RESOLUTION NO. 97 -11
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
"*�" OF GRAPEVINE APPROVING, RATIFYING AND
AFFIRMING A CONTRACT WITH LONGVIEW RUBBER
PRODUCTS IN THE AMOUNT OF $5,480. 00 FOR THE
PURCHASE OF TWO (2) BACKWASH RETURN
SUBMERSIBLE PUMPS; AUTHORIZING PAYMENT FOR
THE PURCHASE IN THE AMOUNT OF $5, 480. 00;
FINDING AND CONCLUDING THE TAKING OF
COMPETITIVE BIDS WAS UNNECESSARY BECAUSE THE
EXPENDITURE IS FOR A PROCUREMENT NECESSARY TO
PRESERVE AND PROTECT THE PUBLIC HEALTH AND
SAFETY OF THE CITY' S RESIDENTS; AND PROVIDING
AN EFFECTIVE DATE
WHEREAS, on April 10, 1991, the City Manager authorized the
purchase of 2 pumps from Longview Rubber products in the amount
of $5,480. 00 for the purchase of the City's Wastewater Treatment
Plant backwash return pumps; and
WHEREAS, the estimate submitted by Longview Rubber Products
was the lowest estimate of two quotes received by the City, the
other estimate being in the amount of $5,484. 00 from OSI Company,
,,�,,, Inc. ; and _
WHEREAS, immediate purchase of the pumps was necessary to
� enable the City to adequately avoid an unpermitted discharge of
ef f luent; and
WHEREAS, the City Council finds and concludes that pursuant
to Section 252 . 022 (a) (2) of the Texas Local Government Code,
. compliance with the competitive bidding process was unnecessary
because the expenditure was for a procurement necessary to
preserve and protect the public health and safety of the City's
residents; and
WHEREAS, the City Council concludes and determines that the
contract with Longview Rubber Products for the purchase of two
(2) backwash return pumps should be approved and ratified and
that payment to Longview Rubber Products in the amount of
$5,480. 00 for the purchase should be authorized.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS:
,�► Section 1. That all of the above premises are found to be
true and correct and are incorporated into the body of this
resolution as if copied in their entirety.

Section 2 . The contract between the City of Grapevine and
�� Longview Rubber Products in the amount of $5,480. 00 for the
purchase of two (2) backwash return pumps is hereby approved,
ratified and affirmed.

Section 3 . The City Manager, or his designated representa-
tive, is hereby authorized to pay the sum of $5,480. 00 for
Longview Rubber Products for the purchase of two (2) backwash
return pumps.
Section 4 . That this resolution shall take effect
immediately upon its passage and approval.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS on this �th day of Mav , 1991.
