PLAN, ATTACHID HERE`I'0 AND MADE A PART HEREOF AS F��iIBIT "A��� AND AISO IN ACCORDANCE WITH CON- STRUCTION STANDARDS, ATTAC�� HERE'I'O AND MADE A PART �F AS EXHIBIT "B"; CORRF7C'.P- ING TfiE OFFICIAL ZONII�7G MAP; PRESERVING AT,T, OZ'f�R PORTIONS OF THE ZONING ORDIlVANCE; PROVIDING A CLAUSE RELATING TO SEVER- ABILITY; DEI�RNIII�TING THAT TI� PUBLIC IN`I`ERESTS, MORALS AND GENERAL WEL�'ARE DET'IAND A ZONING CHANGE AND AMENDMIIVri' Tf�RFIN MADE; PROVIDING A PII�LTY; AND DECLARING AN II�RGFNCY WF�FZFFAS, applications were made to an�nd the Official Zoning Map, City of Grapevine, Texas, by making applications for same with t�ie Planning & Zoning Comnission of the City of Grapevi.ne, Texas, as required by State statutes and the zoning ordinances of the City of Grapevine, Te.xas, and all the legal requirements, conditions and prerequisites having been c�lied with, the case having come before the City Council of the City of Grapevine, Texas, after all legal notices requirements, conditions and prerequisites having been camplied with; and, Vu�iEREAS, the City Council of the City of Grapevine, Texas, at a public hearing called by the City Council did consider the following factors in making a deterntination as to whether these requested changed should be granted or denied; safety of the mr�toring public and the pedestrians using the facil- ities in the area i�nediately surround.i.ng the site; safety from fire hazards and measures for fire control, protection of adjacent property from flood or water damages, noise producing elements and glare of the vehicvlar and sta- tionazy lights and effect of such lights on established character of the neighborhood, location, lighting and types of signs and relation of siqns to traffic control and adjacent property, street size and adequacy of width for traffic reasonably e�ected to be generated by the proposed use around the site and in the inunediate neighborhood, adequacy of parking as determined by requirements of this ordinance for off-street parking facilities, location of - ingress and egress points for parking and off-street locating spaces, and protection of public health by surfacing on all parking areas to control dust, effect on the promotion of health and the general welfare, effect on light and _ air, the effect on the overcrowding of the land, the effect on the concen- tration of population, the effect on the transportation, water, sewerage, schools, parks and other facilities; and, Wf�RFFAS, the City Council of the City of Grapevine, �xas, at a public hearing called by the City Council of the City of Grapevine, Texas, did consider the following factors in making a determination as to whether this requested change should be granted or denied; effect on the congestion of the streets, the fire hazards, panics and other dangers possibly present in the securing of safety from same, the effect on the promotion of health and the general welfare, effect on adequate liqht and air, the effect on the overcrowding of the land, the effect on the concentration of population, the effect on the transportation; water, sewerage, schools, parks and other public facilities; and, W�, the City Council further considered am�ng other things the character of the district and its peculiar suitability for particular uses and with the view to conserve the value of buildings, encourage the m�st appro- priate use of land throughout this city; and, -- WI�REAS, the City Council of the City of Grapevine, Texas, does find that there is a public necessity for the zoning change, that the public demands it, that the public interest clearly requires the amenc�.nt, that the zoning changes do not unreasonably invade the rights of those wlw bought or i�raved property with reference to the classification which existed at the time their original investment was made; and, h't-�RE�S, the City Council of the City of Grapevine, Texas, does find that the change in zoning lessens the congestion in the streets, helps secure safety from fire, panic and other dangers; promotes health and the general welfare; provides adequate light and air; prevents the overcrawding of land; avoids undue concentration of population; facilitates the adequate provisions of transportation, water, setiverage, schools, parks and other public require- ments; and, 4VHEREAS, the City Council of the City of Grapevine, Texas, has deternnined that there is a necessity and need for this change in zoning and has also found and deterniined that there ha.s been a change in the conditions of the property surrounding and in close proximity to the property requested for a change since this property was originally classified and therefore, feels that a change in zoning classification for the particular piece of property is needed, is called for, and is in the best interest of the public at large, the citizens of the City of Grapevine, Texas, ancl helps prcmote the general health, safety, and welfare of this caim�unity. NOW, �'ORE, BE IT ORDAINID BY TF� CITY COUNCIL OF 'I'HE CITY OF GRAPEVINE, '1'EXAS: Section l. That the City of Grapevine Ordinance No. 70-10, being the Comprehensive Zoning Ordinance of the City of Grapevine, Texas, same being also lmown as Appendix "A" of the City Code of Grapevine, Texas, be, and the same is hereby amended and changed in that the use of the following described PmPertY, to-wit: TRACT I - 15.08 ACRES OF I,�ND BEING a tract of land situated in the A. F. Leonard Survey, Abstract 946, City of Grapevine, Tarrant County, Texas, and being more particularly de- scribed by metes and bounds as follaws: BEGINNING at the point of intersection of the west line of Boyd Drive and the north line of Turner Rc�ad; - TI-�10E South, 89° 44' 58" West, 905.56 feet along said north line of Turner Road to a point for corner; Tf�IC:E North, 00� 00' 40" West, 703.30 feet to a point for corner in the south line of Peach