Public Works Director Jim Baddaker advised that an application for extraordinary hardship exemption from the moratoriun, as provided by Resolution No. 83-34, had been submitted by Rick Reutlinger on October 4, 1983. The property illustrated in the application is located at 303 west Northwest Highway and was zoned in June, 1983 for "S-P" Site Plan District for a veterinary hospital, avernight boarding of animals during treatnent only, and also included all other uses in the "C-C" Crnznity Corcial District. The public hearing was opened by Mayor Tate. He continued that he had reviewed the overall situation and a building permit had been issued to Mrs. Vance for the purpose of adding a bathroom to the downstairs of a tawnhome, said addition being considered an accessory structure to the principle use of the property and, thus, allawed under the terms of the mrratoritnn. Mr. Baddaker also stated the notice of public hearing for this application had been advertised and, therefore, it had been included as an agenda item. No action was taken by the City Council. PUBLIC HEARING, HARDSHIP TION FROM NiORATORIUM, KEITH CCIL & ASSOCIATES The next order of business was for the City Council to conduct a public hearing relative to application for extraordinary hardship exemption from moratorium submitted by Keith Cecil & Associates and consideration of same. Mayor Tate declared open the public hearing. Public Works Director Jim Baddaker advised that Keith Cecil & Associates, Inc. had submitted an application for extraordinary hardship exemption fram the moratoritnn, as provided by Resolution No. 83-34, on October 6, 1983. The property in question is located on the west side of Park Boulevard, directly south of the existing Woodlake Apartmxit develoxnent. C.irrently the tract is zoned for a Specific Use Permit for multi-family dwellings and provides for the number of units not to exceed 16 units per acre. The use of the property as recnded by the Master Plan is for meditun density residential. Follawing Mr. Baddaker's presentation of this application, those persons who wished to testify during the public hearing were sworn in by the City ;„ .. None Absent: Dtu1n PUBLIC HEARING, HARDSHIP lPTION FROM MORATORIUM, JOE WRIGHT The next order of business was for the City Council to conduct a public hearing relative to application for extraordinary hardship exemption from moratoriiun submitted by Mr. Joe Wright and consideration of same. The public hearing was declared open by Mayor Tate. City Manager Jim Hancock then explained this was a continuation of the public hearing which was tabled on October 4, 1983 pending the recomnendation of the (6) 10/1$/$3 Planning & Zoning Commission relative to a revised development plan sulnitted by Mr. Wright. It was noted that the Planning & Zoning Ccmission had recently denied the revised. developme.ilt plan, and Mr. Wright was now request- ing a waiver of the zoning moratoritun in order to submit a new zoning application. The property in question is lmawn as the Pickering tract in northwest Grapevine. Those persons who wished to testify during the public hearing and had not been previously sworn then received the oath by the City Secretary. Mr. Joe Wright did then review the circnstances of his application, stating that he wished to amend the site plan on the current "P-D" zoning. Those persons wishing to connrent relative to this application were then invited to do so. The follaaing persons spoke in opposition to the waiver approval: Mr. Edwin Crtis Mr. Kenneth Mitchell 308 Lake Forest Road 2229 Forest Hill Road Mr. Pat Nolan Mr. William T. Criswell 2105 Lakecrest Drive 3101 Lakeridge Drive Mr. Wright was then given the opportunity for further comnnt. Additional Council discussion ensued, after which the follawing letter was read by the City Secretary. ------------------------------------------------------------------------------ GRAPEVINE CITY COUNCIL Ners of the council, my nane is Jack W. Boley, I reside at 2751 Wazwick Way, Grapevine. I wuld like to speak on the Pickering Property. It is my belief that their property should be left under "" the moratoritun until it is in campliance with master plan. Also currently the Dove Rd. project needs to be completed before any more ,_, permits are issued in the areas west of Park Blvd. to the city limits and north of Dove Rd. The city desperately needs to wrrk with Southlake and the county to widen and resurface Kimball Rd. fran Hwy. 114 to Yates Corner before any mre building is allawed. Lastly I would encourage the city to place a fee of $1000.00 on each single family building permit and $300.00 per unit on each apartrrent colex. This money should be xeserved for street, water, and sewer improvements. It seems only fair for the developers to pay these fees for expansion instead of placing the burden on current tax payers. Thank you very much for allawing this to be read into the record of this hearing. Jack W. Boley ------------------------------------------------------------------------------ A motion was then made by Mayor Pro Tem Ware and seconded by Council Member Dyer to close the public hearing. The motion prevailed by the following vote: Ayes . Tate, Ware, Oliver, Brekken, Dyer, & Glynn Nays . None Absent: Dunn The City Council then deliberated the application at length, during which City Attorney John Boyle clarified zoning regulations and noted that the Council could, by waiving the moratoriLun on zoning, allaw Mr. Wright to submit a new zoning application with a new site plan. The caption of a proposed resolution was then read by the City Secretary. Council Member Larry Oliver made a motion to adopt the resolution and grant the waiver for rezoning to Mr. Joe Wright. A second was offered by Mayor Pro Tem Ware, and the motion prevailed by the follawing vote: (7) 10/18/83 Ayes . Ware, Oliver, Brekken Nays .
