The meeting was called to order by Mayor Tate.
INVOCATION
The Invocation was delivered. by Council Member Oliver.
PUBLIC HEARING, ZONING APPLICATION Z84-14, FRID BRANAN
The first order of business was for the City Council and Planning & Zoning
Cca�anission to conduct a public hearing relative to Zoning Application Z84-14
sulx�►itted by Fred Branan.
Mayor Tate declared the public hearing open.
Director of Cammunity Develognent H. T. Hardy advised the 3.132 acres inclu,cled
in this zoning request was located west of Park Boulevard and north of State
Highway 114. The current zoning on the tract was "R-3.5" Two-Family Dwelling
District, with the requested zoning being "CC" Car¢nunity Ca�ercial Zoning
District. He noted that the awner of this tract also owned an adjacent tract
in the City limits of Southlake, and frontage to the Grapevine property would
�"""'" be fran Highway 114 in Southlake.
Dr. Fred Branan, applicant, then addressed the City Council and Commission and
i� advised. that his property within the City of Southlake had comnercial zoning.
He continued that prior to the City-instigated rezoning, the portion of his
property within the City of Grapevine also had a coir¢nercial zoning
designation. Mr. Charles Starnes then presented. the preliminary plans for
development of the property.
Questions and can�anents frcan the Council Members and Commissioners followed,
after which Mayor Tate asked if there were guests present who wished to speak
relative to this zoning application. There were none. It was reported that
no correspondence had been received concerning this request.

The motion was seconded by Ccmmi.ssioner Gerald Norman and prevailed by the
following vote:

A motion to close the public hearing was also made by Mayor Pro Tem Ware and
seconded by Council Memb�r Pawers. The motion prevailed by the ensuing vote:

PUl3LIC HEARING, ZONING APPLICATION Z84-15, MARK TUI'UN �
The next order of business was for the City Council and Planning & Zoning
Conmission to conduct a public hearing relative to Zoning Application Z84-15
submitted by Mr. Mark Tutun representing the Willard Baker Canpany.
Mayor Tate declared open the public hearing. Mr. Hardy, Director of Canmunity
Develognent, reported. this was a "clean up" zoning effort by the Willard Baker
Company relative to their proposed Western Oaks development, which is Iocated
on the west side of State Highway 121 South, north of Parker Cemetery and
south of Big Bear Creek.
Mr. Mark Tutun, applicant, then reviewed the recent zoning history on this
tract, which included the City-instigated zoning case and Zoning Application
Z84-09 considered on April 17 and May 15, 1984. Three small tracts vaere to be
considered in Z84-15 in order to coordinate zoning district lines. The pro-
posed rezoning of Tract lA was fran "R-MF-2" Multi-Family Dwelling District to
"CC" C�nity Co�mercial Zoning District; Tract 3A fran "R-MF-2" Multi-Family
Dw�lling District to "CC" Commznity Cc��ercial Zoning District; and Tract 8
frcan "R-MF-2" Multi-Family Dw�elling District and "R-20" & "R-12.5" Single-
Family Districts to "R-7.5" Single-Family District (see attached Exhibit "A") .

Questions and c�nts frcgn the Cca�mission and Council followed, after which
Mayor Tate invited those guests present who wished to speak for or against the
proposed zoning to do so. No one wished to cc�mrent. It was also reported �""�
that no correspondence or petitions had been received.
A mption to close the Cammission's portion of the public hearing was offered.
by Commission Member Shane Wilbanks. Commissioner Gerald Nornian seconded the
motion, which prevailed by the follawing vote:

Nays: None
Council Member Oliver also made a motion to close the public hearing on Zoning
Application Z84-15. The motion was seconded by Council Member Brekken and
prevailed by the ensuing vote:

The next order of business was for the City Council and Planning & Zoning Can-
mission to conduct a public hearing relative to the replat of Lots 18 & 19,
Block 2, Tiffany Forest Addition. w�ar
Mr. Doug Eberhart, Public iNorks Engineer, noted that the proposed replat of
Lots 18 & 19, Block 2, of the Tiffany Forest Addition was a settlanent between ,,,�
property awners over the location of a conmon property line. It was later
learned that this type of a replat did not require a public hearing, but since
notification of the hearing had already been published in the newspaper, it
wr�uld continue.
No one representing the applicant was present to speak. In addition, there
were no persons present who wished to ccnanent relative to the proposed replat,
and no correspondence had been received.

