HomeMy WebLinkAboutORD 1988-009 ORDINANCE NO. 8 8-0 9 AN ORDIN�INCE ANN�NNDING ORDINANCE NO. 82-73, THE COMPREI�LVSIVE ZONING ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS, SAME BEING ALSO KNOWN AS APPENDIX "D" OF THE CODE OF ORDINANCES BY PROVIDING FOR ANNIENNDMENTS AND CHANGES 'I�0 ZONIlVG REGULATIONS BY AMENDING SECTION 12 DEFINITIONS; BY AMENDING SECI'ION 56 OFF=STRE�I' PARKING REQUIRENIENTS AND BY AMENDING SECTION 58 PARKING AND LOAD AREA DEVEL�OPMENT STANDARDS; PROVIDING A PE[�ALTY OF FINE NO�I' TO EXCEID THE SUM OF TWp THOUSAND DOLI,ARS ($2,000.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE DEII��D COMMITTF,ED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS OR CONTINUES; PROVIDING A SEVERABILITY CLAUSE; DEC.LARING AN II�RGE[�CY AND PROVIDING AN EFFFjCTIVE DATE BE IT ORDAINID BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That Ordinance No. 82-73, the Comprehensive Zoning Ordinance of the City of Grapevine, Texas, same being also ]mown as Appendix "D" of the Code of Ordinances of the City of Grapevine, Texas, is hereby amended in the following particulars, and all other sections, subsections, paragraphs, definitions, w�rds and phrases of said Appendix "D" are not amended but are hereby ratified, verified, and affirmed: � A. That Section 12.A, relative to Definitions is hereby amended by the addition of a new Subsection 102 which shall read as follows: �� "102. DAY CARE ACTIVITY SPACE shall mean an area or rooms used for children's activities including those separate from a group's classroom, excluding day care single use areas which include, but are not limited to, bathrooms, hallways, storage rooms, cooking areas of kitchens, and indoor swinming pools." B. That Section 12.A. relative to Definitions is hereby amended by the addition of a new Subsection 174 which shall read as follows: "174. GROSS LEASABLE AREA (GLA) shall mean the total floor area designed for the tenant's occupancy and exclusive use-including basements, mezzanines, or upper floors-expressed in square feet and measured fran the centerline of joint partitions and from outside wall faces. It is the space for which tenants pay rent, including sales areas and integral stock areas. Gross leasable area does not include public or co�ton areas such as public toilets, corridors, stairw�lls, elevators, machine and equi�xnent rooms, lobbies or enclosed mall � areas." C. That Section 12.A. relative to Definitions is hereby amended by the � addition of a new Subsection 305 which shall read as follows: ��.r "305. OCCUPANCY shall mean the purpose or activity for which a piece of land or its building, or part thereof is used or intended to be used." D. That Section 12.A. relative to Definitions is hereby amended by the addition of a new Subsection 426 which shall read as follows: "426. USE shall mean the purpose or activity for which a piece of land or its buildings is designed, arranged, or intended, or for which it is occupied or maintained." E. That Section 56.C. relative to Off-Street Parking Requirements is amended to read as attached in Exhibit "A". F. That Section 58.C. relative to Parking and Loading Area Development Standards shall read as amended: "C. Driveway Design and Placement Standards shall be in accordance with Chapter 20, Article III, of the City of Grapevine Code of Ordinances." G. That Section 58.M. relative to Parking and Loading Area Development Standards shall read as amended: � "M. Paving, marking, and signing shall be provided in accordance to the design requirements as set forth in the Manual on Uniform Traffic Control Devices." H. That Section 58. relative to Parking and Loading Area Development Standards is hereby amended by the addition of a new Subsection N which shall read as follows: "N. Kindergartens, day schools and similar child training and care establishments shall provide tw� (2) loading and unloading spaces on a private drive, off-street to accca�unodate two (2) motor vehicles for the first twenty (20) students or children, and one (1) for each additional twenty (20) students." Section 2. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a stun not to exceed 'Itao Thousand Dollars ($2,000.00) for each offense and a separ�te offense shall be deemed cornnitted upon each day during or on which a violation occurs or continues. Section 3. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereof to any person or circtnnstance, is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of the ordinance, and the City Council hereby declares it �uld have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 4. The fact that the present zoning ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safequard the health, safety, morals, peace, and general welfare of the public creates an emergency which requires that this ordinance shall became effective from and after the date of its pa.ssage, and it is accordingly so ordained.
