporated into the body of this resolution as if copied in their entirety. Section 2. That the following attached documents are hereby approved: A. Guidelines—Township Revitalization Grant Program (Exhibit "A"). B. Application (Exhibit "B"). C. Preservation Agreement (Exhibit "C"). _ Section 3. That the City Manager, or his designee, is authorized and directed to act in all matters in connection with this grant. "�`� Section 4. NO. 98-�6 2 ��tMIBI�',.�,�, T4 - � GUIDELINES . ��� � 6 TOWNSHIP REVITALIZATION GRANT PROGRAM °� 1. Purpose of the Grant Funds. The goals of the Grapevine Township Revitalization Grant Program are to presee the cultural heritage of the original township of the City of Grapevine through the preservation,restoration,rehabilitation and/or reconstruction of historic homes in the original township. 2. Application Dates. Applicants must complete a grant application form and meet the following deadlines: Spring Grants App(ication Deadline March 1 Fall Grants Application Deadline October 1 Notification dates for grant awards are: Spring Grants Notification May 1 Fall Grants Notification December 1 Recommendations for grants will be presented to the Grapevine Township Revitalization Advisory Board for approval in April and November of each year. 3. General Criteria. Grant funding is available only for: * Owner-occupant residential uses and * limited to(as defined by the Secretary of the Interior's Standards for the Treatment of Historrc Properties-see attached)exterior preservation,restoration,rehabilitation and/or reconstruction of historic homes in existing historic districts or historic homes determined eligible for Landmark " " designation by the Grapevine Historic Preservation Commission within the boundaries of the original township(refer to attached map for boundary locations). �`` � Grant funding is NOT available for purchase or rental of tools,machinery,equipment or Owner's time spent on work. Each appiication wil(be evaluated on its merits as a viable project and on how it relates to the Township's goals. Applicants must describe the project and include drawings,specifications, photographs(historic,where available),budgets and schedule. Grant recipients agree to sign a Preservation Agreement and to designate their property a Historic Landmark in accordance with the City of Grapevine's Comprehensive Zoning Ordinance, Section 39. Refer to attached example. 4. Funds Grant funds must be used within 12 months from the date of notification,or the grant becomes void. The maximum grant to be awarded to one property within any one calendar year is$5,000. Grant funding is handled on a reimbursement and matching(one to one)basis. Previously(within 2 years)completed exterior work will be allowed to count as a match if the work complies with the Secretary of the Interior's Standards jor the Treatment of Historic Properties. The owner's own work ("sweat equity")into this project grant request will not count towards the required match. The Grapevine Township Revitalization Program reserves the right to observe and monitor the project prior to payment and/or to make payment directly to a Contractor(where payment is not on reimbursement basis). -= Ninety percent(90%)payment of the grant will be disbursed only when: * there is evidence that the project is completed,such as receipts for work completed(including ;�Q,ms * copies of paid receipts)are received and the work passes inspection by the City of Grapevine Building Inspections Department(where required)and Ten percent(10%)payment of the grant will be disbursed only when: `�'� * after the property is officially designated historic landmazk status by the City of Grapevine and * after non-conforming work is modified where required by the Grapevine Historic Preservation _ Commission and/or the City of Grapevine Buildings Inspections Department(for achieving final inspection). Payment may be withheld if the work fails to meet the Secretary of the Interior's Standards for the Treatment ojHistoric Properties. 5. Repayment. Grant recipients must repay all the funds if any of the following circumstances occurs within three(3) years of completion of the project: * The building is not maintained to City of Grapevine Building Code. * Historic Landmark designation is removed. * Properiy is conveyed to another within three(3)years of completed work. * Property changes from Owner occupied residential use to another. * Owner performs or arranges for other work(not under this Agreement)materially detracting from the historic character or fabric of the exterior of the house. 6. Conditions of Assistance. The Applicant shall agree to formally initiate and designate their property a City of Grapevine Historic Landmark prior to reimbursement of money. The Applicant may need to establish,to the satisfaction of the Grapevine Township Revitalization Advisory Board,the amounts of other committed funds to be used for the project. � � The Applicant shall comply with all permitting requirements of the City of Grapevine Code of Ordinances and the Comprehensive Zoning Ordinance. �=�� The Applicant must provide a budget and schedule which sets out time frames in which the work will be accomplished. Title: Applicant must provide proof of ownership and liens or encumbrances filed against the property. Notification: In cases of transfer of titie or whenever legal action is pending which may result in foreclosure on the property,the applicant must notify the Grapevine Township Revitalization Advisory Board. Changes in Use: If use of the property changes in use from that existing or proposed at the time of funding,the applicant must notify the Grapevine Township Revitalization Advisory Board. 7. Miscellaneous. Those who have projects published agree to acknowledge the support of the City of Grapevine and the Grapevine Township Revitalization Project,Inc. It is also understood that the Grapevine Township Revitalization Program may seek public recognition for its contribution to any grants funded project. Applications are available from Hugo A. EXMIqi�'_: Yb . � . . _,...�..._„ f�age ._. _ df � ��� Preservation Agreement Township Revitalization Grant Program �� Whereas this Preservation Agreement(Agreement)is entered into between the Grapevine Township Revitalization Project, Inc.(Township)and (Owner);and Wlicreas the Owner will use funds made available through the Township Revitalization Grant Program(Program) for exterior preservation,restoration,rehabilitation and/or reconstruction(Work)of the historic House, which is owned and occupied by the Owner;and Whereas the purpose of this agreement is to set forth the responsibilities of the Township and the Owner in the payment,construction and reporting of the Work;and Whereas the Owner has made application under the Program for financial assistance for Work to the House,which is located at an officially designated landmark or property eligible for designation as landmark in the City of Grapevine;and Whereas such application was recommended for$ by the Township Advisory Board on . 1998;and Whereas the Owner will commence work on ,now therefore, Be it agreed by the Township and the Owner as follows: , Term The term of this Agreement shall commence on the latest date of execution shown hereon and shall terminate three �� , (3)years following the date of completion of the Work. Repavment The Owner shall promptly repay all amounts paid by the Township in the event that during the term of this ` agreement: l. Exriisir� ro _���' Page �- � of ______. , Insurance.Liabilitv and Indemnification The Owner is prohibited from expending funds made available through the Program to purchase any insurance `��' regarding the Work under this Agreement. The Owner shall carry casualty,fire and federal flood insurance(if applicable). The Owner acknowledges that he/she has read the guidelines for the grant program included with the application and agree to all of the terms and conditions contained in the guidelines and further agrees that any contractors hired for this project will hold contractors licenses for the City of Grapevine. The Owner acknowledges that the Township is merely granting funds in connection with the work or project, and that neither the Township,the Grapevine Historic Preservation Commission or the City of Grapevine is or will be responsible for satisfactory performance of the work,or payment for the same beyond the grant by the Township. The Owner also acknowledges that he/she is solely responsible for selecting any contractors hired in connection with the project and in requiring satisfactory performance by such contractor. The Owner agrees to indemnify and hold harmless the Township,the Historic Preservation Commission and the City of Grapevine, its agents,servants,employees,and officers against losses,costs,damages,expenses and liabilities of any nature directly or indirectly resulting from or arising out of or relating to the Township's acceptance,consideration,approval or disapproval of this agreement and the issuance or non-issuance of a grant. Notice The Owner shall provide the Townsliip with at teast two(2)weeks notice of any intended transfer of title,any encumbrance on title or pending legal action which may result in foreclosure of property.
