HomeMy WebLinkAboutORD 1987-040 ORDINANCE NO. 87-40 AN ORDINANCE AMENDING ORDINANCE NO. 82-73, THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS, SAME BEING ALSO KNOWN AS APPENDIX "D" OF THE CODE OF ORDINANCES OF THE CITY OF GRAPEVINE, TEXAS, BY PROVIDING FOR �* AMENDMENTS AND CHANGES TO ZONING REGU- LATIONS BY AMENDING SECTION 12 .A. 332 RELATIVE TO DEFINITIONS; BY AMENDING �,,, SECTION 24.F. 2, 3, & 4, SECTION 24.G. 4 & 5, AND SECTION 24 .N. 1, 2, 3, & 4 RELATIVE TO "CN" NEIGHBORHOOD COMMERCIAL ZONING DISTRICT; BY AMENDING SECTION 25.F. 3, SECTION 25 .G. 4 & 5, AND SECTION 25 .N. 1 , 2 , 3, & 4 RELATIVE TO "CC" COMMUNITY COMMERCIAL ZONING DISTRICT; BY AMENDING SECTION 26 .F. 3 AND SECTION 26.N. 1 , 2, 3, & 4 RELATIVE TO "HC" HIGHWAY COMMERCIAL ZONING DISTRICT; AND BY AMENDING SEC- TION 67.B. 5 RELATIVE TO AMENDMENTS; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF ONE THOUSAND DOLLARS ($1, 000 . 00) AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS : ;�;�� Section 1 . That Ordinance No. 82-73, the Comprehensive Zoning Ordinance of the City of Grapevine, Texas, same being also known as Appendix "D" of the Code of Ordinances of the City of Grapevine, Texas, is hereby amended in the following particulars, and all other sections, subsections , paragraphs, definitions, words and phrases of said Appendix "D" are not amended but are hereby ratified, verified, and affirmed: A. That Section 12 .A. 332 relative to Definitions shall read as follows : 332 . PLANNED COMMERCIAL CENTER shall mean a center consisting of one (1) or more lots having a total site area of a minimum of five (5) acres with a combination of permitted and conditional uses in the zoning district for which the zoning application is made. B. That Section 24 .F. 2, 3 , & 4 relative to "CN" Neighbor- � hood Commercial Zoning District shall read as follows : 2 . LOT SIZE: The minimum lot size in a "CN" Neighbor- hood Zoning District shall be twenty thousand �rr (20, 000) square feet. 3 . MINIMUM OPEN SPACE: At least twenty (20) percent of the total lot area shall be devoted to nonvehicular open space. (Nonvehicular open space is any area not devoted to buildings, parking, loading, storage, or vehicular use. ) Planned Commercial Centers permitted as a conditional use shall meet the requirements of Section 24 .N. 3 . 4 . DISTRICT SIZE: The minimum size of any "CN" Neighborhood Commercial Zoning Distirct shall be one (1) acre and the maximum size of any "CN" Neighbor- hood Zoning District shall not exceed twelve (12) acres. C. That Section 24 .G. 4 & 5 relative to "CN" Neighborhood Commercial Zoning District shall read as follows : 4 . SIDE YARDS: Ever� lot shall have two side yards, each of which shall be not less than ten (10) feet it width. Planned Commercial Centers permitted as a conditional use shall meet the requirements of Section 24.N. 1 . 5. REAR YARD: Every lot shall have a rear yard of not less than twenty-five (25) feet in depth. Planned Commercial Centers permitted as a conditional use shall meet the requirements of Section 24 .N. 1 . D. That Section 24 .N. 1 , 2, 3 , & 4 relative to "CN" Neighborhood Commercial Zoning District shall read as follows : N. PLANNED COMMERCIAL CENTER DESIGN REQUIREMENTS: Each lot or parcel of land created within a Planned Commercial Center shall comply with the following requirements : l . MINIMUM YARD REQUIREMENTS OF PLANNED COMMERCIAL CENTERS: The front yard requirements contained in Section 24.G. 3 shall be applicable to each "` " lot or parcel of land within a Planned Commercial Center. A minimum ten (10) foot side �.� and a minimum twenty-five (25) foot rear yard shall be required around the outside perimeter of the Planned Commercial Center. Minimum side and rear yard requirements of interior lots may be required if deemed necessary by City Council in order to meet the provisions of Section 48. 2 . LANDSCAPING REQUIREMENTS OF PLANNED COMMERCIAL CENTERS: The minimum landscaping requirements of Section 53 .H. 2 (b) shall be applicable around the outside perimeter of a Planned Commercial Center. For interior lots the minimum landscaping requirements of Section 53 .H. 2 (b) may be required if deemed necessary by City Council in order to meet the provisions of Section 48 . 