,,,�, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS AUTHORIZING THE MAYOR TO
ENTER INTO AN AGREEMENT WITH THE STATE OF
TEXAS WHEREBY THE CITY OF GRAPEVINE WILL
ASSUME RESPONSIBILITIES FOR DRAINAGE AND
MAINTENANCE OF THE DRAINAGE FACILITY RIGHT OF
STATE HIGHWAY 1 14 CENTERLINE STATION 410+ 15.89
IN CINEMARK ADDITION; AND PROVIDING AN EFFECTIVE
DATE
WHEREAS, the City Council of the City of Grapevine, Texas deems it necessary
and to the best interest of the City of Grapevine, Texas to enter into an agreement
with the State of Texas, acting by and through the Texas Transportation Commission
whereby the City will assume whatever responsibilities and liabilities the State may
have for the proper and adequate handling of all drainage across the Cinemark
Addition, including the drainage in the State's easement, as shown on Exhibit "A",
attached hereto and made a part hereof.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
���' GRAPEVINE, TEXAS:
Section 1 . That the City of Grapevine, Texas acting by and through its Mayor,
enters into an agreement with the State of Texas whereby the City of Grapevine
assumes whatever responsibilities and liabilities the State may have for the proper and
adequate discharge of all drainage across the Cinemark Addition to the City of
Grapevine, including the drainage across the State's easement recorded in Volume
5428, Page 480 of the Deed Records, Tarrant County, Texas as shown on said
Exhibit "A", and William D. Tate, Mayor of the City of Grapevine, Texas be and is
hereby authorized to enter into an agreement on behalf of the City of Grapevine,
Texas. The City Secretary is hereby instructed to attest and affix the seal of the City
of Grapevine, Texas to said agreement.
Section 2. That this resolution shall become effective from and after the date
of its passage.

;,,�,,,, MAINTENANCE AGREEMENT EASEMENT
Description of a 40,005 square foot tract of land out of the J.B. Fay Survey, Abstract No. 530 in the
City of Grapevine, Tarrant County, Texas; said tract includes a portion of an 80-foot drainage easement
conveyed to the State of Texas as recorded in Volume 5428, Page 480, Deed Records, Tarrant County,
Texas, and being more particularly described as follows:
BEGINNiNG, at a cut " +" found in a concrete apron for the point of beginning of said 80-foot drainage
easement; said point being at 809.1 9 feet southeasterly of and right angles to centerline survey Station
410+ 1 5.89 on State Highway 1 14; said point also being on the South right-of-way line of State
Highway 114;
THENCE, S 89°41'06" E, (S 89°44'42" E), with said South right-of-way line and the North line of said
80-foot drainage easement, a distance of 2.41 feet to a point for corner;
THENCE, S 12°21'29" W, (S 12°17'53" W), a distance of 204.84.feet an angle point on an East line
of the Cinemark Addition, a proposed addition to the City of Grapevine, Texas;
THENCE, S 00°18'54" W, (S 00°15'18" W), at a distance of 126.67 feet pass a 5/8" iron rod with
"Gonzalez & Schneeberg" cap found for an interior corner of said Cinemark Addition, continuing, in all,
a disiance of 851.67 feet to a point for corner on the South line of said Cinemark Addition;

THENCE, N 89°41'06" W, (N 89°44'42" W), with said South line of the Cinemark Addition, a distance
of 40.00 feet to a point for corner;

THENCE, N 00°18'54" E, (N 00°15'18"W), distance of 807.96 feet to an angle point;
THENCE, N 12°21'29" E, (N 12°17'53"E), a distance of 249.17 feet to a point for corner on said
South right-of-way line of State Highway 1 14; said point being on a curve to the right whose center
bears S 00°58'21 W, (S 00°56'20"W), 1402.40 feet;
THENCE, Easterly, with said South right-of-way line and the North line of said 80-foot drainage
easement and said curve to the right, through a central angle of 01 °09'29", (01 °09'27"), an arc
distance of 28.34 (28.331 feet and whose chord bears N 89°36'24" E, (N 89°38'24"E), 28.34 (28.33)
feet to the POINT OF BEGINNING.
CONTAINING, 40,005 square feet or 0.9184 acres of land, more or less.
