HomeMy WebLinkAboutRES 1991-024 ��.., RESOLUTION NO. 91-24 � A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, MAKING FINDINGS OF CERTAIN FACTS RELATIVE TO THE PURCHASE OF MOBILE DATA TERMINALS; DETERMINING THAT THE MOBILE DATA TERMINALS ARE AVAILABLE FROM ONLY ONE SOURCE; DETERMINING THAT THE PURCHASE OF THE MOBILE DATA TERMINALS IS NECESSARY TO PRESERVE AND PROTECT THE PUBLIC HEALTH AND SAFETY OF THE CITY'S RESIDENTS; AUTHORIZING THE PURCHASE OF FOUR MOBILE DATA TERMINALS FROM ELECTROCOM AUTOMATION, INC. FOR THE AMOUNT OF $7, 500. 00; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EFFECTIVE DATE WHEREAS, ElectroCom Automation, Inc. is the sole provider of Model 850-E mobile data equipment that is compatible with the City's existing computer; and �� WHEREAS, the City Staff has been unable to locate anyone except ElectroCom Automation, Inc. who manufactures the Model 850-E mobile data terminal equipment compatible with the City's existing � computer; and WHEREAS, the City Council has determined the need to enlarge the City's police patrol fleet and that the purchase of the four Model 850-E mobile data terminals is necessary to preserve and protect the public health and safety of the City's residents. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCZL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That all of the above premises are found to be true and correct and are incorporated into the body of this resolution as if copied in their entirety. Section 2 . That the City Council authorizes the purchase of four (4) Model 850-E mobile data terminals from ElectroCom Automation, Inc. for the total amount of $7, 500. 00. Section 3 . That the City Manager, or his designee, is �,,, authorized to take all steps necessary to consummate the purchase of the four (4) Model 850-E mobile data terminals as provided in Section 2 . � Section 4. That if any section, article, paragraph, sentence, � ` clause, phrase or word in this resolution, or application thereof to any persons or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect � the validity of the remaining portions of this resolution; and the City Council hereby declares it would have passed such remaining portions of the resolution despite such invalidity, which remaining potions shall remain in full force and effect. Section 5. That this resolution shall take effect from and after the date of its passage.
