HomeMy WebLinkAboutRES 1991-040 �.,-:4 RESOLUTION NO. 91-40 A RESOLUTION OF THE CITY COUNCIL OF THE CITY � OF GRAPEVINE, TEXAS APPROVING AN INTERLOCAL AGREEMENT FOR POLICE SERVICES BETWEEN THE CITY OF GRAPEVINE, TEXAS AND GRAPEVINE-COLLEYVILLE INDEPENDENT SCHOOL DISTRICT; AUTHORIZING AND DIRECTING THE CITY MANAGER AND CHIEF OF POLICE TO EXECUTE THE AGREEMENT; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City of Grapevine, Texas desires to enter into an Interlocal Agreement with Grapevine-Colleyville Independent School District to provide two School Resource Officers; and WHEREAS, the City of Grapevine, Texas is authorized to enter into an interlocal agreement for police services pursuant to the Interlocal Cooperation Act, Article 4413 (32c) , Texas Revised Civil Statutes. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: �� Section 1. That the City Council approves entering into an � interlocal agreement for police services with the Grapevine- Colleyville Independent School District to provide two School Resource Officers in substantially the form attached as Exhibit uAn � Section 2 . That the City Manager and Chief of Police are hereby authorized and directed to execute and take all necessary steps to consummate the interlocal agreement in substantially the form as shown in Exhibit "A" . � Section 3 . That this resolution shall become effective immediately from and after its passage and approval by the City Council. City Attorney �� � � � Exhibit "A" to Resolution 91-40 Page 1 of 2 ��M�� STATE OF TEXAS ) ( AN INTERLOCAL AGREEMENT FOR POLICE SERVICES OF GR.APEVINE, TEXAS AND THE COUNTY OF TARRANT ) ( GRAPEVINE/COLLEY�7ILLE INDEPENDENT SCHOOL DISTRICT � WHEREAS, the Interlocal Cooperation Act, Texas Revised Civil Statutes Annotated, Article 4413-32(c) , (hereinafter referred to as "the Act" ) authorizes local governments to contract with one another for the performance of governmental functions and services, and WHEREAS, the City of Grapevine (hereinafter referred to as "Grapevine" ) and the Grapevine/Colleyville Independent School District (hereinafter referred to as "G.C.I .S.D. " y are located in Tarrant County, Texas, and both parties do desire to enter into an agreement for the purpose of providing police protection to G.C.I.S.D. as hereinafter set out in the body of this agreement, NOW, THEREFORE, Grapevine and the G.C.I .S.D. do hereby contract, agree, and covenant for good and for valuable consideration, the mutual promises and agreements made in the body of this agreement, as follows: I . Grapevine agrees to furnish two police officers to be utilized by �=�a�the G.C. I .S.D. as a School Resouree Officers, which officers' duties and responsibilities are set forth in the rules and regulations of the ;� Grapevine Poliee Department, which rules and regulations are �incorporated herein and made a part thereof for all purposes. The officers that are furnished as School Resource Officers shall be under the supervision and control of the Grapevine Chief of Police. Grapevine shall continue to pay the officers ' total salary, benefits and equipment as deemed necessary by the Chief of Police to include but not limited to vehicle, vehicle maintenance, communications equipment and other equipment that may be deemed necessary for the School Resource Officers to complete his/her assignment; subject to reimbursement as provided in paragraph II . below. Grapevine shall be entitled to request the services of the City of Colleyville, Texas or the City of Euless, Texas, pursuant the Interlocal Agreement for police services to perform the services required of Grapevine under this agreement. II . The School Resource Officer Program shall consist of two ( 2) officers. The first School Resource Officer Program shall receive fifty ( 500) percent of its funding from Grapevine and fifty ( 500) percent of its funding from the G.C.I .S.D. , not to exceed $30,OQ0 per year contribution from G.C.I .S.D. Grapevine shall be responsible for the initial funding, and shall submit a written request for reimbursement to the G.C.I .S.D. on a quarterly basis. The G.C.I .S.D. will make separate """�quarterly payments corresponding with each written reimbursement request ,`�� submitted by Grapevine. ,.,. � Exhibit "A" to Resolution 91-40 - Page 2 of 2 The second School Resource Officer Program shall receive one-hundred percent (100a) of its funding for nine and one half months of the year from the G.C. I .S.D. and two and one half months funding shall be the responsibilityof the City of Grapevine, Texas. Grapevine shal.l be responsible for the initial funding and shall submit a written request for reimbursement to the G.C.I .S.D. on a quarterly basis. The � G.C.I .S.D. will make separate quarterly payments corresponding with each written reimbursement request st�bmitted by Grapevine. III . This agreement shall be for a term of one year, from the date of exeeution of t�iis agreemen�, renewable automatically for successive one year terms unless terminated by either party in accordance with this paragraph III . E�ther Grapevine or the G.C.I .S.D: may terminate this agreement at any time by giving the other party thirty ( 30 } days written notice of termination.
