City Secretary STATE OF TEXAS COUNTY OF TARRANT CITY OF GRAPEVINE The City Council of the City of Grapevine, Texas met in Special Session (Executive Session) on this the 3rd day of October, 2000 at 7:15 p.m. in the City Council Conference Room, Second Floor, 200 South Main Street with the following members present to-wit: William D. Tate Mayor Ted R. Ware Mayor Pro Tem Sharron Spencer Council Member C. Shane Wilbanks Council Member Clydene Johnson Council Member Darlene Freed Council Member constituting a quorum, with Council Member Roy Stewart absent, with the following members of the City Staff: Roger Nelson City Manager Bruno Rumbelow Assistant City Manager John F. Boyle, Jr. City Attorney Linda Huff City Secretary Melisa Leal Assistant to the City Manager CALL TO ORDER Mayor Tate called the meeting to order at 7:15 p.m. ITEM 1. EXECUTIVE SESSION Mayor Tate announced the City Council would conduct a closed session regarding (A) real property regarding property acquisition on Barton Street and (B) conference with City Manager and Staff to receive information relative to economic development prospects under Sections 551.072 and 551.075, Texas Government Code. Upon reconvening in open session in the Council Chambers, Mayor Tate asked if there was any action necessary relative to the closed session. City Manager Roger Nelson stated there was no action necessary relative to (A) real property regarding property acquisition on Barton Street and (B) conference with City Manager and Staff to receive information relative to economic development prospects under Sections 551.072 and 551.075, Texas Government Code. NOTE: City Council continued with the Regular City Council meeting in open session in the Council Chambers. 10/03/00 ADJOURNMENT Mayor Pro Tern Ware, seconded by Council Member Johnson, offered a motion to adjourn ,. the meeting at 7:40 p.m. The motion prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson & Freed Nays: None Absent: Stewart PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS on this the 17th day of October, 2000. CITY COUNCIL CHAMBERS SECOND FLOOR 200 SOUTH MAIN STREET CALL TO ORDER INVOCATION: Mayor Pro Tern Ted R. Ware CITIZEN COMMENTS NEW BUSINESS 1. Consider an ordinance amending the Grapevine Code of Ordinances, Chapter 23 Traffic, Section 23-27 Speed Limits-Schedules of additional school zones to establish a school zone on Park Boulevard and take any necessary action. CONSENT AGENDA Consent items are deemed to need little Council deliberation and will be acted upon as one business item. Any member of the City Council or member of the audience may request that an item be withdrawn from the consent agenda and placed before the City Council for full discussion. Approval of the consent agenda authorizes the City Manager, or his designee, to implement each item in accordance with Staff recommendations. 2. Consider a resolution authorizing a Tower and Ground Lease Agreement with VoiceStream Wireless for the collocation of telecommunications equipment at Dove Water Tower. Staff recommends approval. 3. Reconsider motion approving Ordinance No. 99-50 adopted March 23, 1999 to correct typographical errors in said ordinance that amended the Grapevine Code of Ordinances, Appendix "D", Comprehensive Zoning Ordinance No. 82-73, as amended, Section 25 "CC" Community Commercial District Regulations and Section 67 Amendments. City Secretary recommends approval. 4. Consider an ordinance amending the Grapevine Code of Ordinances, Chapter 23 Traffic, Section 23-63 No Parking Zones, Restricted Parking Zones to establish no parking zones on Barton Street and Franklin Street. Public Works Director recommends approval. 5. Consider an ordinance amending the Grapevine Code of Ordinances, Chapter 23 Traffic, Section 23-26 Speed Limits-Schedule for Certain Public Streets and Ways to establish a 45 mph speed zone in both directions on Grapevine Mills Boulevard North between Grapevine Mills Parkway (FM2499) and State Highway 121 southbound service road. Public Works Director recommends approval. 6. Consider amending the design contract with Cheatham and Associates for the Scribner Street 20" Waterline Project and authorization for Staff to execute said amendment. Public Works Director recommends approval. 7. Consider a resolution authorizing an Interlocal Agreement with Tarrant County for a Cooperative Purchasing Program and authorization for the Mayor to execute said agreement. Staff recommends approval. 8. Consider the minutes of the September 19, 2000 City Council meetings. City Secretary recommends approval as published. ITEM 1. ORDINANCE, AMEND CHAPTER 23 TRAFFIC City Manager Roger Nelson recommended approval of an ordinance amending the Grapevine Code of Ordinances, Chapter 23 Traffic, Section 23-27 Speed Limits-Schedules of additional school zones to establish a school zone on Park Boulevard. The new school zone would extend from the intersection of Park Boulevard and Dove Road to the intersection of Park Boulevard and Big Bend Drive for a distance of 875 feet. Motion by Council Member Wilbanks, seconded by Council Member Johnson, to approve as recommended prevailed by the following vote: 10/03/00 Ayes: Tate, Ware, Spencer, Wilbanks, Johnson & Freed Nays: None Absent: Stewart ORDINANCE NO. 2000-102 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS AMENDING THE GRAPEVINE CODE OF ORDINANCES, CHAPTER 23 TRAFFIC, SECTION 23-27 SCHEDULES OF ADDITIONAL SCHOOL ZONES, ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF SECTIONS 167 AND 169 OF ARTICLE XIX, R.C.S. 6701 d, UNIFORM ACT REGULATING TRAFFIC ON HIGHWAYS, UPON THE BASIS OF AN ENGINEERING AND TRAFFIC INVESTIGATION UPON CERTAIN STREETS AND HIGHWAYS, OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF GRAPEVINE AS SET OUT IN THE ORDINANCE; AUTHORIZING THE ERECTION OF TRAFFIC REGULATION SIGNS; REPEALING CONFLICTING ORDINANCES; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED EACH DAY DURING OR ON WHICH AN OFFENSE OCCURS OR CONTINUES; PROVIDING A „.. SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE CONSENT AGENDA The next order of business for the City Council to consider was the consent agenda items, which were deemed to need little or no discussion and were acted upon as one business item. Mayor Tate asked if there was any member of the audience or the City Council who wished to remove an item from the consent agenda for full discussion. There were none. Item 2. Resolution, Authorize Tower and Ground Lease Agreement, VoiceStream Wireless Staff recommended approval of a resolution authorizing a Tower and Ground Lease Agreement with VoiceStream Wireless for the collocation of telecommunications equipment at Dove Water Tower. Motion by Council Member Spencer, seconded by Council Member Freed, to approve as recommended prevailed by the following vote: 2 10/03/00 Ayes: Tate, Ware, Spencer, Wilbanks, Johnson & Freed Nays: None Absent: Stewart RESOLUTION NO. 2000-49 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS APPROVING A TOWER/GROUND LEASE AGREEMENT WITH VOICESTREAM WIRELESS FOR THE INSTALLATION OF COMMUNICATIONS EQUIPMENT AT THE DOVE WATER TOWER AND PROVIDING AN EFFECTIVE DATE. Item 3. Reconsider Motion Approving Ordinance No. 99-50 Correcting Typographical Errors City Secretary recommended approval of the reconsideration of the motion approving Ordinance No. 99-50 adopted March 23, 1999 to correct typographical errors in said ordinance that amended the Grapevine Code of Ordinances, Appendix "D", Comprehensive Zoning Ordinance No. 82-73, as amended, Section 25 "CC" Community Commercial District Regulations and Section 67 Amendments. Motion by Council Member Spencer, seconded by Council Member Freed, to approve as recommended prevailed by the following vote: Ayes: Tate, Ware, Spencer, Wilbanks, Johnson & Freed Nays: None Absent: Stewart Item 4.
