HomeMy WebLinkAboutORD 1987-062 ORDINANCE NO. 87-62 AN ORDINANCE AMENDING THE CITY CODE OF THE CITY OF GRAPEVINE, TEXAS, BY AMENDING APPENDIX E, CONSTRUCTION STANDARDS, ARTICLE II, ITEM 7. 3 RELATIVE TO SHORING AND SHEATHING AND APPENDIX E, CON- STRUCTION STANDARDS, ARTICLE III, �""" ITEM 2. 3 RELATIVE TO SHEETING AND BRACING; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ;� ($200. 00) AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY .OF GRAPEVINE, TEXAS : Section 1 . That the Grapevine City Code be, and the same is, hereby amended by amending Appendix E, Construction Standards, Article II, Item 7. 3 relative to Shoring and Sheathing by the addition of the following paragraph: All trenches that are required to be excavated to a depth in excess of five (5) feet shall be excavated and maintained in a manner that meets all Occupational Safety and Health Administration Standards . The contractor shall provide the City, prior to excavation and construction of the trench (es) , with detailed plans and specifications for ��` record, certified by a Registered Professional Engineer, that provide for adequate safety systems that meet the Occupational Safety and Health Administration Standards . The detailed plans and specifications shall include requirements for a safety program for the trench system. Section 2 . That the Grapevine City Code be, and the same is, hereby amended by amending Appendix E, Construction Standards, Article III , Item 2. 3 relative to Sheeting and Bracing by the addition of the following paragraph: All trenches that are required to be excavated to a depth in excess of five (5) feet shall be excavated and maintained in a manner that meets all Occupational Safety and Health Administration Standards . Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Hundred Dollars ($200 .00) for each offense and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section 4. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 5.
