HomeMy WebLinkAboutORD 1987-067 CITY OF GRAPEVINE, TEXAS ORDINANCE NO. 87-67 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AMENDING ARTICLE III OF APPENDIX E TO THE CODE OF ORDINANCES, CITY OF GRAPEVINE, TEXAS, TO PROVIDE CONSTRUCTION STANDARDS FOR INSTALLATION OF IRRIGATION „�:�„ SYSTEMS IN SUBDIVISION RIGHTS-OF-WAY; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS (�200.00) FOR EACH OFFENSE AND A SEPARATE OFFENSE SHALL BE '�"`' DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Article 1175 of Vernon' s Annotated Texas Civil Statutes ( "V.A.T.C.S. " ) empowers home rule cities with full power local self-government; and WHEREAS, home rule cities are further empowered by law to promulgate and establish the general plan of their cities and the streets, alleys, public utility facilities, rights-of-way, including those which have been or may be laid out, together with the general plan for the extension of such cities and of the roads, streets and public highways within said cities and within the extraterritorial limits established from the corporate limits thereof; and WHEREAS, Article 8751 V.A.T.C.S. established certain regulations for irrigators within the state of Texas, specifically examination and registration requirements as set � forth in Section 8 thereof, which require all persons desiring to act as irrigators or installers to pass a uniform, reasonable examination and upon the successful completion �` ' thereof to receive a valid certificate of registration; and WHEREAS, Section 14 of Article 8751 V.A.T.C.S. further requires licensed irrigators or licensed installers to comply with any reasonable inspection requirements or ordinances and regulations designed by any regulatory authority of any city, town, county, special purpose district, or other political subdivision of the State, to protect the public water supply, and to pay any reasonable fees imposed by such local entities relating to work performed by licensed irrigators within their jurisdictions; and WHEREAS, the City of Grapevine, Texas (hereinafter referred to the "City" ) is a home rule city vested with the powers and authority hereinbefore set forth; and WHEREAS, in furtherance of the authority granted to the City by State law to provide for the general plan and development of its City, the City Council of the City passed and approved Ordinance No. 83-40 on July 19, 1983, known as the "Subdivision Ordinance of the City, the provisions of which r� are set forth as Appendix B to the Code of Ordinances of the City; and �,, WHEREAS, on November 16, 1982, the City Council of the City adopted Ordinance No. 82-75 , which established certain construction standards to implement the provisions of the Subdivision Ordinance and provided for the orderly, safe, healthy and uniform development of the area within the corporate City limits and within the area surrounding the City, the provisions of which are set forth as Appendix E to the Code of Ordinances of the City; and I, � WHEREAS, the City Council of the City deems it necessary � and expedient to amend Article III of Appendix E to the Code of Ordinances of the City to provide construction standards, to be { utilized by developers of subdivisions within the City, for the installation of irrigation systems in rights-of-way. ' j NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: ' , 1 Section 1 . That all of the above premises are found ' and determined to be true and correct and are incorporated into I „,, the body of this Ordinance as if copied in their entirety. ', Section 2. That Article III of Appendix E to the Code of Ordinances of the City of Grapevine, Texas, is hereby 1 amended in the following particulars by adding thereto Item 21 , entitled, "Construction Standards for Installation of Irrigation Systems in Subdivision Rights-of-Way, " which item � shall hereafter read as follows: ' "Item 21 . Construction Standards for Installation of Irrigation Systems in Subdivision Rights-of-Way Developers of subdivision shall be required to install irrigation systems in rights-of-way which satisfy the following criteria: l . All sprinkler heads and related equipment must be Toro automatic electric, or a City approved equal; 2 . The double check valv e must be FEBCO, or a City approv ed equal and placed in a vault box approv ed by the City; 3 . The plans will be checked as to '; locations of the water meter , double check valve, electrical � connections , control box and � line locations ; 4 . Mueller Gate Valves, or a City ' approved equal must be used; � 5 . All PVC pipe shall be class 200 for lines , and schedule 40 for fittings ; and �I 6 . Any materials and/or parts not specified shall meet the � requirements of the Grapevine fPlumbing Code. 'i � �'�'�'� All persons intending to install irrigation systems must be a licensed �'! irrigator or licensed installer as �,,; regulated by Article 8751 V.A.T.C.S. , � the "Regulation of Irrigators Act . " i ' All approvals under this Item 21 shall be made by the Director of Parks and Recreation or his or her duly authorized designee. " All other items, sentences, words and phrases of Article III of Appendix E to the Code of Ordinances, City of Grapevine, Texas , are not amended , but are hereby ratified, verified, approv ed and affirmed. 2 Section 3 . Any person violating any of the provisions of this Or inance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be subject to a fine in a sum not to exceed Two Hundred Dollars (�200.00 ) for each offense and a separate offense shall be deemed committed upon each day during or on which a violation occurs. Section 4. If any section, article, paragraph, sentence, clause, phrase or word in this Ordinance, or application thereto any person or circumstances is held invalid �''''' or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this Ordinance; and the City Council hereby declares it ,,,� would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 5 . The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety, and general welfare of the public which requires that this Ordinance become effective from and after the date of its passage and it is accordingly so ordained.
