HomeMy WebLinkAboutORD 1985-073 CITY OF GRAPEVINE, TEXAS ORDINANCE NO. 85-73 AN ORDINANCE APPROVING, ADOPTING AND RATIFYING THE REPORT OR STATEMENT OF THE DIRECT�fi, OF PUBLIC WORKS OF THE CITY OF GRAPEVINE, TEXAS, OF THE TOTAL COST OF PAVING AND IMPROVEMENT OF PORTIONS OF A CERTAIN STREET IN THE CITY OF GRAPEVINE, TARRANT COUNTY, TEXAS, TO WIT: TIMBERLINE DRNE FROM THE WEST KIGHT-OF-WAY LINE OF STATE HIGHWAY 121 (WILLIAM ,,,��_�, D. TATE AVENUE) NORTHWEST TO THE SOUTH RIGHT-OF-WAY LINE OF MUSTANG DRIVE; DETERMINING THE COST OF SUCH IMPROVEMENTS AND THE AMOUNTS PER FRONT FOOT PRO- POSED TO BE ASSESSED AGAINST OWNERS OF ABUTTING �""` PROPERTY; ORDEKING AND SETTING A HEARING AT 7:30 O'CLOCK P.M. ON THE 7TH DAY OF JANUARY, 1986, IN THE CITY COUNCIL ROOM, CITY HALL, 413 MAIN STREET, GRAPE- VINE, TEXAS, AS THE TIME AND PLACE FOR A PUBLIC HEARING OF THE REAL AND TRUE OWNERS OF THE PRO- PERTY ABUTTING UPON SAID STREET AND CONCERNING SAID ASSESSMENTS, PROCEEDINGS AND IMPROVEMEWNTS; DIREC- TING THE CITY SECRETARY TO GIVE NOTICE OF SAID HEARING AS REQUIRED BY LAW; AND DECLARING AN EMER- GENCY WHEREAS, the City Council of the City of Grapevine, Texas, has heretofore ordered that the hereinafter described portion of Timberline Drive in the City of Grapevine, Texas, be improved; and WHEREAS, the Director of Public Works of the City of Grapevine, TExas, has prepared and filed with the City Council the total cost of such improvements as determined by the existing construction contract and estimates of the amounts per front foot proposed to be assessed against the abutting property and the owners thereof; and �"""� WHEREAS, the City Council has heretofore determined the necessity of levying an assessment against the property and the owners thereof abutting upon !� the herinafter described street. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That the report or statement filed on or before July 5, 1983, with the City Council by the Director of Public Works of the City of Grapevine, Texas, of the total cost of such improvements as determined by the existing construction contract and the amounts per front foot proposed to be assessed against the abutting property and the owners thereof having been duly examined are hereby approved and adopted. Section 2. That it is hereby found and determined that the costs of improvements of the hereinafter described street with the amounts per front foot proposed to be assessed for such improvements against abutting property and the owners thereof, as shown on Exhibit A attached hereto, are as follows, to wit: CURBS AND GUTTERS BALANCE OF TOTAL STREET TO BE ASSESSED IMPROVEMENTS COST Timberline Drive $75,526.60 $1,123,470.03 $1,198,996.63 �� , It is proposed that the owners of abutting property be assessed as follows: ir,� Curb and gutter $5.70 per front foot Amount of cost to be assessed against abutting property owners $75,526.60 Amount of cost to be paid by the City of Grapevine, Texas $1,123,470.03 Section 3. That a hearin� shall be given to said owners of abutting property and all persons interested in said matter as to the benef'its to said property by reason of said improvements, or any other matter or thing in conriection therewith, which hearing shall be held before the City Council of the City of Grapevine, Texas, in the City Council Room, City Hall, 413 Main Street, Grapevine, Texas, at 7:30 p.m., on the 7th day of January, 1986, at which time all of said owners, their agents or attorneys or other interested persons are notified to appear and be heard, and said hearing shall be adjourned from day to day until fully accomplished. Such hearing to be held pursuant to Article 1105b, as amended, of Vernon's Texas Civil Statutes. ''�`" Section 4. The City Secretary of the City of Grapevine, Texas is hereby directed to give notice of the time and place of such hearing and of other matters and facts in accordance with ther terms and provisions of Article 1105b, ��� a� amended, of Vernon's Texas Civil Statutes. Section 5. The fact that the streets and portions thereof to be improved as herein provided are in need of being improved without delay creates an urgency and emergency for the immediate preservation of the public peace, health and safety which requires that this Ordinance be passed as an emergency measure and that this Ordinance take effect from and after its passage, and it is accordingly so ordered and ordained.
