HomeMy WebLinkAboutORD 1982-079 ORDINADICE NO. 82-79 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS , AMEND- ING CHAPTER 18 , SECTION 18-104 OF THE GRAPEVINE CITY CODE RELATING TO NEPO- TISM; REPEALING CONFLICTING ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS: Section 1 . That Chapter 18 , Section 18-104 of the Gra�evine Cit� Code relating to nepotism is hereby amended to read as follows : "All personnel actions of the City shall comply with Section 11 . 03 of the City Charter. In addition, no employee may directly or indirectly supervise or be supervised by a member of his/her immediate family. In the event that two employees in a department become related by marriage, one employee must either resign or transfer to another department. For purposes of this rule , immediate family includes spouse , parent, step-parent, parent-in-law, child, stepchild, brother, sister, stepbrother , stepsister , brother-in-law, sister-in- law, grandparent , grandchild, and any relative or other person living in the same household as the employee. An exception may be authorized by the City Manager if two employees in a department become related by marriage (but not to each other) and both have been employees of the City for two or more years. Whether this exception is granted is solely at the discretion of the City Manager . If the City Manager grants approval , such approval Fnay be with- drawn at any time that the City Manager or his designate believes that continued employment of the two persons is no longer in the best interest of the City. If two employees in the same department become married to each other , one must either transfer to another City department or resign from the City service . The City Manager may waive the provisions of this section for temporary or emergency appointees when it is in the best interest af the City to do so. " Section 2 . R�peal of Conflicting Ordinances and Rules . All previous conflicting Personnel Rules and Regulations applicable to City employees are hereby repealed. The policy contained herein is hereby declared to be the official nepo- tism regulations of the City of Grapevine , Texas , provided that the rule shall not supercede any rule or regulation oi any employee set forth in the City Charter nor in any statute of the State of Texas. Section 3. Severability. That the terms and provisions of this ordinance shall be deemed to be severable , and that if the validity of the personnel policy affecting any portion of the rules and regulations described herein shall be declared to be invalid, the same shall not affect the validity of the personnel policy or the balance of the rules or regulations described therein. Section 4 . Declaring an Emergency. The fact that the present personnel ordinance of the City is inadequate to properly safeguard the health, safety, morals , peace , and general welfare of the employees of the City creates an emergency for the immediate preservation of the health, safety, and general welfare of the employees , which requires that this ordinance shall become effective from and after the date of its final passage, as provided by the Charter of the City, and it is accordingiy so ordained.
