HomeMy WebLinkAboutORD 1983-033 CITY OP GRAPEVINE ORDINANCE NO. g 3-3 3 AN ORDINANCE �NIENDING THE CODE OF THE CITY OF GRAPEVINE CHAPTER 7 ARTICLE I RELATING TO BUSINESS AND CONSTRUCTION BY ADDING A NE�11 SECTION 7.6 RE- LATING TO THE NECESSITY TO HAVE PROPERTY DULY PLATTED AS A CONDITION FOR OBTAINING A BUILDING PERR�IT; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY IN A SUNI NOT TO EXCEED $200 FOR EACH SEPARATE OFFENSE AND A SEPARATE OFFENSE SHALL BE DEERZED CONIMITTED UPON EACH DAY DUR,ING OR ON WHICH A VIOLATION OCCURS; AND DECLARING AN EMERGENCY AND EFFECTNE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE: Section l. That Chapter 7, Article I of the Grapevine City Code is amended by adding a new Section 7-6 as follows: A. Section 7.6 shall hereby read as follows: "No building permit shall be issued for the construc- tion of any new principal improvements on any tract, lot, or parcel of land unless and until a subdivision plat encomp�ssing said property has been duly ap- proved in accordance with all applicable state laws and city ordinances." Section 2. Severability. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto to any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction such holding shall not affect the validity of the remaining portions of the ordinance; and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall reamin in full force and effect. Section 3. Penalty. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdeameanor and upon conviction thereof shall be fined in a sum not to exceed two hundred dollars ($200.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues after the notice period provided herein has expired. The Court shall order removal and abatement of the nuisance. Section 4. Emergency. The fact that no present ordinances of the City of Grapevine e�ists amending City of Grapevine Chapter 7, Article I relating to Business and Construction creates an urgency and an emergency in the preservation of the public health, safety and welfare requires that this ordinance shall take effect immediately from and after its passage and the publication of the caption as the lacv and charter in such cases provides.
