The City Council of the City of Grapevine, Texas met in Special Session on
this the 3rd day of May, 1984 at 6:30 p.m. in the Council (.'h��mbers, 413 Main
Street, with the follawing members present to-wit:

The meeting was called to order by Mayor Tate.
INVOCATION
Council Member Tam Pawers delivered the Invocation.
RESOLUTION, INIPOSING VOLUNTARY 45-DAY BUILDING NIORATORIUM
� The first order of business was for the City Council to consider a resolution
in�osing a mr�ratorium on the issuance of building permits in certain
� delineated areas by mutual consent and agreement of the property cx�mer and the
City.
City Attorney John Boyle explained. that a resolution had been prepared for
Council consideration which would i.mpose a 45-da.y voluntary nx�ratori�n on
certain properties. He continued that the avners of the properties involved
had agreed in writing to this moratoritun, which was not an extension of the
existing moratoriiun, but a new, voluntary moratoritun on building permits only.
'I'he City Secretary then presented the caption of the proposed resolution.
During brief discussion on this matter, it was agreed to postpone action on
this resolution until after deliberation of the re�nainder of the Planning &
Zoning Comnission recoimiendations.
PI1�I�Il�TING & ZOI�TING CON�IISSION RECONA�LVDATIONS, CITY-INSTIGATED REZONING CASE
The final rec�ndations to ccane fran the Planning & Zoning Ccmmission
relative to the City-instigated rezoning ca.se were then presented by Public
Works Director Jim Baddaker. Each parcel was identified, along with current
and proposed zoning categories.
+�'"° Follaaing this lengthy review of the Comni.ssion's rec�ndations, a brief
recess was taken by the City Council. Al1 Council Nlembers, with the exception
of Council �er Oliver, were present when the meeting reconvened mcxrentarily
�,,, in the Council Chambers.
Consideration was then given to the parcels and their respective zoning
classifications. Special concern was expressed for outdoor storage areas,
which are currently allawed only under the "HC" Highway Commercial Zoning
District. Of particular interest were the Wa7mart shopping center on William
D. Tate Avenue and the Fox Equi�anent Rental on West Dallas Road. It was the
general concensus of the City Council to consider amending the "CC" C�nrnanity
Ccarn�ercial zoning district regulations, at a later date, to allc�w autdoor
storage as a conditional use.

The property loca.ted north of the new post office facility on William D. Tate
Avenue (Parcel No. 88) was also discussed. This parcel was currently zoned
"C-2" Cammunity Busi.ness Zoning District and was rec�nded to be rezoned to
"CN" Neighborhood Cca�n�ercial Zoning District. For straw vote purposes,
Council Member Glynn offered a motion that the rec�ndation be accepted and
the "CN" zoning be designated on this tract. The motion prevailed by the
ensuing vote:

Parcel No. 31, located on both sides of Dove Road on the north side of North-
west Highway, was given special attention. The praperty was advertised for "�
the "HC" Highway Cam�ercial classification; hawever, the Planning & Zoning
Ccemtii.ssion had rec�.nded a "CC" Carmunity C�rcial designation for this
tract. Council Member Dyer then made a motion for straw vote purposes that
this parcel be rezoned to the "HC" Highway C�rcial Zoning District. The
motion prevailed by the follawing vote:

Following discussion on several other tracts of land, it was noted that
letters frcan property awners agreeing to a voluntary 45-day mr�ratoritun had
bee.n received relative to certain parcels. The City Council then gave
consideration to reqnoving these items fran these zoning deliberations and
readvertis�ng them for additional consideration and public testimr�ny.
Property awner agreement letters had been received from 1) Dallas-�rapevine
Associates and 2) Trinity Industries relative to their property as portions of
Parcels No. 132, 77, & 78. These tracts were located generally east of South
Main Street to Spur 382 and south of East Dallas Road to Highway 114. A
m�tion was offered for straw vote purposes by Mayor Pro Tem Ware that the ��•
properties awned by Dallas-Grapevine Associates and Trinity Industries (as
portions of Parcels No. 132, 77, & 78) be withdrawn fran these deliberations
and readvertised for additional consideration. The m�tion prevailed Y.�y the `"�`�
ensuing vote:

Mr. James Mason, the awner of Parcel No. 94, the southeast corner of William D.
Tate Avenue and Highway 114, had also agreed to the voluntazy moratori�n on

that this praperty awned by Mr. Mason be witYydrawn fran these deliberations
and readvertised for additional consideration. The motion prevailed by the

