HomeMy WebLinkAboutRES 1990-030 RESOLUTION NO. 90-30 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS DECLARING THE NECESSITY TO ACT AT ONCE APPROVING, RATIFYING, AND AFFIRMING THE PURCHASE OF ASPHALT STREET MATERIALS; RESCINDING AWARD OF BID 90-183 TO MAROCK, INC. AND TERMINATING THE CONTRACT �„� WITH MAROCK, INC. ; DETERMINING AND CONCLUDING THAT THE RE-AWARD OF BID 90-183 TO REYNOLDS ASPHALT AND CONSTRUCTION COMPANY AND J. L. BERTRAM CONSTRUCTION AND ENGINEERING, INC. ```""' FOR ASPHALT STREET MATERIALS IS NECESSARY TO PRESERVE AND PROTECT THE PUBLIC HEALTH AND SAFETY OF THE CITY ' S RESIDENTS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on April 3, 1990 , the City awarded a bid to Marock, Inc. for the purchase of asphalt street materials and a one (1) year contract was entered into; and WHEREAS, the City of Grapevine, Texas (the "City" ) has discovered that that Marock, Inc. has provided asphalt street materials that fail to comply with the specifications of Bid 90-183 regarding testing, material quality and delivery; and WHEREAS, the City has notified Marock, Inc. on several occasions of the failures to comply with the specifications; and WHEREAS, it is imperative that the asphalt street materials comply with the required testing and material quality and be delivered in a timely manner to preserve and protect the public ,��� health and safety of the City' s residents; and WHEREAS, Reynolds Asphalt and Construction Company "'�" ("Reynolds") and J. L. Bertram Construction and Engineering, Inc. ( "Bertram" ) were the next low bidders and have agreed to hold the prices they bid firm through December 31 , 1990; and WHEREAS, the City has had a favorable work history with Reynolds and Bertram; and WHEREAS, on August 23, 1990 the City provided Marock, Inc. with a 30 day notification of the City' s intention to cancel the contract pursuant to the terms of the contract; and WHEREAS, the City Council finds and determines that it is the interests of the public health, safety and general welfare that the contract with Marock, Inc. be terminated and that a contract be awarded to Reynolds and Bertram and to approve, ratify and affirm the purchase made from Reynolds and Bertram heretofore in accordance with the terms of this resolution. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: � Section l . That all matters stated above are found to be �, true and correct and are incorporated into the body of this resolution as if copied herein in their entirety. Section 2 . That the City Council does hereby, by the approval of this resolution, rescind the award and terminate the contract with Marock, Inc. and the City Manager or his designee is directed to take all steps necessary to accomplish the termination. Section 3 . That the City Council award a contract to Reynolds at $18 per ton for Type A asphalt to be picked up and $19 . 52 per ton for Type D to be picked up. �ection 4 . That the City Council award a contract to Bertram at $20 . 30 per ton for Type A asphalt delivered and $20 . 90 per ton for Type D asphalt delivered. Section 5 . That the City Council approves, ratifies and affirms purchases made from Reynolds for 63 tons of asphalt in the amount of $1 , 386 . 90 . Section 6 .
