Rq_�� AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS ABANDONING AND VACATING A SANITARY SEWER LINE EASEMENT LOCATED IN THE TIMBERLINE SOUTH ADDITION IN THE CITY OF GRAPEVINE, TEXAS, AS HEREINAFTER DESCRIBED; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN �`� EMERGENCY AND PROVIDING AN EFFECTIVE DATE �,,,, WHEREAS, the owner of a tract of land located in the Timberline South Addition in the City of Grapevine, Tarrant County, Texas, as more particularly described in Exhibit "A" , requested the sanitary sewer line easement, as hereinafter described, be abandoned and vacated; and WHEREAS, the sanitary sewer line easement, as hereinafter described, is not needed for public use and will not be needed in the future for public use; and WHEREAS, abandoning and vacating the sanitary sewer line easement will relieve the City of Grapevine, Texas from the cost and expense of maintaining said property and facilities . NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1 . That the City of Grapevine sanitary sewer line easement as recorded in Volume 4795 , Page 41 of the Tarrant County Deed Records, and as shown in Exhibit "A" , attached hereto � " and made a part hereof, is hereby abandoned and vacated for public use and the same is hereby abandoned and vacated insofar ��.,, as all public right, title, duty and interest in and to said described portion of said sanitary sewer line easement is concerned. The City shall have no responsibility for maintaining said easement. Section 2 . If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 3. The fact that said sanitary sewer line easement is no longer needed by the public for public usage and would create a hardship or burden upon the City of Grapevine to keep open and maintain such easements creates an urgency and an emergency for the immediate preservation of. the public health, safety, and general welfare, which requires that this ordinance shall take effect immediately from and after its passage, and it �t..w is accordingly so ordained.