Parcel No. 95 included property under two c�merships 1) the I�etter Estate,
represented by Mr. Neil Nelles, and 2) Tanlin Properties, represented by Mr.
David Denison, both of whan had subanitted agreeme.nt letters. The property is
located on the south side of Highway 114 and extends fram William D. Tate ��
Avenue to Highway 26, north of the Airport property. A straw vote irotion was
made by Council Member Brekken to rezrove this parcel fran oonsideration at
this time and that it be readvertised for additional deliberation. The mQtion �,,

Mr. BarYy Knight, attorney representing Cecil Properties, Inc. , had sulx�iitted
,�+. a letter agreeing to the voluntary moratoritiun on their property referred to as
Parcel No. 24A and located on the west side of Park Boulevard inm�ediately
south of the existing Woodlake Apartments. For straw vote purposes, Council
� Member Ron Dyer offered a m�tion that this property be removed froan these
deliberations and readvertised for additional consideration. The m�tion
prevailed by the ensuing vote:

Parcel No. 30 was located generally on both sides of Lucas Drive south of
Worthington Street. Letters agreeing to the volunta.ry 45-day moratorium had
been received frcan Dr. Don Gerschick and Mr. Harlen Joyce, both of whom awned
property as portions of Parcel No. 30. A straw vote motion was made by
Council Me�er Glynn to remove the portions of this parcel owned by Dr.
Gerschick and Mr. Joyce fran consideration at this time, and that they be
readvertised for additional deliberation. The mption prevailed by the
follawing vote:

Mr. Carroll Ravk�otham, oumer of the Storage House mini warehouses on North

Parcel No. 34 awned by Mr. Rc�wl�otham be withdrawn fran these deliberations and

A property awner agreement letter had been received frcan Mr. Joe L. Wright
relative to his property located on the north end of Lucas Drive and currently
zoned for multi-family development (Parcel No. 164) . A motion was offered by
Council Me,mUer Brekken for straw vote purposes that Parcel No. 164 be with-
drawn from consideration at this time and readvertised for additional
deliberation. The motion prevailed by the following vote:

Mr. Ted E,hloe, representing the awners of the property identified as Parcel
No. 45, had also submitted a letter agreeing to the voluntary 45-day
�"* moratoritun. This property is located generally across frcen the Harris
Corporation on the northwest side of State Highway 121 North and backing up to
Corps of IIzgineers property at Lake Grapevine. A straw vote mr�tion was made
�r.r by Mayor Pro Tem Ware to remove this parcel fran these deliberations and
readvertise the property for additional consideration. The motion prevailed
by the ensuing vote:

Property awner agreement letters had been received frc�n 1) Frederick Brodsky
and 2) Rosewood Properties relative to their property as portions of Parcels
46, 47 and 49. In addition, it was noted that Ms. Chris Larson had testified

during the public hearing that her client, Ctiirt Carter, aaned property
included in Parcels 46, 47, and 49. It was his wish to have tY�e tract
reconsidered for a different zoning classification, and an extension of the
moratoriLun wr�uld be agreeable. The property in question is located in the
northeast portion of the City and wraps around the Hilton Hotel and the Austin
Ranch, extending north. A m�tion was made for straw vote purposes by Council
Member Dyer that the properties awned by Mr. Brodsky, Mr. Carter, and Rosewood
Properties be withdrawn fran consideration at this time and readvertised for
add.itional deliberation. The motion prevailed by the follawing vote:

Parcel No. 106 was then considered for remr�val fran these deliberations. It
was noted that this parcel, located on the southwest corner of Tanglewood
Drive and N�ustang Drive, had been advertised for the "R-3.5" duplex zoning
designation. Mr. James Lee, representing the property cx�,mer, had spoken at
the public Y�earing requesting an "R-MF-1" Multi-Family classification, and
Mayor Pro Tem Ware offered a straw vote motion that this parcel be withdrawn
and readvertised for additional consideration. The motion prevailed by the
ensuing vote:

Consideration was then given to Parcel No. 149, located generally on the south
side of State Highway 26 fresn Grapevine High School to Big Bear Creek. The
property, under several awnerships, had been advertised for the "CN"
Neighborhood ConaY�ercial Zoning District; hawever, the Planning & Zoning
Cca�mission felt this was inappropriate zoning for this tract and recc��ended
the parcel be reconsidered for "HC" Highway C�xcial Zoning. Council Member
RQn Dyer made a mc�tion for straw vote purposes that Parcel No. 149 be
withdrawn fr�► these deliberations and readvertised for additional ��e
consideration. The motion prevailed by the following vote:

Mr. Joe Wright, awner of Parcel No. 148, had also su}�iitted a letter agreeing

West Subdivision, fronting on Pool Road and extending east to Grapevine High
School. For straw vote purposes, Council Member Jim Glynn made a motion that
this tract be removed frcan consideration at this time and readvertised for

Parcel No. 139B, located at the r�rtheast corner of Hall-Johnson Road and the
proposed Cheeksparger extension, had been advertised for consideration as "CC"
ComYaznity C�rcial Zoning District. The Planning & Zoning Cammission,
hawever, had recam►ended that this property be reconsidered for the "R-N�'-2"
Multi Fami.ly designation. A m�tion was offered for straw vote purposes by
Mayor Pro Tem Ware that Parcel No. 139B be withdrawn fran these deliberations

Mr. Larry Lightner, awner of Parcel No. 121, and Mr. Jim Sawell, who had

I T�mberline Drive fran appr�imately 300 feet �as.� of Highway 121 South
extending west to Ztain Creek Cove. Council M�nber Ron Dyer offered a m�tion
for straw vote purposes that this property be ren►aved fran consideration at
this time and readvertised for additional deliberation. The motion prevailed

Parcel No. 121A was also owned by Mr. Larry Lightner, a portion of which had
been contracted for sale to Mr. Jim Saaell, and was located on the north side
of Timberline Drive and east of the proposed Cheeksparger extension to the
existing Pearltree Apartrnents. Both Mr. Lightner and Mr. Sawell had submitted
letters agreeing to the voluntary 45-day moratoritun on this tract. For straw
,�. vote purposes, a motion was offered by Mayor Pro Tem Ware that this parcel be
withdrawn at this ti.tre and readvertised for additional consideration. The
motion prevailed by the following vote:

Council Member Dyer that this parcel be withdrawn fran these deliberations and

Parcel No. 104, com�nly ]mcx�m as the fornier Box property, was currently
zoned "R-1" Single-Family Dwelling District and had been advertised for
consideration as "R-MF-2" Multi-Family Dwelling District. The recotm�endation
fran the Planning & Zoning Cannission, hawever, was that this tract be removed
from consideration at this time and readvertised for all residential uses. A
straw vote m�tion supporting the Planning & Zoning Camzussion rec�ndation
was made by Council Member Dyer and prevailed by the follawing vote:

Mr. Larry Lightner had also sul�nitted a praperty awner agreement letter
relative to his property located south of Grapevine High School and �st of
Timb�rline Drive (Parcel No. 116) . The property is lmdwn as Aspen Oaks and is
currently zoned for "R-3" Multi-Family development. For straw vote purposes,
a motion was offered by Mayor Pro Tem Ware to withdraw Parcel No. 116 fram
these deliberations and readvertise the property for additional consideration.

Parcel No. 117, approximately 4 acres located on the north side of Timberline
Drive adjacent to the Memorial Baptist Church, was advertised for
consideration of the "R-MF-1" N�ulti-Family Dwelling District. The
reco�ndation of the Planning & Zoning Carmission was to rezone the property
"R-3.5" 'Ita�-Family Dwelling District. The City Council discussed the
possibility of removing this tract for readvertisement and further
�^ consideration. A straw vote motion offered by Mayor Pro Tem Ware to consider
zoning this property "R-MF-1" as advertised failed for lack of a majority vote
in favor. �

Discussion of this item continued, and it was the general concensus of the
Council that Parcel No. 117 be included for "R-3.5" Twn-Family Dwelling
District zoning in the ordinance to be passed later in the meeting. It was
also requested that this tract be included with those parcels to be
readvertised so that additional consideration could be given.
During a discussion of Parcel No. 101, loca.ted at the northwest corner of
Ponderosa and Mustang Drive, it was noted that Mr. Hubert Gill had represented
the property awner during the public hearing and had requested additional
consideration for n�ulti-family developn�nt. At that ti.me, Mr. Gill had also

noted that they wnuld be agreeable to an extension of the m�ratoritun on this
tract. Mayor Pro 'Ipm Ware made a motion for straw vote purposes that Parcel
No. 101 be withdrawn and readvertised for further deliberation. The m�tion
prevailed by the ensuing vote:

Parcel No. 108A included the Cote office building located on HigYnaay 26 ��,�
adjacent to Mustang Stadiiun. This tract had inadvertently been included with
the stadilun for advertiserrn�it as "GU" Governmental Use, and the Planning &
Zoning Ccamission recam�.nded it be rea.dvertised for the "PO" Professional
Office Zoning District. For straw vote purposes, Mayor Pro Tem Ware offered a �"
motion to remove Parcel No. 108A frcm these deliberations and that it be
readvertised for additional consideration. The nx�tion prevailed by the
follawing vote:

Wayne's Drive-In and shopping center located on the southeast corner of
Tanglewood Drive and Mustang Drive was noted as Parcel No. 105. This property
had mistakenly been included in the advertisement with an adjacent tract for
consideration as "R-N�'-1" Multi-Family Lkaelling District. Upon discavering
this in their deliberations, the Planning & Zoning Commission reco�nrended
Parcel No. 105 be readvertised for the "CN" Neighborhood Cce�a�iercial Zoning
District. Being in agreement with the findings of the Planning & Zoning
Carmission, Council Member Marion Brekken offered a straw vote motion that
Parcel No. 105 be withdrawn frcHn consideration at this time and readvertised
for further deliberation. The motion prevailed by the ensuing vote:

Parcel No. 130, located east of Highway 121 South between Hughes Road and
Glade Rc�ad. For straw vote puzposes, Mayor Pro Tem Ware made a motion that
Mr. Flories' property as a portion of Parcel No. 130 be removed froan
consideration at this time and readvertised for additional deliberation. 'I'he

generally east of Highway 114 at College Street. A motion was offered for
straw vote purposes by Council Member Dyer that the properties awned by Mr.
Jim Lucas and Mr. Tim Lancaster (as portions of Parcel 53, 54) be withdrawn
frcan these deliberations and readvertised for additional consideration. The

The next order of business was for the City Council to consider the second
reading of Ordinance No. 84-20 passed on first rea.ding on May 1, 1984.
The caption of the ordinance was presented by the City Secretary.
It was noted that Parcel No. 14, located on the north side of West Northwest
Highway across fran the Northwest Plaza Shopping Center, had been included. in
the first reading of Ordinance No. 84-20 and was proposed to be rezoned to the
"PO" Professional Office Zoning District. Mr. Claude Miller, awner of the
property in question, had submitted a letter agreeing to the voluntary 45-day
moratori�n on this tract and requested that it be readvertised for additional
consideration.
Following brief Council discussion, a straw vote motion was made by Council
bsember Brekken that Parcel No. 14 be remr�ved frcgn consideration at this time
and be readvertised for further deliberation. The motion prevailed by the
following vote:

Nays . None

It was also noted that Parcel No. 32, located on the north side of Northwest
Highway frcan just east of Lucas Drive extending east to North Main Street, was
�,,,,,,, included in this second reading of Ordinance No. 84-20 (as instructed during
the City Council meeting of May 2, 1984) . The Planning & Zoning Commission
rec�ndation for this tract was "CC" Comrnxnity Cam�ercial Zoning District;
hawever, the City Attorney had advised that an "HC" Highway Cam��rcial
classification was a consideration under the current advertisement. Parcel
No. 32 was included in this reading of the ordinance for "HC" Highway
Cam�rcial zoning.
Council Member Brekken then made a motion to approve Ordinance No. 84-20 on
second reading, ea�cluding Parcel No. 14. Council Member Glynn seconded the
motion, which prevailed by the ensuing vote:

Council discussion ensued, during which the Council Nle�nbers were advised. that
property awner letters agreeing to the voluntary 45-day mpratoritun had been
received. frcgn (1) John & L�nda Hughes of 205 E. College, (2) Mr. Larry Brown
of 224 E. College, and (3) Dr. J. H. Miles of 213 E. College, each of these
tracts being a portion of Parcel No. 68, which was to be considered for
"R-7.5" Single-Family Zoning. Mayor Pro Tem Ware then offered a straw vote
nr�tion that the properties awned by Mr. & Mrs. Hugh,es, Mr. Brawn, and Dr.

It was also noted that Parcel No. 24B, located on the west side of Park
Boulevard near its intersection with Northwest Highway, and portions of Parcel
No. 58 c�med by (1) Susan Massey, located on the southeast corner of
Pebblebrook and Wall Street, and (2) Mr. William Ratcliff, just south of the
Massey tract at Pebblebrook and Heather, ha.d been withdrawn prior to the first
reading of this ordinance pending readvertisement.

A motion was made by Council Me.mber Pawers and seconded by Council Me�er

consideration, but that they not be included in the voluntary 45-day
moratorium (property awner agreement letters had not been received on these

It was noted that a resolution relative to extending the original m�ratorium
in�osed on SeptemUer 6, 1983, which had been included on the agenda, was not
needed. The original moratoritun would expire at midnight on May 3, 1984.
Mayor Tate then appointed Mayor Pro Tem Ware and Council Member Glynn to
review and inventory the non-conforniing uses in the City. Upon receiving wr�
their report, special consideration will be given to these tracts.
