A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS EXPRESSING FIRM
OPPOSITION TO RESTRICTIONS BEING CONSIDERED
TO BE PLACED ON LOCAL LAND USE REGULATIONS
WITHIN CERTAIN TERRITORIES SURROUNDING
AIRPORTS AND PROVIDING AN EFFECTIVE DATE

WHEREAS, the Secretary of Transportation of the Department
of Transportation is considering certain recommendations of an
Aviation System Capacity Task Force; and
WHEREAS, among those recommendations is a provision that
would preempt the planning, zoning and land use powers of local
governments on any land within the local municipality which is
situated within the 65 ldn noise contour surrounding airports,
regardless whether the land is owned by the airport operator or
other owners; and
WHEREAS, it is believed that such a change in rules would
violate and preempt the constitutionally guaranteed rights of
local governments to manage their local affairs and would further
be in conflict with the Presidential Executive Order on
Federalism, Number 12612 dated October 26, 1987.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS:
Section 1 . That it go on record that the City of Grapevine,
��•� Texas is in opposition to the proposed recommendation regarding
preemption of local land use controls and that the City further
call upon its elected Congressmen, Senators and other officials
`�' to use their voice and positions to support the position of the
people of this City.
Section 2 . That this resolution shall take effect from and
after the date of its passage.

GRAPEVINE, TEXAS on this the 21st day of Auqust , 1990 .
