HERRING SURVEY, ABSTRACT NO. 663 IN THE CITY OF GRAPEVINE, TEXAS , AS HEREINAFTER DESCRIBED; PROVIDING A SEVERABILITY CLAUSE� AND DECLARING AN EMERGENCY �,,, WHEREAS, the owner of a tract of land located in the W. P. Herring Survey, Abstract No. 663 , in the City of Grapevine, Texas, has requested that a sanitary sewer easement, as herein- � after described, be abandoned and vacated; and WHEREAS , the sanitary sewer easement, as hereinafter described, is not needed for public use and will not be needed in the future for public use; and WHEREAS , abandoning and vacating the sanitary sewer easement will relieve the City of Grapevine, Texas from the cost and expense of maintaining said property. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1 . That the City of Grapevine sanitary sewer easement as recorded in Volume 6307, Pages 934-937 of the Tarrant County Deed Records, and as shown in Exhibit "A" , attached hereto and made a part hereof, is hereby abandoned and vacated for °'"� public use and the same is hereby abandoned and vacated insofar as all public right, title, and interest in and to said described �, portion of said sanitary sewer easement is concerned. Section 2. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of any section, subsection, word, sentence, or phase shall be held to be invalid, it shall not affect the remaining part of this ordinance. Section 3 . The fact that the said sanitary sewer easement is no longer needed by the public for public usage and would create a hardship or burden upon the City of Grapevine to keep open and maintain such sanitary sewer easement creates an urgency and an emergency for the immediate preservation of the public health, safety, and general welfare, which requires that this ordinance shal.l take effect immediately from and after its passage, and it is accordingly so ordained. Herring Survey, Abstract No. 663 , in the City of Grapevine, Tarrant County, Texas, said permanent easement across said tract being ten (10 ' ) feet in width with the center line being more parti- cularly described as follows: BEGINNING at a point in west line of said tract that bears north from the southwest corner of said tract a dis- tance of 232 . 3 feet; THENCE north 37 degrees 45 minutes east a distance of 90 . 7 feet, more or less; THENCE north 63 degr�es 16 minutes east a distance of 271 . 0 feet; THENCE south 47 degrees 27 minutes east a distance of 182. 1 feet; THENCE north 33 degrees 03 minutes 36 seconds east a distance of 227 . �3 feet; �,., . THENCE north 54 degrees 20 minutes east a distance of 258 . 3 feet; THENCE north 64 degrees 58 minutes east a distance of 212. 3 feet, more or less, to the east line of said tract; Said permanent easement being ten feet in width and 1242 . 3 feet in l.ength as measured along center line de- scribed above, and as recorded in Volume 6307, Pages 934-937, Tarrant County Deed Records.
