AN ORDINANCE AMENDING ORDINANCE NO. 82-73,
THE COMPREHENSIVE ZONING ORDINANCE OF THE
CITY OF GRAPEVINE, TEXAS, SAME BEING ALSO
KNOWN AS APPENDIX "D" OF THE CODE OF
ORDINANCES BY PROVIDING FOR AMENDMENTS AND ,
CHANGES TO ZONING REGULATIONS BY AMENDING
< SECTION 24 .0 RELATIVE TO "CN" NEIGHBORHOOD
COMMERCIAL ZONING DISTRICT; BY AMENDING
SECTION 25 .0 RELATIVE TO "CC" COMMUNITY

SECTION 26.C. RELATIVE TO "HC" HIGHWAY
COMMERCIAL ZONING DISTRICT; RATIFYING,
VERIFYING AND AFFIRMING ALL ACTIONS TAKEN BY
THE CITY COUNCIL WITH RESPECT TO THE GRANTING
OF CONDITIONAL USE PERMITS FOR PLANNED
COMMERCIAL CENTERS IN THE "CN" NEIGHBORHOOD
COMMERCIAL ZONING DISTRICT, THE "CC"
COMMUNITY COMMERCIAL ZONING DISTRICT AND THE
"HC" HIGHWAY COMMERCIAL ZONING DISTRICT;
PROVIDING A PENALTY OF FINE NOT TO EXCEED THE
SUM OF TWO THOUSAND DOLLARS ($2, 000 .00) FOR
EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE
DEEMED COMMITTEED UPON EACH DAY DURING OR ON
WHICH A VIOLATION OCCURS OR CONTINUES;
PROVIDING A SEVERABILITY CLAUSE; DECLARING AN
EMERGENCY AND PROVIDING AN EFFECTIVE DATE
' BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE,

,,,,_, Section 1 . That Ordinance No. 82-73, the Comprehensive
Zoning Ordinance of the City of Grapevine, Texas, same being also
known as Appendix "D" of the Code of Ordinances of the City of
Grapevine, Texas, is hereby amended in the following particulars,
and all other sections, subsections, paragraphs, definitions,
i words and phrases of said Appendix "D" are not amended but are
hereby ratified, verified, and affirmed:
I A. That Section 24 .C. relative to "CN" Neighborhood
jCommercial Zoning District is hereby amended by the
! addition of a new Subsection 9 which shall read as
follows:

i 9 . Planned Commercial Centers
I B. That Section 25 .C. relative to "CC" Community Commercial
Zoning District is hereby amended by the addition of a
new Subsection 12 which shall read as follows:
"12 . Planned Commercial Centers"
I�I C. That Section 26 .C. relative to "HC" Highway Commercial
' ` Zoning District is hereby amended by the addition of a
new Subsection 13 which shall read as follows :

I Section 2 . That the City Council hereby ratifies, verifies,
t and affirms all action taken since July 21, 1987 regarding the
granting of conditional use permits for Planned Commercial
Centers in "CN" Neighborhood Commercial, "CC" Community
I�� Commercial and "HC" Highway Commercial Zoning Districts.
Section 3 . Any person violating any of the provisions of
;i this ordinance shall be deemed guilty of a misdemeanor and upon
conviction thereof shall be fined in a sum not to exceed Two
�
Thousand Dollars ($2, 000 .00) for each offense and a separate ,
offense shall be deemed committed upon each day during or on
which a violation occurs or continues .
Section 4. If any section, article, paragraph, sentence,
clause, phrase or word in this ordinance, or application thereof
to any person or circumstance, is held invalid or
unconstitutional by a Court of competent jurisdiction, such ,
holding shall not affect the validity of the remaining portions
- of the ordinance, and the City Council hereby declares it would
have passed such remaining portions of the ordinance despite such
invalidity, which remaining portions shall remain in full force '
and effect. '
Section 5. The fact that the present zoning ordinances and
regulations of the City of Grapevine, Texas, are inadequate to
properly safeguard the health, safety, morals, peace, and general
welfare of the public creates an emergency which requires that
this ordinance shall become effective from and after the date of
its passage, and it is accordingly so ordained.

GRAPEVINE, TEXAS on this the 15th day of December , 1987 .
