HomeMy WebLinkAboutORD 1983-044 ORDINANCE NO. g3-44 CITY OF GRAPEVINE, TEXAS AN ORDINANCE AMENDING THE CITY COD� OI' THE CITY OF GRAPEVINE, CHAPTER 6, ARTICLES I AND II RELATING TO ANIMALS AND FOWL BY AMENDING SECTION 6-1 DEFINING CERTAIN TERMS; AMENDING SECTION 6-7 RELATING TO INIPOUNDING OF ESTRAYS; AMENDING SECTION 6-9 PRES- ENTLY RESERVED BY ADDING A PROVISION RELATING TO DISPOSAL OF DEAD ANIMALS; PROVIDING A PENALTY NOT LESS THAN ONE DOLLAR NOR MORE THAN TWO HUNDRED DOLLARS, AND THAT EACH DAY A VIOLATION OCCURS SHALL CONSTITUTE A SEPARATE OFFENSE; PROVIDING A SEVERABILITY CLAUSE AND DECLARIIvTG AN EMERGENCY AND EFFECTIVE DATE NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. Chapter 6, Section 6-1 of the City Code of the City of Grapevine, Texas, defining certain terms shall be amended by changing the definition of vicious as it applies to a dog, cat or other domestic animal to read as follows: "Vicious: (When applied to a dog, cat or other domestic animal). Any dog, cat, or other domestic animal within the city that shall bite, scratch or otherwise attack a person, which dog, cat or other domestic animal has previously bitten, scratched or otherwise attacked a person, who is not at the time, trespassing upon the property of the owner or person having control of such animal or who is not otherwise provoking or teasing such animal shall be deemed vicious or dangerous to persons or other animals." Section 2. Chapter 6, Seetion 6-7 of the City Code of the City of Grapevine, Texas, relating to impoundment of estrays shall be amended by changing the fees charged as poundage fees on all estrays as listed in subsection (d) to read as follows: "(1) For impounding, per head . . . . . . . . $20.00 (2) For taking care of animal, per day . . . $5.00" Section 3. Chapter 6, Section 6-9, of the City Code of the City of Grapevine, Texas, presently a reserved section, shall be amended by adding the followirg provision and shall read as follows: "Sec. 6-9. Disposal of Dead Animals. It shall be unlawful for any dead animal to be disposed of within the city by a means other than burying the animal at a landfill site located within the city, if such a landfill site exists, or by a garbage collection or disposal service. The owner of such animal shall be responsible for its disposal." Section 4. Any person or persons who violate any provisions of this ordinance shall be guilty of a misdemeanor �nd shall be fined upon conviction not less than One Dollar nor more than Two Hundred Dollars for each offense, and each day any violation continues shall constitute a separate offense. Section 5. If any section, paragraph, subdivision, clause or phrase of' this ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this ordinance as a whole or any part of any provision thereof other than the part so decided to be invalid or unconstitutional. Section 6. The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals, peace, and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the immediate preservation of public business, property, health, safety, and general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage and it is accordingly so ordained.
