RESOLUTION N0. 94-04
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS APPROVING CHANGE ORDER #1 TO
THE BAYLOR PARKWAY CONSTRUCTION CONTRACT IN
ORDER TO PRESERVE AND PROTECT THE PUBLIC
HEALTH AND SAFETY OF THE CITIZENS OF THE CITY;
PROVIDING AN EMERGENCY CLAUSE AND DECLARING
AN EFFECTIVE DATE
WHEREAS, on May 18, 1993, after due notice to bidders, the City received
bids from five (5) contractors for the construction of the Baylor Parkway Construction
Project; and
WHEREAS, J.L. Bertram Construction Engineering, Inc. submitted the lowest
responsible bid of 5357,480.37 and the City Council awarded the bid to Bertram on
June 15, 1993; and
WHEREAS, the City hereby determines that the reconstruction of Coppell Road
is required to preserve the property of the municipality and will protect the public
health and safety of the municipality's residents; and

WHEREAS, J.L. Bertram Construction Engineering, Inc. has submitted the
lowest of two proposals from contractors currently under contract to the City of
Grapevine in an amount of 5248,345.50; and
WHEREAS, Section 252.022(1 � of the Texas Local Government Code ("Code")
authorizes the City to extend existing contracts in excess of 25% of the original
amount without complying with competitive bid requirements when the procurement
is made because of a public calamity that requires the immediate appropriation of
money to relieve the necessity of the City's residents or to preserve the property of
the City; and
WHEREAS, Section 252.022(2) of the Code authorizes the City to extend
existing contracts in excess of 25% of the original amount without complying with
the competitive bid requirements when the construction of the facilities are necessary
to preserve and protect the public health and safety of the City's residents; and
WHEREAS, rebidding procedures would be costly and are unlikely to yield an
��-� amount lower than that referenced above.

� . NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS:

Section 1 . The above premises are found to be true and correct and are
incorporated herein for all purposes.
Section 2. The City Council hereby determines that the extension of this
existing contract through adoption of a Change Order is necessary to preserve the
property of the City and protect the public health and safety of the City's residents.
Section 3. The City Council hereby agrees to execute Change Order #1 to the
Baylor Parkway Construction Contract in an amount of 5248,345.50.
Section 4. The fact that the present resolutions and regulations of the City of
Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals,
peace and general welfare of the inhabitants of the City of Grapevine, Texas creates
an emergency for the immediate preservation of the public business, property, health,
safety, and general welfare of the public which requires that this Resolution become
effective from and after the date of its passage and it is accordingly so resolved.
