ORDINANCE NO. 83-74

AN ORDINANCE APPROVING, ADOPTING AND RATIFYING THE
REPORT OR STATEMENT OF THE DIRECTOR OF PUBLIC
WORKS OF THE CITY OF GRAPEVINE, TEXAS, OF THE TOTAL
COST OF PAVING AND IMPROVEMENT OF PORTIONS OF
CERTAIN STREETS 1N THE CITY OF GRAPEVINE, TEXAS, TO-
WIT: DOGWOOD DRNE FROM THE NORTH RIGHT-OF-WAY LINE
OF COLLEGE STREET NORTH TO THE SOUTH RIGHT-OF-WAY
LINE OF WALL STREET; DETERMINING THE COST OF SUCH
�� IMPROVEMENTS AND THE AMOUNTS PER FRONT FOOT PRO-
POSED TO BE ASSESSED AGAINST OWNERS OF ABUTTING
PROPERTY; ORDERING AND SETTING A HEARING AT 7:30
O'CLOCK P.M. ON THE 6TH DAY OF DECEMBER, 1983, IN THE
CITY COUNCIL ROOM, 413 MAIN, GRAPEVINE, TEXAS, AS THE
TIME AND PLACE FOR A PUBLIC HEARING OF THE REAL AND
TRUE OWNERS OF THE PROPERTY ABUTTING UPON SAID
STREETS AND CONCEBNING SAID ASSESSMENTS, PROCEED-
INGS AND IMPROVEMENTS; DIRECTING THE CITY SECRETARY
TO GNE NOTICE OF SAID HEARING AS REQUIRED BY LAW;
DECLARING AN EMERGENCY
WHEREAS, the City Council of the City of Grapevine, Texas, has
heretofore ordered that each of the hereinafter described portions of streets in
the City of Grapevine, Texas, be improved;
WHEREAS, the Director of Public Works of the City of Grapevine, Texas,
has prepared and filed with the City Council the total actual cost of such
improvements and his estimates of the amounts per front foot proposed to be
assessed against the abutting property and the owners thereof; and
WHEREAS, the City Council has heretofore determined the necessity of
levying an assessment against the property and the owners thereof abutting upon
the hereinafter described streets;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GRAPEVINE, TEXAS:
Section 1. That the report or statement of estimates filed on or before
October 5, 1982, with the City Council by the Director of Public Works of the
City of Grapevine, Texas, of the total cost of such improvement, are hereby
approved, adopted and ratified and the report or statement of actual costs of
such improvements and the amounts per front foot proposed to be assessed
against the abutting property and the owners thereof having been duly examined
� are hereby approved and adopted.
Section 2. That it is hereby found and determined that the actual cost
of improvements of the hereinafter described street with the amounts per front
foot proposed to be assessed for such improvements against abutting property
and the owners thereof, as shown on Exhibit A attached hereto are as follows,
to-wit:

- It is proposed that the owners of abutting property be assessed as follows:
Curb, gvtter and paving $29.94 per front foot
Amount of cost to be assessed
against abutting property owners $7,706.56

Section 3. That a hearing shall be given to said owners of abutting
property and �11 persons interested in said matter as to the benefits to said
property by reason of said improvements, or any other matter or thing in
connection therewith, which hearing shall be held before the City Council of the
City of Grapevine, Texas, in the City Council Room, 413 Main, Grapevine,
Texas, at 7:30 p.m., on the 6th day of December, 1983, at which time all of said
owners, their agents or attorneys or other interested persons are notified to
appear and be heard, and said hearing shall be adjourned from day to day until
fully accomplished. Said hearing is to be held in accordance with the terms and
provisions of Article 1105b, as amended, of Vernon's Texas Civil Statutes.
_ Section 4. The City Secretary of the City of Grapevine, Texas, is hereby
directed to give notice of the time and place of such hearing and of other
matters and facts in accordance with terms and provisions of Article 1105b, as
amended, of Vernon's Te�as Civil Statutes by advertisement inserted at least
three (3) times in some newspaper published in the City where such special
assessment tax is to be imposed, the first publication of such notice of hearing
to be made at least twenty-one (21) days before the date of the hearing, and
additional written notice of the hearing shall be given by mail at least fourteen
(14) days before the date of the hearing to each of the abutting property owners
and railways, if any, pursuant to Article 1105b, as amended, of Vernon's Texas
Civil Statutes.
Section 5. The fact that the streets and portions thereof improved as
herein provided were in need of being improved without delay created an
emergency and public necessity for the immediate preservation of the public
peace, health and safety which requires that this Ordinance be passed as an
emergency measure and that this Ordinance take effect from and after its
passage, and it is accordingly so ordered and ordained.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
GRAPEVINE, TEXAS, this lst day of November , 1983.
