HomeMy WebLinkAboutORD 1982-072 ORDINANCE NO. g2-72 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS, AMENDING SECTION 25-36 RELATING TO COST DEPOSITS OF WATER, WASTE WATER, AND REFUSE SERVICE; PROVIDING A PENALTY; PROVIDING A SEVERABILITY; PROVIDING AN EFFEC- TIVE DATE; AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS. Se�tion 1 . That Section 25-36 is hereby amended as follows : Single-Family Residential , minimum . . . . $50 . 00 Section 2. Any person violating any of the portions of this ordinance shall be deemed guilty of a misdemeanor and, upon con- viction thereof , shall be fined $1 . 00 to $200 . 00 , and each day ' such violation continues shall constitute a separate and distinct offense. Section 3. If any section, paragraph, sentence , clause , phrase, or word in this ordinance, or application thereto to any person or circumstance , is held invalid or unconstitutional by a court of competent jurisdiction, such holdings shall not aff�ct the validity of the remaining portions of the ordinance, and the City Council hereby declares it would have passed such remaining portions of the ordinance despite such invalidity, which remain- ing portions shall remain in full force and effect. Section 4 . The effective date for charging of the increased utility deposit is November l , 1982 , and all customers shall be charged under the new rate commencing said date. Section 5 . The fact that the present Code of Ordinances for the City of Grapevine, Chapter 25 , Section 25-36 is inadequate creates an urgency and an emergency and, in the preservation of the public health, safety, and welfare , r�q_uires that this ordi- nance shall become effective from and after the date of its passage and the publication of the caption as the law and charter � in such cases provides.
