HomeMy WebLinkAboutRES 1996-062 �Hm� RESOLUTION NO. 96-62 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF �� GRAPEVINE, TEXAS MAKING FINDINGS OF CERTAIN FACTS RELATIVE TO THE PURCHASE OF PORTABLE RADIOS AND MOBILE RADIOS; DETERMINING THAT THE ITEM IS AVAILABLE FROM ONLY ONE SOURCE; DETERMINING THAT THE PURCHASE OF THE PORTABLE RADIOS AND MOBILE RADIOS IS NECESSARY TO PRESERVE AND PROTECT THE PUBLIC HEALTH AND SAFETY OF THE CITY'S RESIDENTS; AUTHORIZING PURCHASE FROM MOTOROLA CORPORATION IN THE AMOUNT OF 530,814.25; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, Motorola Corporation is the sole provider of portable radios and mobile radios for the Motorola radio system; and WHEREAS, the City Staff has been unable to locate anyone except Motorola Corporation who manufactures the MTS2000 portable radios and MCS2000 mobile "�" radios compatible for use by the City's Police Department; and .�.�. WHEREAS, the City Staff has determined the need to purchase the list of radio equipment listed in Exhibit "A" to preserve and protect the public health and safety of the City's residents. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1 . That all of the above premises are found to be true and correct and are incorporated into the body of this resolution as if copied in their entirety. Section 2. That the City Council authorizes the purchase of the portable radios and mobile radios listed in Exhibit "A" from Motorola Corporation for the total amount of 530,814.25. Section 3. That the City Manager, or his designee, is authorized to take all steps necessary to consummate the purchase of the authorized equipment provided „�,„, in Section 2. �,� �.�• Section 4. That if any section, article, paragraph, sentence, clause, phrase or word in this resolution, or application thereof to any persons or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not �i affect the validity of the remaining portions of this resolution; and the City Council hereby declares it would have passed such remaining portions of the resolution despite such invalidity, which remaining portions shall remain in full force and effect. Section 5. That this resolution shall take effect from and after the date of its passage.
