AN ORDINANCE AMENDING THE CITY CODE OF
THE CITY OF GRAPEVINE, TEXAS, BY
AMENDING APPENDIX E, ARTICLE II,
STANDARD SPECIFICATIONS FOR CON-
STRUCTION--STREETS AND DRAINAGE,
ITEM 1 . 6 RELATIVE TO GUARANTEE AND BY

I BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE,
TEXAS :

�; Section 1 . That the Grapevine City Code be, and the same
j is, hereby amended by amending Appendix E, Article II , Standard
iSpecifications for Construction--Streets and Drainage, Item 1 . 6
relative to Guarantee shall read as follows:
! 1 . 6 . Guarantee: The contractor shall guarantee the work
for a period of two (2) years after the date of
acceptance by the City. During this two (2) year
period, the contractor shall make any repairs and/or
replacement of defective materials and corrections due

compliance with the specifications . This guarantee
�i shall apply to all matters reported by the City in
writing within said two (2) year period and this
�I guarantee shall be backed by the issuance of a
maintenance bond. Said maintenance bond shall be
issued by a surety licensed to operate within the
State of Texas, shall be for a time period of two (2)

ears from the date of acceptance by the City, and
shall be in an amount equal to one hundred percent
(100�) of the cost of construction of the work being
guaranteed.
I Section 2 . That the Grapevine City Code be, and the same
is, hereby amended by amending Appendix E, Article III, Standard
; Specifications for Construction--Water Distribution System and
i Sanitary Sewer System, Item 1 . 6 relative to Guarantee shall read
i as follows:

compliance with the specifications. This guarantee

Section 3. Any person violating any of the provisions of
this ordinance shall be deemed guilty of a misdemeanor and upon
conviction thereof shall be fined in a sum not to exceed Two
Hundred ( $200. 00) for each offense and a separate offense shall
be deemed committed upon each day during or on which a violation
occurs or continues.
Section 4. If any section, article, paragraph, sentence, �,
�,:-..{ clause, phrase or word in this ordinance, or application thereof
to any person or circumstance, is held invalid or �
unconstitutional by a Court of competent jurisdiction, such
holding shall not affect the validity of the remaining portions
of the ordinance, and the City Council hereby declares it would
have passed such remaining of the ordinance despite such
invalidity, which remaining portions shall remain in full force
and effect.
Section 5 . The fact that the present ordinances and
' regulations of the City of Grapevine, Texas, are inadequate to
� properly safeguard the health, safety, morals, peace, and general
; welfare of the inhabitants of the City of Grapevine, Texas,
creates an emergency for the immediate preservation of public
business, property, health, safety, and general welfare of the
'� public which requires that this ordinance shall become effective
from and after the date of its passage and it is accordingly so
ordained.
