ORDINANCE NO. 82-81
AN ORDINANCE ABANDONING AND VACATING
A PORTION OF A UTILITY EASEMENT IN THE
CITY OF GRAPEVINE, TEXAS , AS HEREINAFTER
DESCRIBED; PROVIDING A SEVERABILITY
CLAUSE; AND DECLARING AN EMERGENCY
[aHEREAS, the owner of Lot 1 , Block 2 , Highland Greens
Addition, in the City of Grapevine, Texas , has requested
that a portion of a utility easement, as hereinafter de-
scribed, be abandoned and vacated; and
[9HEREAS, a portion of the utility easement, as herein-
after described, is not now needed for public use and will
not be needed in the future for public use; and
WHEREAS, abandoning and vacating a portion of the
utility easement will relieve the City of Grapevine , Texas
from the cost and expense of maintaining said property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF GRAPEVINE, TEXAS:
Section l . That the most southerly five f�et (5' ) of
a ten foot (10 ' ) utility easement located along and parallel
to the north lot line of Lot 1 , Block 2 , of Highland Greens
Addition, Grap�vine, Texas, described in Exhibits "A" & "B" ,
attached hereto and made a part hereof , is hereby abandoned
and vacated for public use and the same is hereby abandoned
and vacated insofar as all public right, title , and interest
in and to said described utility easement is concerned.
Section 2 . That the terms and provisions of this ordi-
nance shall be deemed to be severable and that if the valid-
ity of any section, subsection, word , sentence , or phrase
shall be held to be invalid, it shall not affect the remain-
ing part o� this ordinance.
Section 3. The fact that a portion of said utility
easement is no long�r needed by the public for public usage
and would create a hardship or burden upon the City of Grape-
vine to keep open and maintain such utility easement creates
an urgency and an emergency for the immediate preservation of
the public health, safety, and general welfare , which requires
that this ordinance shall take effect immediately from and
after its passage, and it is accordingly so ordained.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF
( GRAPEVINE, TEXAS on this the 21st day of December , 1982 .

Addition, City of Grapevine, Tarrant County, Texas, as shown in Volttme 388-
142, Page 11 , Tarrant County Deed Records, Tarrant County, Texas;
Thence, S 53°, 26' W along the P�orth property line of said lot, a dis-
tance of 5 feet;
Thence, S 0° 10' East, parallel to and 5 feet 4lest of the East property
line of said lot to the true point of beginning of the herein described
tract; �
Thence S 53° 26'- W, parallel to and 5 feet South of the North line of
said lot, a distance of 192,53 feet, more or less, to a point in the West
property line of said lot, said property line also being on a curve to the
1eft; ,
Thence, along said curve to the left, a distance of 8.-42' more or less,
to a point, said point bears S 36° 44' E a distance of 10' from the North
line of said lot;
. Thence, N 53° 26' E, parallel to and 10 feet South of the North line
of said lot, a distance of 182.04 feet, more or less, said point being on
the West line of a 5' utility easement to the true point of beginning, and
containing 948.9 square feet, more or less.