seconded. by Ccmnission Member Joyce. The motion prevailed by the ensuing

RECESS, PLANNING & ZONING COMMISSION
Mayor Tate then announced that the Planning & Zoning Comni.ssion would recess
to the Civic Center, 311 Main Street, to consider other published agenda
items.
The City Council was to remain in session to consider further business.
MISCII�LANEOUS REPORTS
City Manager Jim Hancock then reported the City had employed a new Main Street
Project Director, and he introduced Mary Ellen Tamasy who had recently ass�d
this position.
CC7NTRACT WITH STATE HIGHf�Y DEPARZT�]T, EXTENSION OF HIGHV�.Y 121 FRONTAC� ROAD
The next item considered by the City Council was authorizing the execution of
a contract with the State Highway Departnuent relative to an extension of High-
way 121 N frontage road (in conjunction with Connell Develo�.anent C�npany) .
""�""' City Manager Jim Hancock reviewed the procedure for extension of this portion
of frontage road at the expense of Connell Development Canpany. This would
%,,,,�, require two contracts: (1) One between the City and Connell Develo�anent
Company stipulating that they will provide funding and engineering for the
project; and (2) A contract between the City and the State Highway Department
stipulating that the City will advertise for bids and award and administer the
contract. The first contract with Connell Develognent Company had been
approved on April 17, 1984, and the City Staff was naa recammending that the
contract with the State Highway Department be approved.
There being little discussion, Mayor Pro Tem Ware offered a motion that the
agreement with the State Highway Departrnent be approved. The motion, seconded
by Council Member Glynn, prevailed by the following vote:
Ayes: Tate, Ware, Oliver, Brekken, Dyer, Glynn, & Paaers
Nays: None
ORDINANCES, GARBAGE RATES
The next order of business was for the City Council to consider an ordinance
amending the City Code relative to service rates for solid waste collection
and disposal.
The caption of the proposed ordinance was read by the City Secretary.

Assistant City Manager Bill Eisen reviewed the rates proposed by SCA Services
of Fort Worth in their new 5-year contract for refuse collection and disposal.
�.r Most of the rates were proposed to be reduced, with twice-a-week service to
residential, single-family honues decreasing fram $4.50/month to $3.94/month.
It was rec�uended the effective date of the ordinance be May 21, 1984.
A motion was then made by Council Member Pawers and seconded by Council Me.mber
Glynn that the ordinance be adopted. The mption prevailed by the ensuing
vote:

The next item before the City Council was to consider the minutes of the
meetings of April 23, 24, 25, & 26 and May 1, 2, 1984.

There being no additions or corrections, Council Member Glynn made a motion
that the minutes be approved as published. The motion was seconded by Mayor
Pro Tem Ware and prevailed by the ensuing vote:

PLANNING & ZONING CON7NiISSION RECONA�IDATIONS, CITY-INSTIGATED REZONING CASE
The next order of business was for the City Council to consider the reconr
mendations of the Planning & Zoning Commission relative to pending City-
instigated rezoni.ng cases, if available, and take any necessary action
relative thereto. These recaninendations were carried over fran the City
Council and Planning & Zoning deliberations of June 6-18, 1984.
Item No. 28, Parcel No. 101 - This tract is located on the northwest corner of
Mustang Drive and Ponderosa and is awned by SunWest Properties. The current
zoning on the property is "R-3" Multi-Family Dw�lling District.
Planning & Zoning C�anission Chairman Sharron Spencer reported the Ccattnission
had, on June 14, 1984, made a rec�ndation on this tract for "R-MF-2" Multi-
Family Dw�elling District with deed restrictions limiting the density to 16 '"'�
units per acre. At that time, the City Council had requested that the item be
sent back to the Ccmunission for reconsideration. Following additional �i
deliberation, Mrs. Spencer advised the Planning & Zoning Cce�nission was still
in agreearent to recommend that this parcel be zoned for multi-family
develognent with a 16-unit-per-acre maximum density being imposed by deed
restrictions. Their vote was 6 to 0.
The caption of the proposed ordinance was presented by the City Secretary.
Council discussion followed, during which it was noted that the Master Plan
designation for this tract was meditun density residential, and Mr. Wiles,
consulting planner, had reco�nended "PRD-12" Plaruzed Residential District.
Density and drainage problems in the area were discussed, as well as the
Cc�ani.ssion's concern for camnercial develo�xnent which wr�uld be allawed under
the "PRD-12" district.
Mayor Pro Tem Ware then offered a motion to accept the recongrtendation of the
Planning & Zoning Conmission and adopt the ordinance. Council Meznber Brekken
' seconded the motion, which prevailed by the following vote:

NOr!'E: The owner of Parcel 101 had initially submitted a letter opposing any
change in the zoning of this tract, which would require a three-quarter
vote of the City Council to approve. Mr. Hubert Gill, representing
SunWest Praperties, withdrew their objection and confirmed their
acceptance of the zoning.
Item No. 31, Parcel No. 139B - Parcel No. 139B is currently awned by Lincoln
Properties and is located on the northeast corner of the proposed Cheek-
Sparger extension and Hall-Johnson Road. The property is zoned "R-1" for
single-family develognent, and Mrs. Spencer reported the Planning & Zoning
Conanission recca�anendation for "R-MF-2" Multi-Family Dwelling District on the
entire tract. She noted the Ccamnission preferred the "CN" Neighborhood
Coimlercial District; hawever, this choice was not available under the current
advertisement.
City Secretary Karen Spann then read the caption of the proposed ordinance.

