HomeMy WebLinkAboutRES 1994-042 � RESOLUTION N0. 94-42 ,,,�,,, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS ACCEPTING DEDICATION OF PROPERTY AND CONVEYANCE OF CASH BY THE OWNERS OF WESTERN OAKS ESTATES, SECTION III, A RESIDENTIAL SUBDIVISION, AND THE OWNERS OF BELFORT ADDITION, A RESIDENTIAL SUBDIVISION, IN COMPLIANCE WITH APPENDIX "D" ZONING, SECTION 51 OF THE CODE OF ORDINANCES OF THE CITY OF GRAPEVINE, TEXAS; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the owners of Western Oaks Estates, Section III ("Western Oaks"1, a residential subdivision plat, initially agreed to dedicate Lots 45 and 46 of said plat to the City for park purposes in compliance with Section 51 of Appendix "D" of the City Code, which dedication was in excess of the legal requirements of the City code; and WHEREAS, the owners of Western Oaks requested the City at the time the plat "� R of Westem Oaks was approved to reconsider the excess dedication when, as and if the owners of property to the immediate south boundary of Western Oaks submitted �n� a residential subdivision plat; and WHEREAS, the City acknowledged the request by the owners of Western Oaks; and WHEREAS, the owners of the property to the south have filed a residential subdivision plat Belfort Addition; and WHEREAS, the City Staff has reviewed and calculated the requirements for both subdivisions to satisfy Section 51 of Appendix "D", the City's zoning ordinance; and WHEREAS, the owners of Western Oaks III may satisfy the requirements by dedicating Lot 46 and conveying to the City $9,168.00 in cash, and the owners of Belfort Addition may satisfy the requirement by dedicating 14,374 square feet in the subdivision and 55,829.32 in cash; and WHEREAS, the Open Space Committee has approved the proposed dedications ,� by the owners of both residential subdivisions; and WHEREAS, it is not necessary for the owners of Western Oaks Estates III to � dedicate Lot 45 as originally proposed and as reflected on the face of the approved final plat of Western Oaks Estates III. „�,, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: � Section 1 . That all matters stated in the preamble are found to be true and correct and are incorporated herein as if copied in their entirety. Section 2. That the City Council does hereby state that the dedications necessary to comply with the requirements of Section 51 of Appendix "D” of the City Code may be satisfied by the dedication and conveyances outlined above by the owners of Western Oaks Estates III and Belfort Addition, and that it is not necessary that Lot 45 of the Western Oaks Estates III be dedicated as originally proposed.