3 . MINIMUM OPEN SPACE REQUIREMENTS OF PLANNED COMMERCIAL CENTERS: At least twenty (20) percent of the total site area of the Planned Commercial Center shall be devoted to nonvehicular open space. (Nonvehicular open space is any area not devoted to buildings, parking, loading, storage, or vehicular. ) +�r 4 . BUILDINGS ELEVATIONS OF PROPOSED STRUCTURES SHALL BE SUBMITTED WITH THE SITE PLAN REQUIRED BY SECTION 48.D. 7. E. That Section 25 .F. 3 relative to "CC" Community Commercial Zoning District shall read as follows: 3 . (Nonvehicular open space is any area not devoted to buildings, parking, loading, storage, or vehicular use. ) Planned Commercial Centers permitted as a conditional use shall meet the requirements of Section 25.N. 3 . Planned Commercial Centers permitted as a conditional use shall meet the requirements of Section 25 .N. 1 . G. That Section 25 .N. 1 , 2, 3 , & 4 relative to "CC" Community Commercial Zoning District shall read as follows: N. PLANNED COMMERCIAL CENTER DESIGN REQUIREMENTS : Each lot or parcel of land created within a Planned Commercial Center shall comply with the following requirements : 1 . MINIMUM YARD REQUIREMENTS OF PLANNED COMMERCIAL CENTERS: The front yard requirements contained in Section 25 .G. 3 shall be applicable to each lot or parcel of land within a Planned '�``"� Commercial Center. A minimum twenty (20) foot side and a minimum twenty-five (25) foot rear „� yard shall be required around the outside perimeter of a Planned Commercial Center. Minimum side and rear yard requirements of interior lots may be required if deemed necessary by City Council in order to meet the provisions of Section 48 . 2. That Section 26 .F. 3 relative "HC" Highway Commercial Zoning District shall read as follows: 3. Planned Commercial Centers permitted as a conditional use shall meet the requirements of Section 26 .N. 3. I. That Section 26 .N. 1, 2, 3 , & 4 relative to "HC" Highway Commercial Zoning District shall read as follows : N. PLANNED COMMERCIAL CENTER DESIGN REQUIREMENTS: Each lot or parcel of land created within a Planned � Commercial Center shall comply with the following requirements : 1 . MINIMUM YARD REQUIREMENTS OF PLANNED COMMERCIAL CENTERS: The front yard requirements contained in Section 26 .G. 3 shall be applicable to each lot or parcel of land within a Planned Commercial Center permitted. The minimum side and minimum rear yards as required in Section 26 .G. 4 and 26 .G. 5 shall be required around the outside perimeter of a Planned Commercial Center. Minimum side and rear yard requirements of interior lots may be required if deemed necessary by City Council in order to meet the provisions of Section 48 . 2 . BUILDING ELEVATIONS OF PROPOSED STRUCTURES SHALL BE SUBMITTED WITH THE SITE PLAN REQUIRED BY SECTION 48 .D. 7. J. That Section 67.B. 5 relative to Amendments shall read as follows : 5. Changes to any aspect of a zoning case or conditiona use application, including changes to concept plans or site plans, that the City Council or Planning and Zoning Commission consider, in their sole judgement, to be significant that are proposed by the applicant shall not be considered unless filed with the City at least fourteen (14) days prior to the scheduled '"'�"" public hearing. In the event such a proposed change is filed less than fourteen (14) days prior to the scheduled public hearing, the Planning and Zoning �ww Commission or City Council may decline to consider the proposed changes or may continue the public hearing to a date certain that is at least fourteen (14) days from the date said proposed change was filed. This section does not apply to any changes proposed by the Planning and Zoning Commission or City Council. Section 2 . Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed One Thousand Dollars ($1, 000. 00) for each offense and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 3 . If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; �,,, and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 4 . The fact that the present ordinances and regu- lations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace, and general welfare of the public creates an emergency which requires that this ordinance become effective from and after the date of its passage, and it is accordingly so ordained.
