INVOCATION The Invocation was then delivered by Camnissioner Gerald Norman. PUBLIC HEARING, PRUPOSID AMIIVDMEIVTS TO CONIPRE��TSIVE ZONING ORDINANCE NO. 82-73 The first order of business was for the City Council and Planning & Zoning Canmission to continue a public hearing relative to proposed �nendments to Ccxnprehensive Zoning Ordinance No. 82-73. NO2'E: Co�mission M�mber Peggy Engholm arrived at the meeting. Planning & Zoning Cc�nmission Chainman Sharron Spencer proceeded to review the proposed antiendments to the Ccx�rehensive Zoning Ordin,ance which had initially been considered on Sept�r 18, 1984 and had been tabled until this meeting. She then review�d a second set of proposed amenc�ments, which had been ,� , scheduled for public hearing at this time. Mrs. Spencer detailed the proposed Ope.n Space Requirements, r�ting that they would apply to residential developments of 100 or more units in the R-20, � R-12.5, or R-7.5 Single-Family Districts in order to provide open space and recreational areas to meet the needs of the future residents of the area. The regulations provided for a dedication of the open space to the City, though it was not required. The proposed Section 52, Tree Preservation, was also reviewed. This section would govern re�noval or replacement of trees in a development. She noted that the affect these regulations w�uld have on the utility campanies' ability to provide underground service w�ould be taken into consideration during Planning & Zoning Ccmmission deliberations. 10/16/84 She then revie�d the proposed changes in the R-3,5 'Itao-Family Dwelling Dis- trict, which included providing for the subdivision of duplexes and conversion to the R-TH Tawnhouse District if aIl requirezrents are met. She noted the density limit in the duplex district was eight units per acre, alley ways could not be included in the 25-foot rear yard require�nent, and the proposal would prohibit the parking of recreational vehicles within the required front yard. The R-3.75 Three- and Four-F�nily Uwelling District was then presented. The minimLun square footage of the lot area for three-plexes and four-plexes was +�� noted. In addition, Mrs. Spencer reviewed buffer area regulations when a three- or four-family developm�ent is located adjacent to a tawnhouse, multi- family, or non-residential develognent. Prohibiti.ng the parking of � � recreational vehicles within the required front yard an�d a density limit of ten units per acre w�re also noted. The R-Tfi Tawnhouse District was proposed t�o be amended rather cc7mprehensively. Mrs. Spencer noted a maximtun density of eight units per acre, the maximinn length of a stYucture at 240 linear feet or eight units, landscape and buffer require�nents, and requirements for horizontal and vertical breaks in the building line. Mrs. Spencer also c�nted on one change in the LI Light Industrial District adding batching plants to the conditional uses and deleting them frcan the limitations of uses. Also, she noted the rec�ndation of the Planning & Zoning Cca�mission that Section 32, General Industrial District, be deleted in its entixety, as it had been inadvertently included in the fi.nal draft of the zoning ordinance. Follawing this review, Mayor Tate invited those guests present to speak relative to the proposed zoning ordinance amendments. City Secretary Karen Spann reported that two letters had been received fresn Mrs. Becky Stewart, representing the Grapevine Coalition of NeighUorhoods, one ""'� of which expressed their support for the proposed o�en space requixements and the other which supported the tree preservation regulations. �.�r There being no one else present who wished to speak at this tinue, a motion to close the public hearing was made by Cannissioner Gerald Norman and seconded by Camnission MPmber Harlen Joyce. Council M+anber Dyer offered a second to the motion, which prevailed by the ensuing vote: Ayes: Tate, Ware, Oliver, Brekken, Dyer, Glynn, & Paaers Nays: None PUBLIC HEARING, ZONING APPLICATION Z84-29, GILES & THONIPSON ��� The next it�n before the City Council and Planning & Zoning Ccitrmission was to conduct a public heari.ng relative to Zoning Application Z84-29 su�mitted by Mr. Barney Giles and Mr. Gerald Thanpson. �� Public Works Director Jim Baddaker advised this public hearing had been tabled frcan the meeting of Septemher 4, 1984 at the request of the applicant. The location of the property in question is the northwest carner of Dove Road and Dove Loop Road. The current zoning on the property is R-TH Tawnhouse Dis- trict, with the requested zoning being for CN Neighborhood C�rcial District on 8.9 acres (which had been revised dawnward fresn the initial application for 11.6 acres.) Mr. David Risinger, representing the applicants, addressed the Council and Canmission giving a brief history of the zoning on this property. He also revie�aed. the proposed concept plan shawing 2.16 acres of townhouse develo�ent and 8.9 acres of ca��rcial property. Mr. Mike Starek of DeShazo, Starek & Tang then gave a lengthy presentation of the traffic study analysis at this location. He detailed the affect of existing traffic and then added figures including proposed develognent in the area. Questions and cam��ents fran the City Council and Planning & Zoning Canmission follawed this presentation. �' " A brief recess was then called by Mayor Tate. Upon reconvening in the Council Chambers, all me.nibers of the City Council and Planning & Zoning Ccnmission �� were present, with the exception of Canmissioner Atkins. Mr. Gerald ThcanQson, applicant, then c�nted relative to their efforts to meet the concerns of the City Council and Planning & Zoning Camnission. There being no further discussion, a motion to close the public hearing was offered by Ccmnission Me�c�ber Harlen Joyce and seconded by Ccmmissioner Engholm. The m�tion was seconded by Council MemUer Brekken ar�d prevailed by the ensuing vote: Ayes: Tate, Ware, Oliver, Brekken, Dyer, Glynn, & Pawers Nays: None PUBLIC HEARING, ZONING APPLICATION Z84-32, FRAZIER/TAYLOR (BANYAN PLACE) The next order of business was for the City Council and Planning & Zoning Cam- mi.ssion to conduct a public hearing relative to Zoning Application Z84-32 su�sn.itted by Mr. Et�erett Frazier. Mayor Tate declared the public hearing open and called on Public Works Director Jim Baddaker to explain the request of the applicant. Those present were advised this zoning request involved approximately 14 acres . of land located east of Scribner Street, west of North Main Street, and north of the Safeway grocery store. The present zoning on this tract is R-ME-1 MuZti-Family Dw�elling District, with the requested zoning being R-TH Tawnhouse District. ""�� Mr. John Teague, representing the applicant, briefly addressed the project and fielded questions fran the Council an� Cammission. Mr. Et�erett Frazier also �.s:� offered camrents and clarified that he proposed a develognent of townhouse stnzctures with tw� units each (duplex-style) . There �rere no guests present who wished to speak regarding this zoning application, and no correspondence had been reeeived. CaYmission Meqnber Wilbanks made a motion to close their portion of the public hearing. The motion, seconded by Ccmmissioner Joyce, prevailed by the ensuing vote: (4) 10/16/84 Ayes .
