;,;�,,,�, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS AUTHORIZING THE CITY TO ENTER
INTO AN INTERLOCAL AGREEMENT WITH THE HOUSTON-
GALVESTON AREA COUNCIL FOR THE PURCHASE OF A
FIRE TRUCK; AUTHORIZING CITY MANAGER TO EXECUTE
SAID AGREEMENT; AMENDING THE FISCAL YEAR
1995/96 BUDGET AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the Fire Chief and City Administration for the City of Grapevine
have reviewed and analyzed the City's need for a new ambulance; and
WHEREAS, the City of Grapevine,Texas, pursuant to the Interlocal Cooperation
Act [Article 4413(32c) V.T.C.S.] desires to participate in an Interlocal Agreement with
the Houston-Galveston Area Council for the purchase of a fire truck; and
WHEREAS, the Houston-Galveston Area Council is a regional planning
commission created under Acts of the 59th Legislature, Regular Session, 1965,
recodified as Chapter 391 , Texas Local Government Code; and

WHEREAS, the City of Grapevine, Texas is of the opinion that participation in
�+ the interlocal agreement will be highly beneficial to the taxpayers of this City through
the anticipated savings to be realized.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1 . That all of the above premises are found to be true and correct and
are incorporated herein as if copied in their entirety.
Section 2. That the City Manager is hereby authorized to enter into an
Interlocal Agreement for Cooperative Purchasing, said agreement attached hereto and
made a part hereof as Exhibit "A", with the Houston-Galveston Area Council for the
purchase of a fire truck.
Section 3. That the City of Grapevine Budget for Fiscal Year 1995/96 is hereby
amended to authorize the expenditure of funds, not to exceed 5240,684 for purchase
�,,,,, of said fire truck and necessary shipping, equipment and supplies to make the fire
; truck ready for use.

passage.

WHEREAS, H-GAC is a regional planning cocrunission created under Acts of the 59th Legisiature; Regular Session, '1965,

WHEREAS, H-GAC has eatered into an agreement with the loca! �overnmeat on the Ib th day of February, 19 93 aad
WHEREAS, the Ioca! government registers its desire to purc:�ase cercain governmental administrative functions, goods, or
services; and

ARTICLE 5: SCOPE OF SERVTCES (continuedl (
The.materials and services shall be pra;ured in accordance with procedures governing competitive bids and competitive proQosals
by H-GAC, and at the unit pricrs and admiaistntive fees as indicated ia the current H-GAC Order Forms and Price Lists,

Ownership (title)of material purchased shall trsasfer directly hom the vendor to the local goverament. ?he local government
agrees to provide H-GAC witti documentation of receipt aad acceptance of material within five(�days of accaptaac: of same.
ARTTCLE 6: PAYI-fENTS
The local goverament agrees that, upon ihe preseatarioa by H-GAC of a properIy documented, verified proof of pezformance
and a statemeat of costs H-GAC has incurrcd in accordance with the terms of tfus Agreement, it shall pay H-GAC, from eurreat
reveaues available to the local governmeat during the current fiscal year, on or before the dace of the delivery of materials and
services to be provided under this agreement.
�RTiCLE 7: CHANG£S a'�tD AiviEiYDMENTS
�ny aItemations, additions, or deletions to the terms of this Agreement whic�are required by changes in Federal and State Iaw
or regulations are automatically incorporated into this Agreement without wrirten amendment hereto, and shall become effective

K-GAC reserves the right to make changes in the scope of the services offered through the H-GAC Cooperative Puzchasing
Pzogram to be performed hereunder.

Either H-GAC or the local governmeat may canca! or terminate this Agreement upoa thizty(30) days writua aotics by c..-rrined
mail co the other party. In tha eveat of suc� termination prior to completion of any purcfiase provided for herein, the local
,�w�+ gove:nment agrezs to pay for services on a prordted basis for materiats and services actually provided and iavoiced in accordanr
with the cerms of this Agrxmeat, inciuding peaalties, less payment of any campensatioa previously paid. +,
