HomeMy WebLinkAboutORD 1981-029 ORDINANCE NO. 81-29 AN ORDINANCE AMENDING THE CITY CODE OF THE CITY OF GRAPEVINE, TEXAS BY AMENDING APPENDIX A - THE ZONING ORDINANCE OF THE CITY BY ADDING SUBSECTION (31) TO SECTION 7-1002 THE SPECIFIC USE PERMIT DISTRICT TO PERMIT, ALLOW, AND REQUIRE BILLIARD HALLS AND SKILL OR PLEASURE COIN OPERATED MACHINES AS PRINCIPAL USES IN A SPECIFIC USE PERI�TIT DISTRICT ONLY; PROVIDING A PENALTY; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPE- VINE, TEXAS : Section 1. That Section 7-1002 of Appendix A of the City Code of the City of Grapevine, the Zoning Ordinance, is hereby amended by adding a new section 31 relating to "Billiard Halls" and "Skill or Pleasure Coin Operated Machines" , said new section 31 is to read as follows : (31) Billiard Table and Coin Operated Machines (A) Definitions: l. Billiard Table: Any table surrounded by a ledge or cushion, with or without pockets , upon which balls are impelled by a stick or cue, and where the player thereon does not or is not required to make a coin deposit causing an electrical connection of any nature or kind before such game may be actually commenced. 2. Skill or Coin Operated Machines : Means every coin operated machine of any kind or character whatsoever, when such machine or machines dispense or are used or are capable of being used or operated for amusement or pleasure or when said machines are operated for the purpose of dispensing or affording skill or pleasure, or for any other purpose other than the dis- pensing or vending of inerchandise, music or service as those terms are defined in Title 122A Taxation-General of the Laws of the State of Texas. The use of eight (8) or more such machines at any one location shall constitute a principal use. (B) Notwithstanding any other provision of this ordinance or of any ordinances of the City the commercial use of a Billiard Table or the commercial use of eight (8) or more skill or coin operated machines shall be illegal unless the property is zoned specifically for that purpose in accordance with and pursuant to the "SP" Specific Use Permit District Zoning Category. Section 2. That any person, firm or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in Ordinance No. 70-10, Zoning Ordinance of the City of Grapevine, Texas. Section 3. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land des- cribed herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of the tract or tracts of land described herein. Section 4. The fact that the present zoning ordinance and regulations of the City of Grapevine, Texas are ina�equate to properly safeguard the health, safety, morals, peace, and general welfare of the inhabitants of the City of Grapevine, Texas creates an emergency for the immediate preservation of the public business, property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its passage, and it accardingly so ordained.
