HomeMy WebLinkAboutORD 1985-044 CITY OF GRAPEVINE, TEXAS ORDINANCE NO. 85-44 AN ORDINANCE OF THE CITY OF GRAPEVINE, TEXAS A- MENDING CHAPTER 18 OF THE CODE OF ORDINANCES RE- LATING TO PERSONNEL BY ADDING SUBSECTION (C) RE- LATING TO THE WORK PERIOD FOR FIREMEN TO SECTION 18- 143; ADOPTING A TWENTY-SEVEN (27) DAY WORK PERIOD FOR FIREMEN FROM AND AFTER SEPTEMBER 24, 1985; PROVIDING FOR OVERTIME PAY IN ACCORDANCE WITH THE RULES AND "'�'"�° REGULATIONS OF THE DEPARTMENT OF LABOR; PROVIDING A SEVERABILITY CLAUSE; DECLARING AN EMERGENCY AND PROVIDING AN EFFECTNE DATE. � NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That Chapter 18 of the Code of Ordinances of the City relating to Personnel is hereby amended in the following particulars, and that no other existing sections, subsections, articles, paragraphs, sentences, phrases or words shall be amended but shall be and are hereby ratified, verified, approved and af f irmed: A. That a new Subsection (c) shall be added to Section 18-143 of Chapter 18 of the Code of Ordinances, to read as follows: "Sec. 18-143 (c). All firemen of the City of Grapevine shall be on a twenty-seven (27) day work period from and after September 24, 1985. Said work period and schedule shall be established by the City Fire Chief. Any hours worked by a fireman in excess of 204 hours during the said twenty-seven (27) day work period shall be considered overtime, for which hour or hours a fireman shall receive compensation at the rate of one and one-half his re�ular rate of pay." � Section 2. That City firemen shall receive overtime pay in accordance ' with the rules and regulations of the United States Department of Labor. Section 3. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstance, is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full force and effect. Section 4. The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace, and general walfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance become effective from and after the date of its passage and it is accordingly so ordained.
