AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF GRAPEVINE, TEXAS, AMENDING CHAPTER 3 ,
ARTICLE III , DIVISION 2, CHAPTER 3 OF THE
GRAPEVINE CITY CODE BY AMENDING SECTION 4A
( 1) (b) RELATING TO THE DEFINITION OF
"LITERATURE" AND BY PROVIDING A NEW
SUBSECTION (c) RELATING TO THE DEFINITION OF
�* "TERMINAL SECTION" ; BY AMENDING SECTION 4A
(4) (c) BY THE ADOPTION OF A NEW SUBSECTION
(dd) RELATING TO THE ALLOCATION OF AVAILABLE
�, TERMINAL SPACE AND PROVIDING A NEW
SUBSECTION (ee) PROHIBITING THE STORAGE OF
LITERATURE IN AIRPORT TERMINALS; BY AMENDING
SECTION 18 RELATING TO PROHIBITING THE
PLACEMENT OF EASELS, TRIPODS OR SIMILAR
ITEMS IN AIRPORT TERMINALS; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A PENALTY OF
FINE NOT TO EXCEED THE SUM OF FIVE HUNDRED
DOLLARS ($500 . 00) FOR EACH OFFENSE AND A
SEPARATE OFFENSE SHALL BE DEEMED COMMITTED
EACH DAY DURING OR ON WHICH AN OFFENSE
OCCURS OR CONTINUES; DECLARING AN EMERGENCY
AND PROVIDING AN EFFECTIVE DATE
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS :
Section 1 . That Chapter 3 , Article III , Division 2,
Chapter 3 of the Grapevine City Code is hereby amended in the
following particulars and all other chapters, articles,
divisions, sections, subsections, paragraphs, definitions ,
°�"" words and phrases of said Code are not amended but are hereby
ratified, verified, and affirmed.
Section 2 . That Chapter 3 , Article III , Division 2,
Chapter 3 , Section 4A{ 1) (b) is hereby amended to read as
follows :
" (b) ' Literature ' is defined as books,
pamphlets, handbills, tracts, cards ,
circulars , pictures, films , magazines , or
any other items . "
Section 3 . That Chapter 3 , Article III , Division 2 ,
Chapter 3 , Section 4A ( 1) is hereby amended by the addition of
a new subsection (c) which shall read as follows :
" (c) ' Terminal Section' is defined as the
Connector Building between Airport Terminals
2E and 3E and the A, B, and C Sections of
Level 2 of Terminals 2E, 3E, 4E and 2W. "
Section 4 . That Chapter 3 , Article III , Division 2 ,
Chapter 3 , Section 4A (4) (c) of the Grapevine City Code is
hereby amended by the addition of two new subsections (dd) and
(ee) which shall read as follows :
" (dd) No more than three (3) persons
authorized by permit to solicit funds or
distribute literature shall be authorized to
do so in the secure area of any one terminal
section on any given day. Each person
wishing to distribute literature or solicit
funds must :
( 1) Obtain in advance one of three
dated tags for the terminal section
in which he desires to solicit funds
or distribute literature. Such tags
shall be available from 7 : 00 a .m. to '
5 : 00 p.m. on a first-come first-serve
basis at Station One of the Airport
Department of Public Safety on and
for each day that the person desires
to solicit funds or distribute
literature . No person may hold more
than one tag at a time . Only the
person obtaining the tag as described
above may use it .
(2) Return the tag for one
terminal section before obtaining a
tag for another terminal section on
the same day.
(3) Display the dated tag on his
upper torso, clearly visible to the
public, while engaged in the
permitted activity in the terminal
section and on the date to which the
tag pertains .
(ee) A permittee commits an offense if he
stores any literature or any items used in
connection with his literature distribution
or solicitation of funds in any public use
area of the Airport ' s terminals . All such
literature and material shall be carried on
the person of a permittee while inside an
Airport terminal building; provided,
however, that where the solicitation of
funds or distribution of literature is
conducted from tables under Section 18 of
Chapter 3 of this Code, the literature or
material may be placed or displayed upon the
�°` ° permittee' s table. "
,� Section 5 . That Chapter 3 , Article III , Division 2,
Chapter 3 , Section 18 of the Grapevine City Code is hereby
amended to read as follows :
"Section 18 . Tables and chairs .
Except as provided in Section 4A (4) (c) (cc)
of this Chapter a person commits an offense
if he places or maintains a table, bench,
chair, stool , easel , tripod or other item
designed or adapted to serve similar
purposes on Airport premises not leased to
that person by the Airport Board for
commercial or traveler ' s aid purposes . "
Section 6 . If any section, article, paragraph, sentence,
clause, phrase or word in this ordinance, or application
thereof to any person or circumstance, is held invalid or
unconstitutional by a Court of competent jurisdiction, such
holding shall not affect the validity of the remaining portions
of the ordinance and the City Council hereby declares it would
have passed such remaining portions of the ordinance despite
"�" such invalidity, which remaining portions shall continue in
full force and effect .
� Section 7 . Any person violating any of the provisions of
this ordinance shall be deemed guilty of a misdemeanor and upon
conviction thereof shall be fined in a sum not to exceed Five
Hundred Dollars ($500 . 00) for each offense and a separate
offense shall be deemed committed upon each day during or on
which a violation occurs or continues .
Section 8 . The fact that the present ordinances and
regulations of the City of Grapevine, Texas , are inadequate to

properly safeguard the health, safety, morals , peace, and
general welfare of the public creates an emergency which
requires that this ordinance become effective from and after
the date of its passage, and it is accordingly so ordained.
