OF GRAPEVINE, TEXAS, BY AMENDING CHAPTER. 4 RELATING TO ALCOHOLIC BEVERAGES BY AMENDING SECTION 4.7 RE- LATING TO FEES; PROVIDING A PENALTY NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00) AND A SEPARATE OFFENSE SHALL BE DEEMED COMMITTED UPON EACH DAY DURING OR ON WHICH A VIOLATION OCCURS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFEC- TNE DATE AND DECLARING AN EMERGENCY f NOW, THEREFORE> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1. That Chapter 4 of the Code of Ordinances, City of Grapevine, Texas, relating to Alcoholic Beverages is hereby amended in the following particulars and all other existing Sections, Subsections, Paragraphs, Sentences, Definitions, Phrases and Words of said Grapevine Code are not amended, but . shall remain intact and are hereby ratified, verified and affirmed: A. That Section 4.7 relating to Fees is hereby amended to read as follows: Sec. 4-7. Fees - Schedule. There is hereby levied, pursuant to Article 11.38 of the Alcoholic Beverage Code of the State of Texas, the following schedule of fees for a license or permit issued for premises located ;r within the City under the Alcoholic Beverage Code, :which fees shall be equal at all times to one-half of the fee assessed by the State of Texas for each license or permit pursuant to the Alcoholic Beverage Code: � (a) For each mixed beverage permit: First through third years o . . $ 0.00 Fourth and subsequent years (until September 1, 1984) . o . 312.50 Fourth and subsequent years (on and after September 1, 1984) . 375.00 (b) For each retail dealer's off-premise license 30.00 (c) For each mixed beverage late hours permit 75.00 (d) For each beverage cartage permit for each holder of a mixed beverage or private club registration permit . . 10.00 (e) For each private club late hours permit . 375.00 (f) For each caterer's permit . . 250.00 Section 2. If any section, article, paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any person or circumstance is held invalid or unconstitutional by a Court of competent jurisdiction such holding shall not affect the validity of the remaining portions of the ordinance; and the � City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remaining portions shall remain in full ; force and effect. Section 3. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in a sum not to exceed Two Hundred Dollars ($200.00) and a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues. Section �. The fact that the present ordinances and regulations of the City of Grapevine, Texas, are inadequate to properly safeguard the health, safety, morals peace and general welfare of the inhabitants of the City of Grapevine, Texas, creates an emergency for the irnmediate preservation of public business, property, health, safety, and general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage as provided by law and it is accordingly so ordained.
