T. Hardy noted the proposed location of the convenience store was in the Treepoint Plaza shopping center at the � � northwest corner of S.H. 121 South and Timberline Drive. The tract was ; currently zoned "CC" Ccermunity C�rcial, with a conditional use requested = for the storage, possession, reta.il sale, and off-premise consiunption of � alcoholic beverages (beer only) . � : Mr. Fred Fayyazi, representing the applicant, then gave a brief presentation � requesting favorable consideration for off-premise beer sales. f ; ; i � � There being little discussion, Mayor Pawers asked if any guests present wished ; to speak for or against the request. ' ; z € The public hearing was declared open by Mayor Pavers. � � Director of Ccxrmunity Develognent H. T. Hardy advised the tract in question � contained 8.93 acres located south of Timberline Drive and east of the R proposed Heritage Avenue (west of the Los Robles Estates subdivision) . � �. Current zoning on the property was "R-20" Single-Family Dwelling District, � with the request for "R-7.5" Single-Family Dwelling District. � � The applicant's representative, Mr. Scott Cline, addressed the Council and y Cannission. He reviewed surrounding land uses and noted the reclamation plan € for the flood plain area across this tract. � � Questions and c�nts fran the Council and Commissioners follawed. Topics of � discussion included access to the site, the flood plain area and reclamation �' plans, and the number of single-family lots proposed. � Mayor Powers then invited those present to offer co�ments. Ms. Becky Carlson, s 2410 Los Robles Drive, spoke in opposition to the zone change request. She � felt no develogr�nt was appropriate until access was provided on Heritage � Drive. There was no correspondence to report. � � Commissioner Martin then made a motion that the public hearing be closed. None ' Absent: Dyer � PUBLIC HEARIl�iG, ZONING APPLICATION Z86-04, DAVID FIELDING (HAI.I� TRACT) � , � The next order of business was for the City Council and Planning & Zoning € Coimussion to conduct a public hearing relative to Zoning Application Z86-04 � sulsn.itted by David Fielding & Tim Sralla. � Mayor Pawers declared open this public hearing and the next two public a hearings, since all three requested the same zoning district change and were all located in the Hall-Johnson/Parr Rpad area. Haaever, separate pre- � sentations were given by each applicant and public comments w�ere taken on all � � three cases. � �. Director of Community Develogneilt H. T. Hardy advised Z86-04 included � approximately 50 acres of land located north of Hall�7ohnson between Pool Road � and Parr Ftoad (the Jess Hall tract) . The tract was presently zoned "R-20" �. Single-Family Dwelling District, and the requested zoning was for "R-12.5" � Single-Family Dwelling District. � � � City Attorney John Boyle advised the one year waiting period to reconsider a x previously denied zoning request did not apply in this case, even though a � similar request was heard in October, 1985 (Z85-24, Joyce-Myers) . It was his ; opinion this case was substantially different, as it included a much larger �: �: � (2) � �: � g � 03/18/86 tract of land. In addition, the Council 5-2 vote to approve Z85-24 did not regularly constitute denial, although the case was denied due to the 20 percent rule and lack of a 3/4 vote. Mr. David Fielding, representing the owner of the property, then review�ed the history of the tract and the rezoning efforts. He noted the current "R-12.5" request eliminated a 210-foot strip abutting the Marsh Lane homes, which w�uld remain "R-20". Arc�unP.nts supporting the "R-12.5° district w�ere given, and Mr. Fielding presented slides of surrounding land uses. � � Mr. Jess Hall, 3324 Ha.11-Johnson Road, owner of the 50-acre tract, then , solicited favorable consideration of the zoning request. Lengthy deliberation follawed this presentation. Concerns of the Council and Conmissioners included the econamics of the case, justification of "R-12.5" zoning, clarification of the proposed develo�anent area, and location of the utilities on the eastern portion of the tract. Mayor Pawers then invited public testimony fran the audience. Mrs. Josie Stettler, 3504 Barberry, inquired about sidewalks in this develognent and along Pool Road when fully developed. The following letters w�ere then read ; into the record: March 14, 1986 `` � E Grapevine City Council 413 Main Street ' Grapevine, Texas 76051 { ; Dear City Council Nl�mbers: As we are unable to attend the public hearing on the proposed zoning ; � request for the land south of Marsh Lane and east of Pool Road, we w�uld like to be recorded as being in opposition to this request. Any downzoning of this property for higher density population should be carefully considered for the impact it will bring to already ' inadequate road syst�ns. In addition, there is the possibility of a � resulting decrease in property values for surrounding lando�mers. ` Finally, it is part of the last remaining "R-20" land in Grapevine, $ which areas of Southlake and Colleyville have proven is still a x highly desirable land designation. It could still be developed profitably at "R-20". This piece of land was once offered to property owners on Marsh Lane who all agreed to purchase the land directly behind their own � property in order to keep it open. The awner's asking price was ? ; � € (3) � i � � 03/18/86 agreed upon by all buyers, who were subsequently told that Mr. Hall had decided not to sell the land after all. When the master plan for the city was being considered, the owner of this property had ample opportunity to request a zoning change at that time and chose not to do so. We see no reason that the change should occur at this time. I live at 3518 Hightiunber Drive in � Grapevine. I w�uld like to speak out in favor of the zoning � application by Mr. Jess Hall. Since I am unable to attend tonight � this letter will have to suffice. A majority of the homeowners on � Hightimber and High Countryside Drive have expressed an opinion for � the rezoning this time as they had expressed an opinion favoring the �: "R-12.5" rezoning application the last time this issue was raised. � ,: I would hope that with the passage of this rezoning case that the � developer w�uld still consider underground utilities in that # develognexit. With the absence of trees, the underground utilities � would greatly enhance the area, giving it an uncluttered look and �: retaining a semi-rural look. ` Consider, if you will, the difference betw�een the "R-12.5" and ` "R-20" is not much more than the area of the roan in which you meet � tonight. So far, it has split neighbor against neighbor, and has ` tied up city time and assets. � E "R-12.5" is sufficient and deserves favorable oonsideration. Thank � you for your time. This public hearing had been declared open earlier by Mayor Powers. Director of Ccamunity Develognent H. T. Hardy reported this application included approxim�tely 5.5 acres of land located north of Hall�ohnson Road " and west of Parr, between Parr Road and High Country Estates. The request was for a change in the zoning fran "R-20" Single-Family Dwelling District to "R-12.5" Single-Family Dwelling District. � � Mr. Fred Joyce, applicant, addressed the Council and Commission Members. Mr. � Joyce noted his intent to develop the property, if approved, as Pha.se III of �: High Country Estates. Utilities and access to the tract, as well as s surrounding zoning and land uses were reviewed. °� Questions and comments frcen the Council and Commissioners followed this presentation.
