ORDINANCE NO. 87-46
AN ORDINANCE AMENDING THE CITY CODE OF THE
CITY OF GRAPEVINE, TEXAS BY AMENDING CHAPTER
25, ARTICLE III , RELATING TO SOLID WASTE
DISPOSAL BY AMENDING SECTION 25-94; PROVIDING
A PENALTY NOT TO EXCEED THE SUM OF ONE
�� THOUSAND DOLLARS (�1,000.00) AND A SEPARATE
OFFENSE SHALL BE DEEMED COMMITTED UPON EACH
DAY DURING OR ON WHICH A VIOLATION OCCURS;
PROVIDING A SEVERABILITY CLAUSE; PROVIDII�TG AN
�' EFFECTIVE DATE AND DECLARING AN EMERGENCY
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS:
Section 1. That Chapter 25, Article III of the City Code
of the City of Grapevine, Texas, relating to Solid Waste
Disposal is hereby amended in the following particulars and all
other existing Sections, Subsections, Paragraphs, Sentences,
Definitions, Phrases and Words of said City Code are not
amended, but shall remain intact and are hereby ratified,
verified and affirmed:
That Section 25-94 is amended to read as follows:
"In the event it is impracticable to collect
and remove the garbage or trash from the
alley, the owner, occupant, tenant or lessee
of the premises shall place the container,
such containers having no more than a thirty
(30) gallon capacity, at such point as the
� agent of the City shall find and designate
to be most accessible for collecting and
removing. In the event trash is of such a
�"� nature that it cannot be put in the
container, it shall be carefully placed in
bundles under fifty (50) pounds in weight so
it can be removed conveniently, and tree
limbs, trunks and hedge cuttings shall not
exceed five (5 ) feet in length. Containers
no more than thirty (30) gallons in capacity
shall be removed within twenty-four 24
hours after garbage has been collected and
shall not be placed in the required front
vard or right-of-way prior to twenty-four
(24) hours of the collection time.
Dumpsters shall not be placed in the
right-of-way or required front yard of any
premises. The City Manager may approve the
location of a dumpster in the required front
yard provided he finds there is no other
location on the lot suitable for storage and
access to the dumpster. All dumpsters
located within the City of Grapevine shall
conform to all requirements of this Section
�_-� within sixty 60 days of the adoption of
this Section. "
Section 2 . If any section, article, paragraph,
sentence, clause, phrase or word in this ordinance, or
application thereto any person or circumstance is held invalid
or unconstitutional by a Court of competent jurisdiction such
holding shall not affect the validity of the remaining portions
of the ordinance; and the City Council hereby declares it would
have passed such remaining portions of the ordinance despite
such invalidity, which remaining portions shall remain in full
force and effect .
Section 3 . Any person violating any of the provisions of
this ordinance shall be deemed guilty of a misdemeanor and upon
conviction thereof shall be fined in a sum not to exceed One
Thousand Dollars ($1 , 000. 00) and a separate offense shall be
deemed committed upon each day during or on which a violation
occurs or continues .
Section 4 . The fact that the present ordinances and
regulations of the City of Grapevine, Texas, are inadequate to
*� properly safeguard the health, safety, morals, peace and general
welfare of the inhabitants of the City of Grapevine, Texas,
creates an emergency for the immediate preservation of public
�,,, business, property, health, safety and general welfare of the
public which requires that this ordinance shall become effective
from and after the date of its passage and it is accordingly so
ordained.
