HomeMy WebLinkAboutORD 1985-077 CITY OF GRAPEVINE, TEXAS OKDINANCE NCS. 85-77 AN ORDINANCE APPROVING, ADOPTING AND R.ATIFYING THE REPORT OR STATEMENT OF THE DIRECTOR OF PUBLIC WORKS OF THE CITY OF GRAPEVINE, TEXAS, OF THE TOTAL COST OF PAVING AND IMPROVEMENT OF PORTIONS OF A CERTAIN STREET IN THE CITY OF GRAPEVINE, TEXAS, TO WIT: DOVE LOOP ROAD NORTH FROM THE SOUTH PROPERTY LINE ,���� OF DOVE CROSSING SUBDIVISION TO THE SOUTH PROPERTY LINE OF THE UNITED STATES ARMY COHPS UF ENGINEE�.S PROPERTY; DETERMINING THE COST OF SUCH IMPR,OVE- MENTS AND THE AMOUNTS PER FRONT FOOT PROPOSED TO BE ASSESSED AGAINST OWNERS OF ABUTTING PROPERTY; ORDERING AND SETTING A HEARING AT 7:30 O'CLOCK P.M. ON THE 7TH DAY OF JANUARY, 1986, IN THE CITY COUNCIL ROOM, CITY HALL, 413 MAIN STREET, GRAPEVINE, TEXAS, AS THE TIME AND PLACE FOR A PUBLIC HEARING OF THE REAL AND TRUE OWNERS OF THE PROPERTY ABUTTING UPON SAID STREET AND CONCERNING SAID ASSESSMENTS, PROCEEDINGS AND IMPROVEMENTS; DIRECTING THE CITY SECRETARY TO GIVE NOTICE OF SAID HEARING AS REQUIRED BY LAW; AND DECLARING AN EMERGENCY WHEREAS, the City Council of the City of Grapevine, Texas, has heretofore ordered that the hereinafter described portion of Dove Loop Road in the City of Grapevine, Texas, be improved; and WHEREAS, the Director of Public Works of the City of Grapevine, Texas, has prepared and filed with the City Council the total cost of such improvements as determined by the existing construction contract and estimates of the amounts per front foot proposed to be assessed agains� the abutting property and the owners thereof; and �'� WHEREAS, the City Council has heretofore determined the necessity of levying an assessment against the property and the owners thereof abutting upon the herinafter described street. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That the report or statement filed on or before April 2, 1985, with the City Council by the Director of Public Works of the City of Grapevine, Texas, of the total cost of such improvement as determined by the existing construction contract is hereby approved, adopted and ratified and the amounts per front foot proposed to be assessed against the abutting property and the owners thereof having been duly examined are hereby approved and adopted. Section 2. That it is hereby found and determined that the total cost of improvements of the hereinafter described street with the amounts per front foot proposed to be assessed for such improvements against abutting property and the owners thereof, as shown on Exhibit A attached hereto, are as follows, to wit: CURBS AND BALANCE TOTAL GUTTERS TO OF IMPROVE- ACTUAL STREET BE ASSESSED MENTS COST "°`�� Dove Loop Road $18,601.6? $392,956.28 $411,557.95 It is proposed that the owners of abutting property to be assessed as follows: Curb and �utter $6.55 per front foot Amount of cost to be assessed a�;ainst abutting property owners $18,601.67 Amount of cost paid by the City of Grapevine, Texas $284,307.66 Amount of cost paid by others $108,648.62 Section 3. That a hearing shall be given to said owners of abutting property and all persons interested in said matter as to the benefits to said property by reason of said improvements, or any other matter or thing in connection therewith, which hearing shall be held before the City Council of the City of Grapevine, Texas, in the City Council Room, 413 Main Street, Grapevine, Texas, at 7:30 p.m., on the 7th day of January, 1986, at which time all of said owners, their agents or attorneys or other interested persons are notified to appear and be heard, and said hearing shall be adjourned from day �..,, to day until fully accomplished. Said hearing is to be held in accordance with the terms and provisions of Article 1105b, as amended, of Vernon's Texas Civil Statutes. '�"'� Section 4. The City Secretary of the City of Grapevine, Texas is hereby directed to give notice of the time and place of such hearing and of other matters and facts in accordance with the terms and provisions of Article 1105b, as amended, of Vernon's Texas Civil Statutes by advertisement inserted at least three (3) times in some newspaper published in the City where such special assessment tax is to be imposed, the first publication of such notice of hearing to be made at least twenty-one (21) days before the date of the hearing, and additional written notice of the hearing shall be given by mail at least fourteen (14) days before the date of the hearing to each of the abutting property owners and railways, if any, pursuant to Article 1105b, as amended, of Vernon's Texas Civil Statutes. Section 5. The fact that the streets and portions thereof improved as herein provided were in need of being improved without delay created an emergency and public necessity for the immediate preservation of the public peace, health and safety which requires that this Ordinance be passed as an emergency measure and that this Ordinance shall take effect from and after its passage, and it is accordingly so ordered and ordained.
