That Chapter 7, Article VIII of the Code of Ordinances of the City of Grapevine, Texas is hereby amended to read as follaws: ARTICLE VIII PLUMBING CODE Sec. 7-170. Short Title This Article shall be known as the "Grapevine Pl�nbing Code" and is to be cited as such. Sec. 7-171. Pltm�bing Code Adopted. (a) There is hereby adopted by the City of Grapevine, Texas, the "Uniform Pltm�bing Code", 1982 Edition with the exception of such sections thereof as are in hereinafter deleted, modified or amended and the same is hereby adopted and incorporated herein as if the same was copied in full herein, and the provisions thereof shall be the building regulations within the corporate limits of tYie City of Grapevine, Texas. (b) A copy of the "Uniform Plumbing Code° 1982 Edition shall be maintained by the Office of the City Secretary. Sec. 7-172, Registration and Licensing Sec. 7-172.1 (a) It shall be unlawful for any person, firm or corporation who is not registered by the City as a pltmibing contractor to secure pezmits as provided herein. Each plumbing contractor shall register with the City at the begi.nning of each year or prior to doing plumbing work within the City in any current year. The pltunbing contractor shall furnish the n� or names of persons who are authorized to sign permit applications. (b) Each applicant for registration as a pl�nbing contractor shall have an established place of business or shop for which a Certificate of Occupancy has been secured from the City of Grapevine if such business is located in the City of Grapevine. Such Certificate of Occupancy shall be displayed in his place of business. Sec. 7-172.2. Method of Registration of Pltm�bing Contractor (a) To register with the City of Grapevine as a Plimibing contractor, application shall be made in writing on forms furnished for the purpose and filed with the Pllunbing Inspector. The application shall show the plLunbing contractor's name, local address and telephone ntunber, and such other information as may reasonably be required to properly identify the pltmibing contractor. (b) It shall be unlawful for any person, firm, or corporation to represent himself or themselves as a registered and licensed pltunber, or to use falsely the words "Pltunbing Contractor", "Master Pltmiber" , "Journeyman Plumber", or Pltm�ber, or words of similar impor.t or meaning, on signs, cards, stationezy, or by any other misleading manner whatsoever within the City, unless said person, finn or corporation is, in fact, registered and holds a valid license within the �aning of the words used and as provided in this code. Sec. 7-172.3. Supervision (a) The actual work of installing, maintaining, altering or repairing of plumbing for which a permit is required by this code shall have super- vision by a licensed Master Pl�r as provided by the Texas Plumbing Licensing Law and this Code. The c�wner of a plumbing contracting business who is not a licensed Master Pltin�nber shall have constantly in his employ a licensed Master P1Lunber. Such Master Plumber shall be designated by the c�mer of such place of business to the Pltunbing Inspector as the person responsible for, and supervising, the plumbing work done by such plumbing contractor. Such designated Master Plumber shall be the supervisozy pltunber of only one plumbi.ng contractor within the City at any one time. Should such supervision not be constantly provided, the Building Official may order the work being done by such Pl�nbing Contractor to be discon- tinued until proper supervision and control has been provided and the name of the new Master Plumber disclosed to the Building Official. Sec. 7-172.4. License Required (a) It shall be unlawful for any person who is not licensed as a pltunber in accordance with the provisions of the laws of the State of Texas to install pltunbing work or supervise pli�nbing as defined herein. (b) Nothing herein shall be construed as prohibiting the e�loyment of a Journeymari Pl��ber to engage in, and work at the actual installation, alteration, repairing and renovating of plumbing, or the e�loyment of a pl�unbers apprentice who, as his principal occupation, is engaged in the learning and assisting in the insta�lation of plumbing, or the employment of unskilled laborers to handle, haul or carzy materials when working under the i�diate supervision of a Master Pl�r. Sec. 7-172.5. Display of License (a) Each holder of a license as a Master Plumber shall display his license in a conspicuous place in his principal place of business. (b) Each holder of a Master or Journeyman Pltunber's license shall cariy evidence of proper registration on his person at all times while doing plumbing work and shall produce and exhibit same when requested by any inspector or officer of the City. Sec. 7-172.6. Plumbing Installation or Maintenance by Home Owner Nothing in this Code shall prevent a homeawner from installing or maintaining pltunbing within the property boundaries of