Street; � Tf�VCE North, 89° 30' S4" East, 935.72 feet along said south line of Peach Street to the intersection with said West line of Boyd Drive, a point for corner; Z�NCE South, 507.40 feet along said West line of Boyd Drive to a point for corner; Tf-IEIV(� South, 08° 32' 12" West, 202.10 feet continuing along said West line of Boyd Drive to the Point of Beginning and containing 15.08 acres of land, mpre or less; which, in accordance with Ccanprehensive Zoning Ordinance No. 70-10, was previously zoned "C-2" Co�ra�iunity Business District is hereby changed to "PD" Planned Development District for multi-family residential dwellings; providing for a maxim�un density of 20 dwelling units per acre; providing for 2 1/2 parking spaces per dwelling unit; in accordance with a development plan, attached hereto and made a part hereof as �hibit "A"; and also in accordance with construction standards, attached hereto and made a part hereof as �chibit "B". TRACT II - 14.76 ACRES OF LAND BEING a tract of land situated in the A. F. Leonard Survey, Abstract 946, City of Grapevine, Tarrant County, Texas, and being more particularly de- scriUed by metes and bounds as follows: BEGINNING at the point of intersection of the east line of Boyd Drive and the south line of Wilclwood Drive; TF�TC� North 89° 23' 30" East, 350.00 feet along said south line of Wildwood Drive to a point for corner; Z�10E South, 1,019.80 feet to a point for corner; TH�ICE East, 626.30 feet to a point for corner; Tf�10E South, 479.50 feet to a point for corner on the proposed north line of Turner Road; TFIENCE along said north line of Turner Road and around a curve to the right having a central angle of 44° 27' 42", a radius of 470.00 feet, and a chord bearing North 67° 46' 09" West, for an arc length of 364.72 feet to a point of reverse curve for corner; Tf-�10E continuing along said proposed north line $f 'hirner Road and around a curve to the left having a central angle of 44 27' 42", a radius of 530.00 feet and a chord bearing North 67° 46' 09" West, for an arc length of 411.28 feet to the end of said curve, a point for corner; Tf�tCE West, 275.84 feet along the north line of said Turner Road to the intersection with said east line of Boyd Drive, a point for corner; Tf�TCE North, 1,209.30 feet along said east line of _Boyd Drive to the Point of Beginning and containing 14.76 acres of land, mpre or less; which, in accordance with Co�rehensive Zoning Ordinance No. 70-10, was previously zoned "C-2" Comrnznity Business District is hereby changed to "PD" Planned Develop- ment District for multi-family residential d�ellings; providing that the portion of Tract II north of the center line of Peach Street shall have a maximum density of 12 dwelling units per acre with a mininn�n of 2 parking spaces per dwelling un:i.t; providing that the remainder of Tract II shall have a mini.urnun parking requirement of 2 1/2 parking spaces per clwelling unit with a maxim�n of 20 dwelling units per acre; in accordance with a developrr�nt plan, attached hereto and m�ade a part hereof as E�hibit "A"; and also in accordance with construction standards, attached hereto and made a part hereof as Exhibit ��B�,. Section 2. The City Manager is hereby directed to correct the official zoning map of the City of Grapevine, Texas, to reflect the herein change in zoning. Section 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said City of Grapevine zoning ordinance and all other applicable and pertinent ordinances of the City of Grapevine, Texas. Section 4. That the zoning regulations and districts as herein estab- lished have been made in accordance with the co�rehensive plan for the purpose of promoting health, safety, morals and the general welfare of the c�ar�nity. They have been designed with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future, to lessen congestion in the streets; to secure safety fran fire, panic, flood and other dangers; provide adequate light and ai.r; to prevent overcrowding of land, to avoid undue concentration of population; facilitate the adeguate provisions of transportation, water, sewerage, drainage and surface water, parks and other public requirements, and to make adequate provisions for the normal business, corHnercial needs and development of the comnunity. They have been made with reasonable consideration, among other things, of the character of the district, and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging t':e ::nst appro- priate use of land throughout the c�rnanity. Section 5. This ordinance shall be cuniulative of all ott�-er ordinances ot the City of Grapevine, Texas, affecting zoning and shall not repeal anv of the provisions of said ordinances except in those instances where provisions of those ordinances which are in direct conflict with the pro�-isions of this ordinance. Section 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoni:g affecting any portion of the tract or tracts of land descri.bed herein shall be declared to be invalid, the same shall not affect the validity of the �oning of the balance of the tract or tracts of land described herein. Section 7. That any person, finn or corporation violating any of the terms and provisions of this ordinance shall be subject to tt:e same penalties as provided for in Ordinance No. 70-10, Zoning Ordinance of the City of Grapevine, Texas. Section 8. The fact that the present zoning ordinance and regulations of the City of Grapevine, Texas are inadequate to properly safeguard the health, safety, mr�rals, peace, and general welfare of the inhabitan'-�s of the City of Grapevine, Texas, creates an emergency for the inanediate presezvation of the public business, property, health, safety and general caelfare of the public which requires that this ordinance shall bec� effective frcgn and after the date of its final passage, and it is accordingly so ordained.