Following brief Council discussion, Mayor Pro Tem Ware made a mr�tion that this
;,�„ item be tabled and to authorize the City Staff to institute a new zoning case
for consideration of the Neighborhood C�ercial District. The mr�tion was
seconded by Council Mem}�er Dyer and prevailed by the followinq vote:
Ayes: Tate, Ware, Oliver, Brekken, Dyer, Glynn, & Powers
Nays: None
Item No. 32, Parcel No. 22A - Parcel No. 22A is located on the northwest
corner of Dove Road and Dove Loop RQad and is currently zoned as "PUD" Planned
Unit Develognent. The Planning & Zoning Camnission reconmendation as reported
by Mrs. Spencer was for the "CN" Neighborhood Camnercial Zoning District by a
vote of 4 to 2.
The caption of the proposed ordinance was presented by the City Secretary.
During the e�nsuing discussion, concern was expressed for c�rcial
develoFanent on the entire 11± acre tract and that the awner did not have a
develo�ent plan proposed. Possible am�enciments to the "CN" Neighborhood
Co��rcial District were also noted, such as limiting the square footage of
buildings and leased spaces.
Follawi.ng lengthy deliberation, Mayor Pro Tem Ware offered a motion to accept

zoning Parcel No. 22A "CN" Neighborhood Cammercial. The motion was seconded
by Council Member Oliver and failed by the ensuing vote:

Planning & Zoning Coim�ission Chairnian Sharron Spencer reported the
Cc�mission's recc�m�endation as follaws:
(1) "CC" Ca�nunity C�rcial District on approximately 15 acres fronting on
Highway 121;
(2) "R-MF-2" Multi-Family Dwelling District on the remainder of the tract
lying east of the creek which runs north and south through the property;

which is located on the west side of the creek, backing up to the pro-

City Secretary Karen Spann read the caption of the proposed ordinance.
A lengthy Council discussion followed. Possible use of the creek and/or the
proposed arterial as buffers was addressed, as c�ll as whether the creek would
be an adequate buffer. Master Plan proposed densities for this tract were
�* discussed, and the location of the comnercial designation was deliberated.
Council Member Glynn then offered a mption to accept the rec�tiendation of the
� Planning & Zoning Co�nission and adopt the ordinance. Mayor Pro Tem Ware
seconded the motion, which failed by the following vote:

Council Member Tcgn Powers then made a motion to table consideration of this
matter for 45 days in order to work with the developer for an acceptable plan.

discussion, Council Meznbers Powers and Oliver agreed to amend their motion to
table the matter until 'Thursday, June 21, 1984 at 7:30 p.m. The amended
motion prevailed by the ensuing vote:

of Timberline Drive between Oak Creek Estates and the existing Pearltree

Chairnnan Spencer advised the Planning & Zoning Commission made the following

necessary to approve.

Item No. 37, Parcel No. 121 - Mr. Lightner was also the owner of this approxi-
mately 78-acre tract located on the south side of Timberline Drive, wrapping
around the Creekwood P,ddition and extending east to approximately 300 feet
west of State Highway 121. The existing zoning on the tract is "R-3" Multi-
Family Dwelling District and "C-2" Camm�nity Business District, and it had
been advertised for consideration of all residential districts. The Planning
& Zoning Conanission recca�anendation as reported by Mrs. Spencer was for the
"PRD-6" Planned Residential District on the entire tract, subject to a flood
reclamation plan being approved by the City prior to development. The vote

The City Council deliberated this matter at length. Concern was expressed for
dividing the land uses by the proposed Cheek-Sparger arterial, leaving
approximately 21 acres to be located east of the arterial directly across fran

ments of the "PRD-6" district could be met due to the flood plain and build- '""�"
able area was also addressed. It was noted that the Master Plan recammended