his homestead, providing that the owner files with the Building Inspection Department adequate plans and specifications; satisfy the Building Official as to his . ability to install plumbing; provided such work is done by himself and used exclusively by him and his family. Such privilege does not convey the right to violate any of the provisions of this code, nor is it to be construed as e�e�ting any such property cx�mer from obtaining a perm.it, paying the required fees and obtaining all required inspections. Sec. 7-173. Amendments Sec. 20.1 Section 20.1 of the "Uniform Plumbing Code" 1982 Edition, is hereby amended so as to hereinafter read as follaws: The admi.nistration and enforcement of this Code is assigned to the Building Inspection Departsrnnt. Sec. 20.6. Application for Permit Section 20.6 of the "Uniform Pltunbing Code" 1982 Fdition, be, and the same is hereby amended so as to hereinafter read as follaws: Sec. 20.6. Application for Perniit Application for a permit shall be made at the Building Inspection Department on forms provided. Liability Section 20,12 of the "Uniform Pltunbing Code", 1982 Edition, be, and the same is hereby amended so as to hereinafter read as follaws: Sec. 20.12. Liability Any officer or employee, or meml�er of the Board of Adjustment and Appeals, charged with the enforcement of this Code, acting for the City of Grapevine in the discharge of his duties, shall not thereby render himself liable personally, and he is hereby relieved fram all personal liability for any damage that may occur to persons or property as a result of any act required or pernlitted in the discharge of his duties. Any suit brought against any officer or employee, or member of the Board of Adjustrr�nt because of such act performed by him in the enforcement of any provision of this Code shall be defended by the Department of Law until the final termination of the proceedings. Sec. 20.14. Board of Appeals Section 20.14 of the "Uniform Pli.m�bing Code", 1982 F1dition, be, and the same is hereby amendeci so as to hereinafter read as follows: Sec. 20.14. Pltunbing Code Board of Adjustinerit and Appeals (a) Appointment - There is hereby created a board to be knawn as the Plumbing Code Board of Adjustrnent and Appeals. Such Board shall consist of six (6) members, five (5) of which shall be those m�mb�rs of the Housing Advisory and Appeals Board and one (1) licensed and registered Master Pllunber having at least five (5) years experience, skilled in planning, layout of the installation of plLunbing. "Board" mP.mbers shall be appointed by the City Council. Reference to the "Board" shall mean the Pltunbing Code Board of Adjustment and Appeals. (b) Term of Office - The D4aster Pl��ber of the Board shall hold office for a term of two (2) years, and shall serve until his successor has been appointed and qualified. Vacar�cies shall be filled by appointrnent in the m��nner prescribed above. (c) Quorum - Four (4) me.mbers of the Board shall constitute a quorum. In varying the application of any provisions of this Code or in modifying an order of the Plumbing Inspector, affirniative votes of the majority present is required. A Board member shall not act in a case in which he has a personal interest. (d) Compensation - The members of the Board shall serve without co�ensation. (e) Records - The City shall provide a Secreta.ry for the Plumbing Code Board of Adjustrnent and Appeals who shall set forth the reasons for its decisions, the vote of each member participating therein, the absence of a mP_mber, and any failure of a member to vote. Co�lete records shall be kept in the Building Inspection Departrnent. (f) Procedure - The Board shall establish rules and regulations for its awn procedure not inconsistent with the provisions of this Code. The Board shall meet at regular intervals, to be determined by the Chairman, or in any event, the Board shall meet within a reasonable time, without unnecessary delay after notice of appeal has been received. (g) Appeals - Whenever the Pltmibing Inspector shall reject or refuse to approve the mode or manner of pllunbing proposed to be follaved, or materials to be used in the installation or alteration of a plLunbing system or when it is claimed that the provisions of this Code do not apply, or that an equally good or rcx�re desirable method of pl�nbing can be employed in any specific case, or when it is clauned that the true intent and meaning of this Code or any of the regulations thereunder have been miscon- strued or wrongly interpreted, the c�mer of such building or structure, or his duly authorized agent, may appeal from the decision of the P1Lunbing Inspector to the Plumbing Code Board of Adjustrr�ent and Appeals. Notice of appeals shall be in writing and filed within sixty (60) days after the decision has been rendered by the Plumbing Inspector. In case a plLmibing system is unsafe in the opinion of the Pltunbing Inspector, he may, in his order, limit