AN GRDINANCE ANNEXING ADJACENT AND CONTIGUOt1S TERRITORY TO THE CITY OF GRAPEVINE, TEXAS; FINDING THAT ALL NECESSARY AND REQUIRED LEGAL CONDITIONS HAVE BEEN SATISFIED; PROVIDING THAT SUCH AREAS SHALL BE BECOME A PART OF THE CITY �°- AND THAT THE OWNERS AND INHABITANTS THEREOF SHALL BE ENTITLED TO THE RIGHTS AND PRIVILEGES OF OTHER CITIZENS AND BE � BOUND BY THE ACTS AND ORDINANCES NOW IN EFFECT AND SO BE HEREAFTER ADOPTED; AND FURTHER PROVIDING FOR AMENDING AND CORRECTING THE OFFICIAL BOUNDARIES OF THE CITY AS HERETOFORE ADOPTED AND PROVIDING FOR THE ORDINANCE TO GO INTO EFFECT UPON PASSAGE OF THE ORDINANCE CN SECOND READING; AND PROVIDING A SEVER- ABILITY CI,AUSE WHEREAS, the City, pursuant to the Municipal Annexation Act, Art. 970A Tex. Rev. Civ. Stat. Ann. , has heretofore instituted annexation proceedings on the tract described in Exhibit "A" ; and WHEREAS, in accordance with the Municipal Annexation Act a service plan was prepared by an appropriate department of the City, which plan was made available for inspection and explained to the inhabitants of the area to be annexed (of which there are none) at the public hearings conducted as hereinafter described; and �"` ' WHEREAS, all required statutory notices pursuant to the Act have been accomplished; and �� WHEREAS, public hearings were conducted at the Grapevine Concour.se on August 13 , 1985 and in Grapevine City Hall Council Chambers on August 20, 1985, which public hearings were conducted after notices had been published in a newspaper of general circulation in the City and in the areas proposed to be annexed not more than 20 days nor less than 10 days prior to each hearing; and WHEREAS , the property to be anr.exed is contiguous and adjacent to the City limits of the City of Grapevine and not within the boundaries of another city. NOW, THEREFORE, BE IT ORDAINED BY THF CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS : Section 1 . That all of the above premises are found to be true and correct and are incorporated into the body of this ordinance as if copied in their entirety. ^�� `' Section 2 . The service plan submitted in accordance with the Municipal Annexation Act is hereby approved as part of this Ordinance, made a part hereof and attached hereto as Exhibit "B" . Section 3 . That the property described in Exhibit "A" , which exhibit is attached hereto and incorporated herein for all purposes, be and is hereby ar�nexed and brought within the corporate limits of the City of Grapevine, Tarrant County, Texas, and same is hereby made an integral part hereof. Section 4 . That the owners and inhabitants of the area herein annexed be entitled to all of the rights and privileges of other citizens and property owners of said City and are hereby ��o� 833'7 PAc�21.39 , r" ��1 y"' V J. ��.�?�r�i,�'�:.� ��'.J� bound by all acts, ordinances, and all other legal action now in full force and effect and all those which may be hereafter adopt.ed. Section 5 . That the official map and boundaries of the City of Grapevine, Texas heretofore adopted and amended be and are hereby amended so as to include the aforementioned territory as part of the City of Grapevine. �_- Section 6 . That this ordinance shall take effect immedi- ately upon second and final reading. � Section 7 . If any section, subsection, sentence , phrase, or word be found to be illegal, invalid, unconstitutional or if any portion of said property is incapable of bEing annexed by the City of Grapevine, Texas for any reason whatsoever, the adjudication shall not affect any other section, sentence, phrase, word, paragraph, or provision of this ordinance or the application of any other section, sentence, phrase, word, paragraph, or provision to any other person, situation, or circumstances , nor shall such adjudication affect any other section, sentence, phrase, word, paragraph, or provision of the Grapevine City Code . The City Council declares that it would have adopted the valid portions and applications of this ordinance and would have annexed the valid properties without the invalid part, and to this end the provisions of this ordinance are aeclared to be severable. Because of the City's garticipation in a fire protection agree.n�nt with Tarrant County, this ur�incorporated area is already receiving fire protection from the City of Grapevine. No additional personnel or equipment are anticipated to be required as a result of the annexation. SOLID 4�STE COI.LDC.'TICJ�T: Solid Waste Collection service in the City of Grapevine is presently being provided by ,G.S.X. Services fornierly S.C.A. Services of Fort Worth. It is anticipa�ed that this service will be provided by the private sector via service contracts for the foreseeable future, because the City cannot qualify for a landfill permit in the vicinity of the Dallas-Fort Worth Airpc�t. This contract does not � specifically address the expansion of the City Limits. Hawever, it is � � `'�` aur intexpretation that the present contract would require G.S.X. r; ,� ; Services to provide service to any potential custaners acquired by `, expansion of the City Limit Boundary.