Dear Honorable Mayor and City Council:
I am the owner of approxi.mately 27 acres that surrounds Grapevine
°"�'�` Medical Center. I have recently had an engineering consultant
review the PCD zoning designation you have applied to my property.
,� He has made me aware of a requiretn�ent under that category that
concerns me grea.tly: that is, the requirement of a buffer zone of
60 to 100 feet betvueen the PCD and adjacent zoning. A land benn and
a greenbelt buffer only are allowed. and therefore, all this huge
amount of land cannot have parking or construction of buildings on
it. If this interpretation is correct, this is definitely punitive
and damaging to my property.
I intend to sul�lit a plat for said tract within this year. I also
intend to deed restrict my subdivision strictly to enforce a quality
business park. I finally intend to build my awn professional office
building in said subdivision along with a not-for-profit Wellness
Center designed for use by the entire community.
The problem that I have is the width of the land required by your
ordinance, not the land benn and screening fence requirements. I
need to retain the use of that property for parking. Your ordinance
as I have interpreted it restricts all use within these boundaries
because of the neighboring single family districts. My land is
currently sized in a way that I have only one practical develo�xnent
plan, and that is for the new street into my property to split
evenly and approx�m�ately 470 feet frontage on College street having
'"""`" lots fronting on said new street. This solution is good because it
does not allow a straight through intersection with the new street
and Azalea Drive. It does give me lots with depths of 200 feet
�► which are ideal for professional office construction. However when
I install the minumun 60 feet with benn requirement then I must move
the street west to retain a typical usable lot depth and this causes
an intersection that is undersirable by the City engineering
standards.
Therefore in conclusion, I must request that you consider requiring
the preluninary plat applicant tonight (the purchaser of the
Williamson land) to share the 60 feet requirement with me by imple-
menting a 30 feet rear yard building line on all lots adjacent to my
property. Also to share the cost of installing a berm with a

screening fence on our boundary at the time of construction of his
streets. I will also dedicate 30 feet along our boundary as
greenbelt buffer and require by deed restriction that all users in
the business park professionally landscape and maintain said 30 feet
greenbelt area.
I think this solution is a good co�nprcanise because your zoning ordi-
nance also suggests that the greenbelt area bec�s the responsi-
bility of the land not previously zoned, be it the residential or
the Business Developer. Since my zoning was in place first the �
entire 60 feet could be the responsibility of the land awner to the
east. It also insures an orderly thoroughfare plan and appealing
greenbelt Business Park design. I intend to request the sat�ue �,,,�
voluntary greenbelt "sharing" fran Baylor Medical Center on my
western boundary.

The property in this preliminary plat (known as the Sinnx>ns tract) is located
on the southwest corner of Dove Road and Park Boulevard and is zoned for
single-family develo�nt. Mrs. Spencer reported the Planning & Zoning
�* CcxYmission rec�ndation for approval of the preluninary plat, with the
provision that no streets be extended through to the property to the south
which is zoned for duplexes. Their vote was 7 to 0.

Council Member Oliver offered a motion, which was seconded by Council Member
Glynn, to accept the rec�ndation of the Planning & Zoning Cc�ission and
approve the preliuninar.y plat of the Simnons tract. The mr�tion prevailed by
the ensuing vote:

PRELIMINARY PLAT, COLLEGE CRE�.-'K ADDITION
The next item before the City Council for consideration was the reco�nendation
of the Planning & Zoning Ccmgnission relative to the preliminazy plat of the
College Creek Addition.
The College Creek Addition is located on the south side of West College Street
across fran Cannon Elementary School. The tract is zoned "R-7.5" Single-
Family, with the southern portion being zoned for duplexes. Planning & Zoning
C�mission Chairman Sharron Spencer advised the Cca�anission rec�nded
approval of the preliminary plat with the following provisions: (1) That the
easterrunost north-south street alignment with Drexel Drive be addressed on the
'�' '� final plat; and (2) That a letter be received fran the developers, Mr. Tamnitz
� and Mr. Parker, agreeing to postpone develo�ent of the duplexes until an
;,�, east-w�est through street is constnicted to Ball Street or to Highway 114.
During the ensuing discussion, Mr. Mike Starek of DeShazo, Starek, & Tang, was
called upon to address the traffic study. Concern was expressed for only one
point of ingress/egress, increased traffic as it relates to the school, and
Council Me.mbers favored an access point for �ergency vehicle use.
A motion was then made by Mayor Pro Tem Ware and seconded by Council M��ber
Oliver to accept the recommendation of the Pl�nn;nq & Zoning Camnission for
approval of the preliminary plat of the College Creek Addition, with the above
stipulations to be addressed at the time of final platting. The motion
prevailed by the ensuing vote:
Ayes: Tate, Ware, Oliver, Brekken, Dyer, Glynn, & Paaers

The next order of business was for the City Council to consider the
recaimlendation of the Planning & Zoning Cce�anission relative to the preliminary
plat of Dove I�anding.
`'"�"" This particular tract is presently zoned "R-5.0" Zero Lot Line and is located
on the south side of Dove Road iimiediately east of the Park Place Addition.
Mrs. Spencer reported the Planning & Zoning Cc�mission reco�nendation for
+�r approval of the preliminary plat by a vote of 7 to 0.
Council Member Oliver then made a motion to accept the reco�rendation of the
Conmission and approve the preliminazy plat of the Dove Landing Subdivision.
The nx�tion was seconded by Council Members Pawers and prevailed by the ensuing
vote:
Ayes: Tate, Ware, Oliver, Brekken, Dyer, Glynn, & Pawers