the tiure of such appeal to five (5) days. Appeals hereunder shall be on forms provided by the Building Inspec- tion Departrr�ent. That a new Section 20.14.1 be added so as to hereinafter read as folla,vs: 20.14.1. Decisions of the Plumbing Code Board of Adjustment and Appeals (a) Variations and Modifications - The Pluribing Code Board of Adjust- ment and Appeals, when so appealed to and after a hearing, may vary the application of any provision of this Code to any particular case when, in its opinion, the enforcement thereof would do manifest injustice, and would be contrary to the spirit and purl�ose of this Code or public interest, or when, in its opinion, the interpretation of the Pltunbing Inspector should be modified or reversed. A decision of the Board to vary the application of any provision of this Code or to m�dify an order of the Plumbing Inspector shall specify in what manner such variation or �ification is made, the conditions upon which is made and the reasons therefore. (b) Decisions - Et�ery decision of the Pl�nbing Code Board of Adjust- ment and Appeals shall be final, subject, hawever, to such remedy as any aggrieved party might have at law or in equity. It shall be in writing and shall be promptly filed in the Building Inspection Department Office, and shall be open to public inspection; a copy shall be kept publicly posted in the Building Inspection Department for two (2) weeks after filing. (c) The Board shall, in every case, reach a decision without unrea- sonable or unnecessary delay. (d) If a decision of the Pltanbing Code Board of Adjustment and Appeals reverses or modifies a refusal, order or disallowance of the Pltunbing Inspector, or varies the application of any provision of this code, the Pltunbing Inspector shall im�diately take action in accordance with such decision. " Sec. 201(h) . Section 201(h) of the "Uniform Plumbing Code", 1982 Edition, be, and the same is hereby amended so as to hereinafter read as follaws: (h) When there is insufficient evidence to substantiate claims for alternates, the Building Official may require tests, as proof of com- pliance, to be made by an approved testing agency at the expense of the applicant. If in the opinion of the Building Official, the evidence and proof are not sufficient to justify approval, the applicant may refer the entire matter to the Plumbing Code Board of Adjustrnent and Appeals. Sec. 503 (2) . Section 503 (2) of the "Uniform Plimibing Code", 1982 Edition, be, and the same is hereby amended so as to hereinafter read as follows: (2) ABS and PVC DWV piping installations shall be limited to those structures three stories or less in height. Sec. 701 (d) . Section 701(d) of the "Uniform Plumbing Code", 1982 Fdition, be, and the same is hereby amended so as to hereinafter read as follows: (d) The vertical distance between a fixture outlet and the trap wire shall be as short as practicable, but in no case shall the tailpiece from any f�ture exceed twenty-four (24) inches in length. Sec. 1004 (a) . Section 1004 (a) of the "Uniform P1Lunbing Code", 1982 Edition, be, and the same is hereby amended so as to hereinafter read as follows: (a) Water pipe and fittings shall be of brass, copper, cast iron, galvanized malleable iron, galvanized wrought iron, galvanized steel, lead or other approved materials. Asbestos-cement, PB, PE, CPVC, or PVC water pipe manufactured to recognized standards may be used for cold water distribution syst�ns outside a building. Plastic pipe used inside a building for hot and cold water distribution syst�n shall be approved by the Ac�ninistrative Authority. Section 2. Severability. If any section, article, paragraph, sen- tence, clause, phrase or word in this ordinance, or application thereto to any person or circ�unstance is held invalid or unconstitutional by a Court of corr�etent jurisdiction, such holding shall not affect the validity of the remaini.ng portions of the ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall renbain in full force and effect. Section 3. Penalty. Any person violating any of the provisions of this ordinance shall be deetned guilty of a misdemeanor and, upon convict�on thercof, shall be fined in a sum not to exceed Ztao Hundred Dollars ($200.U0) and a separate offense shall be de�d co�n.itted upon each day durir_g or on which a violation occurs or continues after the notice period provided herein has expired. The Court shall order removal and abatement of the nuisance. Section 4. nnergency. The fact that no present ordinances of the City of Grapevine exist am�nding Grapevine City Code Chapter 7, Article VIII relating to adopting the Uniform Pltmibing Code of 1982 with exceptions creates an urgency and an emergency in the presezvation of the public health, safety, and welfare and requires that this ordinance shall talte effect immediately frc�n and after its passage and the publication of the caption as the law and charter in such cases provides.
