A1 -�4 � A RESOLUTION OF THE CITY OF GRAPEVINE, TEXAS, DETERMINING A PUBLIC NEED AND NECESSITY FOR THE ACQUISITION OF FEE SIMPLE TITLE TO AN APPROXZMATE 5 . 82 ACRES OF LAND LOCATED IN THE A. ANDERSON SURVEY, ABSTRACT NO. 26 , TARRANT COUNTY, TEXAS, FOR A GOLF COURSE, PARKWAY, AND ASSOCIATED MUNICIPAL PURPOSES; AUTHORIZING THE MAKING OF AN OFFER; AUTHORIZING THE CITY ATTORNEY TO FILE PROCEEDINGS IN EMINENT DOMAIN TO ACQUIRE THE NEEDED PROPERTY; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Grapevine, Tezas, upon consideration of the matter, has determined that there is a public necessity for the welfare of the City of Grapevine and the public-at-large, to acquire certain real property for a golf course, parkway, and associated municipal purposes; and, WHEREAS, in accordance with the above, the City Council �,„�, of the City of Grapevine, Texas, hereby finds that it is in the , public interest to acquire fee simple title to real property for the above stated municipal purposes; and, 1rr�wr WHEREAS, the real property to be acquired for such purposes is an approximate 5 . 82 acres, more or less, of land located in the A. Anderson Survey, Abstract No. 26, Tarrant County, Tezas, and is more particularly described in Ezhibit "A" attached hereto and made a part hereof by reference (the "Property") ; ' NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section I . The City Council hereby finds and determines that it is necessary for the welfare of the City and its citizens and is in the public interest to acquire fee simple title to the Property for a golf course, parkway, and associated municipal purposes . Section II . The City Manager, or his designee, is hereby authorized on behalf of the City to attempt to agree on damages and compensation to be paid to owners of the Property and to make an official offer to said owners . If the City Manager or his designee determines that an agreement as to �"'�'' damages and compensation cannot be reached, then the City Attorney, or his designee, is hereby authorized to file or cause to be filed, against the owners and interested parties of � the Property, proceedings in eminent domain to acquire fee simple title to the Property. � �_ ,, Section III . It is the intent of the City Council that this Resolution authorizes the condemnation of al� property required to construct and use as a golf course, parkway, or other associated municipal purposes . If it is later determined ""�' that there are any errors in the descriptions contained herein or if later surveys contai.i more accurate revised descriptions, the City Attorney or his designee is authorized to have such errors corrected or revisions made without the necessity of obtaining a new City Council Resolution authorizing the condemnation of the corrected or revised Property. Section IV. The findings of fact, recitations and provisions set out in the preamble of this Ordinance are adopted and made a part of the body of this Ordinance, as fully as if the same were set forth herein. Anderson Survey (A-26) and being more particularly described as follows: From the northeast corner of said A. Anderson Survey, Abstract No. A-26, along east line of said Survey, south 00°30' west, 1775 feet to a fence corner; thence along a fence line as follows: between U. S. Government property and the Birdie E. Brown north 88°28' west, 696 feet to the point of the beginning; thence south 03°19' east, 243 feet to a point; thence south 16°40' west, 304 feet to a point; thence departing from said fence line, south 01°15' west, 444 feet to a point in the common line between the Birdie E. Brown and Danny Fowlie, deceased, properties; thence along common line between the U. S. Government and Danny Fowlie, deceased, properties north 89°30' west, 220 feet to a point being the northwest � -�« corner of the Danny Fowlie, deceased, property and a reentrant corner of U. S.
