HomeMy WebLinkAboutORD 1981-039 ORDINANCE NO. 81-39 AN ORDINANCE AMENDING SECTION 7-91 OF THE GRAPEVINE CITY CODE BY PROVIDING FOR THE ADOPTION OF THE 1981 EDITION OF THE NATIONAL ELECTRICAL CODE; PRO- VIDING FOR THE REPEAL OF PRIOR CON- FLICTING ORDINANCES; PROVIDING A PEN- ALTY; PROVIDING A SEVERABILITY CLAUSE; AND DECLARING AN EMERGENCY BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAPEVINE, TEXAS : Section 1. Adoption and Amendmer�t. Article III , Section 7 , Division 4 of the Grapevine City Code relating to electrical codes is hereby amended by adding and amend- ing certain sections as follows : (a) Section 7-91 (a) is hereby amended to read as follows: • There is hereby adopted by the City of Grapevine, Texas for the purpose of pre- scribing regulations, governing conditions hazardous to life and property that cer- tain 1981 edition of the National Elec- trical Code, and it is hereby incorporated herein as if fully set out in length herein and from the date on which this ordinance shall take effect, the provisions thereof shall be controlling within the limits of the City of Grapevine with amendments as herein noted in Section 7-97 . (b) Section 7-91 (b) is hereby amended to read as follows : If any portion of the 1981 edition of the National Electrical Code conflicts with any other section or subsection of this electrical code, the City Electrical Code shall prevail over the National Electrical Code. (c) A new Section, 7-97 , is hereby added to read as follows : Amendments to the 1981 edition of the National Electrical Code: (1) Al1 persons using power from all 120 volt single phase 15 and 20 ampere receptacles on construction sites shall furnish their own ground-fault circuit interrupters, connected to cords receiving energy from the temporary pole to protect them from electrical shock or GFCI breakers must be installed at the temporary pole, or as provided in Article 210-8 {b) of the NEC. (2) Article 310-14 of the National Elec- trical Code is hereby amended to read as fcllows : There shall be no aluminum wire in the house past the service smaller than a No. 2 thw. (3) The National Electrical Code is hereby amended to include the following: No more than eight (8) current consuming outlets on a No. 14 wire and no more than ten (10) current consuming outlets on a No. 2 wire. (4) Article 351-4 of the National Electrical Code is hereby amended to include the following: All outside air conditioning units must be wired in a liquid tight flexible conduit. (5) Article 351-8 of the National Electrical Code is hereby amended to include the following: On air conditioning units , anything longer than six feet must be supported. (6) The National Electrical Code is hereby amended to include the following: Wiring in attics must be kept in a three foot height or less section of the attic space for home runs or as per Article 333-12 of the National Electrical Code. Section 2 . Repeal. This ordinance repeals those provi- sions , and only those provisions, of all ordinances in conflict with the provisions hereof. Section 3. Penalty. That any person, firm or corporation violating any of the terms and provisions of this ordinance shall be subject to the same penalties provided for in Article III , Section 7-91 (c) Electrical Code of the City of Grapevine, Texas. Section 4 . Severability. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of any section, subsection or paragraph of this ordinance shall be declared invalid, the same shall not affect the validity of the balance of this ordinance. Section 5. Emergency. The fact that the present elec- trical ordinance and regulations of the City are inadequate to properly safeguard the health, safety, morals , peace and general welfare of the inhabitants of the City creates an emergency for the immediate preservation of the public busi- ness , property, health, safety and general welfare of the public which requires that this ordinance shall become effective from and after the date of its final passage, as provided by the Charter of the City, and it is accordingly so ordained.
