RESOLUTION NO. 94-10
;�„ A RESOLUTION OF THE CITY OF THE CITY COUNCIL OF
THE CITY OF GRAPEVINE, TEXAS PROVIDING THAT THE
CITY COUNCIL HAS BEEN UNABLE TO DETERMINE AT
THIS TIME THE REASONABLENESS OF BASIC CABLE
SERVICE RATES SUBMITTED, PROVIDING FOR TOLLING
THE INITIAL PERMITTED BASIC SERVICE RATES FOR A
PERIOD NOT TO EXCEED 90 DAYS AND PROVIDING FOR
AN EFFECTIVE DATE
WHEREAS, the City of Grapevine adopted Ordinance 94-11 on February 1,
1994, amending Chapter 25, by adding Article VI, Cable Television Rate Regulations,
to provide for regulation of basic service cable television rates in accordance with the
Cable Television Consumer Protection and Competition Act of 1992 ("Cable Act of
1992"1; and
WHEREAS, the City of Grapevine notified Paragon Cable of its rights to regulate
such rates on February 9, 1994; and
� � WHEREAS, Paragon Cable, in accordance with the Cable Act of 1992 and
Chapter 25, Article VI, Grapevine Code of Ordinances, submitted FCC form 393 in
'� order to establish its initial permitted charge per channel; and
WHEREAS, the City of Grapevine is unable to determine at this time if the rates
submitted meet the benchmark rates established by the Federal Communications
Commission and are within the charges permitted as defined in Chapter 25, Article VI,
Sections 25-154 and 25-155, Grapevine Code of Ordinances.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:
Section 1 . The City is unable to determine, based upon the material submitted
by Paragon Cable, that the proposed initial basic service cable rates are within the
rates permitted by Chapter 25, Article VI, Sections 25-154 and 25-155, Grapevine
Code of Ordinances.
Section 2. The City Council tolls Paragon Cable's rate request for a period not
to exceed 90 days from April 9, 1994 in accordance with Chapter 25, Article VI,
Section 25-161 .

Section 3. That this resolution shall become effective from and after the date
of its passage.
